Chapman Avenue, Orange, California. 4:30 P.M. SESSION 1. CONSENT CALENDAR 2. 1 Declaration o( the Assistant Clerk of the Orange Redevelopment Agency, Cassandra J. Cathcart,declaring posting of Orange Redevelopment Agency Agenda of regular meeting of May 9, 1995 at Orange Civic Center, Main Library, the Police Facility at 1107 N. Batavia and the Eisenhower Park Bulletin Board; all of said locations being in the City of Orange and freely accessible to members of the public at least 72 hours before commencement of said regular meeting.ACTION: Accepted Declaration of Agency Posting and authorized its retention as a public record in the Office of the Agency Clerk.2.2 Authorize Chairman and Director of Finance to draw warrants on Agency's Fiscal Agent in payment of demands.ACTION: Approved.REMOVED AND HEARD SEP ARATEL Y)2.3 RESOLUTION NO. The Community Development Block Grant Manager explained the details of the Owner Participation Agreement, and indicated Fairway Manor is located near the Rehabilitation Institute (RIO) site on Tustin and Fairway Avenue. (RA2100.0.Agr.2386)FISCAL IMP ACT: The funds are available for the OUSD site in Account No. 920-9811-426700 Other Professional and Consulting Services) and funds are available for the Anaconda site in Account No. 930-9821-426700 ( Other Professional and Consulting Services).The City Attorney advised that when Eberhart and Stone submitted their proposals, they attached a standard contract and some of the provisions were not acceptable to the City. ORA-0289 A Resolution of the Orange Redevelopment Agency approving and authorizing the execution of a Participation Agreement by and between the Orange Redevelopment Agency and Santa Fe Pacific Pipeline Partners, L. P. (R3500.0)The City Attorney recommended the action be a Resolution of the Orange Redevelopment Agency approving and authorizing the execution of the agreement as long as such agreement is substantially in the form as submitted to the Agency Board.It was further recommended the resolution be adopted by title only because there are some provisions in the resolution that need to be in the agreement itself, but not necessarily in the resolution.MOTION SECOND AYES Barrera Spurgeon Murphy, Barrera, Mayor Coontz, Spurgeon, Slater Moved to adopt Resolution No. ORA- 0289 as written as long as such agreement is substantially in the form submitted to the Agency Board and that the resolution is being adopted by title only.ACTION: Approved.MOTION SECOND AYES Murphy Barrera Murphy, Barrera, Coontz, Spurgeon, Slater Items 2. 3,2.4,2.5 and 2.6were removed from the Consent Calendar. Agency Director Spurgeon abstained from Item 2.4 and Agency Director Slater abstained from Item 2.5. All remaining items on the Consent Calendar were approved as recommended. ( RC2500.F)MOTION - Slater SECOND - Murphy AYES - Murphy, Barrera, Coontz, Spurgeon, Slater Moved that the item required immediate action and the need to discuss this item arose after the posting of the Agenda.The City Attorney advised that the Redevelopment Agency needs to withdraw its money as well as the City.MOTION - Spurgeon SECOND - Murphy AYES - Murphy, Barrera, Coontz, Spurgeon, Slater Moved to approve the modifications and authorize the Chairman and Assistant Clerk of the Redevelopment Agency to execute the modifications.8.
