A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE APPROVING A SPECIFIC PLAN
AMENDMENT TO REDESIGNATE APPROXIMATELY
17.12 ACRES OF PROPERTY INTO THE CHAPMAN
UNIVERSITY SPECIFIC PLAN. A PORTION OF THIS
AREA WOULD BE REDESIGNATED FROM THE SANTA
FE DEPOT SPECIFIC PLAN. THE PORTION OF THE
AREA IN THE SOUTHWEST PROJECT AREA IS
DELETED FROM THE SOUTHWEST PROJECT AREA
DESIGN ST ANDARD. THE CURRENT CHAPMAN
UNIVERSITY SPECIFIC PLAN CONSISTS OF
APPROXIMATELY 40.35 ACRES. THIS AMENDMENT
WOULD EXPAND THE BOUNDARIES OF THE CURRENT
SPECIFIC PLAN TO A TOTAL OF APPROXIMATELY
57.47 ACRES.
SPECIFIC PLAN AMENDMENT NO.5
APPLICANT: CHAPMAN UNIVERSITY
WHEREAS, Chapman University has filed an application with the City requesting an
amendment to the Chapman University Specific: Plan to redesignate approximately 17.12 acres
of property to be included into the Specific Plan; and
WHEREAS, Amendment No.5 to the Chapman University Specific Plan would amend
the existing boundaries of the Specific Plan to a totaI area of 57.47 acres, as is more specifically
shown on Exhibit A; and
WHEREAS, the Planning Commission reviewed ..<\mendment No 5 to the Chapman
University Specific Plan; and
WHEREAS, the City Council has held a duly advertised public hearing on November
12, 2003 for the purpose of considering, among other things, Amendment No. 5 to the
Chapman University Specific Plan, an amendment to the existing boundaries of the Specific
Plan, as described in Exhibit A; and
WHEREAS, in compliance with the California Environmental Quality Act (CEQA) the
State CEQA Guidelines the City has prepared Final EIR No. 1717-03 (hereinafter FEIR)
to evaluate the potential adverse environmental effects of the project and Amendment No.5 to
the Chapman University Specific Plan;
and WHEREAS, by Resolution No. 9799 the City Council certified FElR No. 1717-03
at a legally noticed
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF' THE CITY
OF ORANGE MAKES THE FOLLOWING FINDINGS:
1. FEIR No. 1717-03 was considered prior to approval of Amendment No.5 to
the Chapman University Specific Plan and determined to adequately address all potential
adverse environmental impacts ofthe proposed project and meets aU CEQA and City
requirements.2. That findings have been adopted as set forth in Section 21081 of CEQA
and Section 15091 of the CEQA Guidelines with respect to each significant environmental
effect identified in the FEIR and each alternative considered in the FEIR and the explanation of
the City Council's reasoning with respect to each such finding as set forth in the Statement
of Overriding Considerations and incorporated herein by reference as is fully set
forth.3. That the unavoidable significant environmental of facts of Amendment No.5
to the Chapman University Specific Plan that have not been reduced to a level of
insignificance have been substantially lessened in their severity by the imposition of mitigation measures
and that the remaining unavoidable significant impacts are clearly outweighed by the
economic,social and other benefits of the project is more fully set 10rth in the Statement of
Overriding Considerations, which is incorporated herein by
reference.4. That it approves Amendment No.5 of the Chapman University Specific Plan
to establish the boundaries of the Specific Plan in accordance with the map attached as Exhibit
A.5. That Amendment No.5 to the ChapmaIl University Specific Plan is in the
public interest which is fully set forth in the Statement of Overriding Considerations which has
been incorporated herein by
reference.6. That area of the Santa Fe Depot Specific Plan that is included in the
Chapman University Specific Plan as is more specifically shown in Exhibit B is hereby deleted from
the Santa Fe Depot Specific
Plan.7. That area of the Southwest Redevelopment Area that is included in
the Chapman University Specific Plan, as is more speeifically shown in Exhibit B, is
hereby deleted from the Southwest Project Area Design Guide:
