A RF.SOLUTION OF THE. CITY COUNCIL OF THE
CITY OF ORANGE AN[ENDING THE MASTER
SCHEDULE OF F+.ES AND CHARGES AS
AUTHORIZED BY ORANGF, MUNICIPAL CODE
CHAPTER 3.10 RELA7'ING TO PARKING FINES.
WHEREAS, pursuant to Chapter 3.10 o f the Orange Municipal Code, the City Council
has established and maintained a Master Schedule of Fees and Charges, consisting of fees and
charges for services provided by the City to persons using such services; and.
WHEREAS, in accordance with the mandat of Chapter 3.10 of the Orange Municipal.
Code, the Master Schedule of Fees and Charges h,as been periodically amended and revised
from time to time by the City Council; the last t:ime being April 22, 2003, when Resolution No.
972: was adopted by the City Council; and
WHEREAS, the City Council hereby fi:ds and determines that the Master Schedule of
Fees and Charges should be amended, in pari, in orcier to reflect the true cost of services
pro ided by the City in connection with regizlating a:ny violation of the standing or parking of a
vehicle under Title 10 of the Orange Munic;ipal and. certain sections of the California Vehicle
Code and an amount that would deter such activity.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orange
as fc llows:
1.The Master Schedule of Fees and Ch.arges is hereby amended and Attachment
A to this Resolution is liereby adopted, modifying tYie T Iaster Schedule of Fees and Charges to
pro ide for the inclusion and revision of the amount of parking fines as more particularly
described on said Attachment A.
2.The City Council finds that the arking fines set forth in Attachment A do not
exce;ed the reasonable costs of services pro`ided by the City in connection with regulating any
viol;tion of the standing or parking of a vehicl; under Title 10 of the Orange Municipal or of
certain sections of the California Vehicle Code alon; with an amount that would act as a
dete rrent to future acts in violation of said regulation,s.
3.The parking fines listed in Attacllmetit A shall be effective as of the date of the
adoption of this Resolution, except where noted.
4.If any parking fine set forth in this R.esalution or the application thereof to any
person or circumstance is held to be unconsti:tutional or otherwise invalid by any court of
competent jurisdiction, such invalidity shall not affe;ct any other fee, charge, or rate, or
application thereof, which can be implement,d ithout the invalid fee, charge, or rate, or
application thereof, and to this end the fees, charges and rates of this Resolution are declared to
be :>everable.
