A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AUTHORIZING SUBMISSION
OF AN APPLICATION TO THE CALIFORNIA
DEPARTMENT OF PARKS AND RECREATION
FOR GRANT FUNDS IN THE AMOUNT OF $584,000
FROM THE PER CAPITA GRANT PROGRAM
UNDER THE CALIFORNIA CLEAN WATER,
CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND
COASTAL PROTECTION ACT OF 2002
WHEREAS, the people of the State of California have enacted the Per Capita Grant
Program (the Program) under the California Clean Water, Clean Air, Safe Neighborhood Parks,
and Coastal Protection Bond Act of 2002 (the Bond Act), which provides funds in the form of a
grant for the acquisition and development of neighborhood, community, and regional parks and
recreation lands and facilities; and
WHEREAS, the California Department of Parks and Recreation, Office of Grants and
Local Services (the Department) has been delegated the responsibility for the administration of
the Program and, to that end, has developed a procedural guide (the Procedural Guide) to assist
with the application and administration process for the Program; and
WHEREAS, the Department has notified the City that allocations under the Bond Act
have been included in the State of California fiscal year 2003-04 budget and that the City
will receive the sum of$584,000;
and WHEREAS, in order for the City to encumber those funds, it is required under
and pursuant to the Procedural Guide to submit an authorizing resolution of this City Council to
the Department and, thereafter, enter into a Grant Contract with the State of California for one
or more projects to be identified by the City Manager in consultation with the City's Director
of Community Services, which qualify under the Program and its Procedural Guidelines [
herein referred to as the "Proj ect( s )"];
and
I WHEREAS, the City Council desires to apply to the Department for a grant of
funds from the Program in the amount of $584,000 to help the City pay for a portion of eligible
costs of construction and development of one or more
Projects.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange as
follows:1. The foregoing recitals are true and
correct.2. The City Council hereby approves the filing of an application with
the Department for local assistance funds from the Program in the amount of$584,
3. The City Council hereby certifies that the City of Orange has or will have
sufficient funds to operate and maintain the Project(s) for which such funds are used.
4. The City Council hereby certifies that the City of Orange has reviewed,
understands, and agrees to the General Provisions contained in the form of the Grant Contract
set forth in the Procedural Guide.
5. The City Council hereby appoints the City Manager (or his designee) as agent of
the City to identify one or more Project(s) which qualify under the Program and its Procedural
Guidelines and to conduct all negotiations, execute and submit all documents including, but not
limited to, applications, agreements, payment requests and such other documentation as the
City Manager deems necessary and appropriate to consummate the transaction contemplated by
the adoption of this Resolution and to administer the City's obligations, responsibilities and
duties to be performed hereunder and under any agreement entered into with the State of
California or any of its authorized departments or agencies in connection with the Program.
