A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING RUNOFF
MANAGEMENT PLANS FOR THE SANTIAGO
HILLS II AND EAST ORANGE PLANNED
COMMUNITIES (ROMPS)
APPLICANT: THE IRVINE COMPANY

WHEREAS, the City Council has authority per Mitigation Measure W-4 of 2000 Final
SEIR 1278 for Santiago Hills II Planned Commnnity to consider the preparation of a Runoff
Management Plans for the Santiago Hills II and East Orange Planned Communities (ROMPS); and
WHEREAS, the applicant prepared ROMPS that covered the entire study area and the
applicant filed the draft ROMPS with the County of Orange and the City of Orange; and
WHEREAS, the City of Orange retained the firm of URS to provide a peer review of the
ROMPS and both the City of Orange and County of Orange reviewed the draft ROMPS and
provided comments; and
WHEREAS, Pursuant to the authority and criteria contained in the California
Environmental Quality Act (CEQA), the Community Development Director analyzed the proposal
and determined that the project will have a potentially significant adverse effect on the
environment. A Draft Environmental Impact Report (Draft SEIR 1278/Draft EIR 1716) was
prepared and circulated for public review for a period of at least 45 days, from October 20, 2004
through December 6, 2004. The Final Environmental Impact Report for the Santiago Hills II and
East Orange Planned Communities and required discretionary permits is complete and adequate
for the consideration of the ROMPS. Resolution 10018 has been passed, approved and adopted by
the City Council on November 8, 2005, certifying Final SEIR 1278/Final EIR 1716,
SC#1988110905 and adoption of a Statement of Overriding Considerations and a Mitigation
Monitoring Program for the Santiago Hills II and East Orange Planned Communities and all
required discretionary permits; and
WHEREAS, the ROMPS was circulated for an initial review in October 2004, and upon
review from the City of Orange, County of Orange and general comments from the public, the
ROMPS was revised and the revised copy of the ROMPS was available to the general public in
May 2005; and
WHEREAS, the Planning Commission conducted a public hearing for the SHII/EOPC
project on July 18, 2005, continued the item to August 15, 2005 and adopted Planning
Commission Resolution No. PC 29-05 on August 15, 2005, recommending approval of the
ROMPS; and
WHEREAS, the City Council conducted a duly advertised public hearing on September
27,2005, continued the item to October 11,2005, to October 25, 2005 and again to November 8,
2005, at which time interested persons had an opportunity to testifY either in support of or
opposition to the adoption of the ROMPS for Santiago Hills II and East Orange Planned
Communities, upon property described as follows:

NOW, THEREFORE, BE IT RESOLVED that the City Council approves the
ROMPS for Santiago Hills II and East Orange Planned Commnnities as shown in Attachment
B on file in the City Clerk's Office and incorporated by this reference and which encompasses
the following documents:
o Santiago Hills II Planned Commnnity and East Orange Planned
Community Area 1 Runoff Management Plan, Storm Water
Hydrology dated May 2005.
o Storm Water Hydrology Volume 1 Planning Level Hydrology
Analysis for East Orange Planned Community Areas 2 & 3 and golf

based on the following findings:
SECTION 1 - FINDINGS
1. The ROMPS includes hydrology and flood protection that confirms that post-
development storm flows from the proposed project to Peters Canyon
Reservoir are consistent with available detention capacity and will not exceed
previously established limits for releases to Handy Creek and capacity
facilities in Santiago Hills 1.
2. Flows diverted to Santiago Creek will have a negligible increase in the total
flows in the creek and have an insignificant impact of the creek's hydraulics
and operations of Villa Park Dam and Irvine Lake.
3. By conveying flows through storm drains, the project will substantially reduce
the current volume of sediment produced within the project's watershed area.
4. Storm flows are diverted from Irvine Park by either routing the storm flow to
the north of the improved park area or to the south of the Irvine Park
boundaries.
5. Peak storm flows are reduced through the use of detention facilities.
6. Detention facilities and energy dissipaters are employed to protect against
adverse scour and lateral bank erosion to Peters Canyon Park and Irvine
Regional Park.
7. The general principals for control of sedimentation during construction
described in the ROMPS are appropriate for the project.
8. Additional storm water facilities are added to the Jamboree Road area to
maintain free flow of storm waters to Peters Canyon for runoff exiting from
Santiago Hills II development area.
9. The ROMPS establishes specific requirements for structural and non-
structural Best Management Practices (BMP). The BMPs will effectively
manage all constituents of concern from each drainage area.
I Dry weather flows are diverted to detention basins, bio swales and riparian
areas prior to entering Peters Canyon Regional Park, and the ROMPS project
that most or all of dry weather flows will not leave the project site.
11. A series of natural treatment train BMP's are employed that will effectively
manage the water quality of runoff from the project area to levels equal to or
better than current conditions.

12. The surface water associated with the Project is not included in the 2002
303(d) List of impaired waters.
13. The water quality features proposed in the ROMPS are consistent with the
requirements of the Orange County Model Water Quality Management Plan
WQMP) at this stage of project consideration.
14. Natural riparian areas in Santiago Hills II are preserved and will serve as
habitat protection and water quality enchantment.
15. An aeration system is proposed for Peters Canyon Reservoir that can
positively alter water quality in the reservoir over the existing conditions.
16. The County of Orange has approved the ROMPS as shown in a letter on file
with the City of Orange and dated May 2,2005.
17. The firm of URS that provides peer review for the ROMP has recommended
approval of the ROMP as shown in a letter on file with the City of Orange and
dated May 19, 2005.

hnplementation of the ROMPs will be consistent with the Public Park
Preservation Act, Public Resources Code 99 5400-5409 (Act), which provides
in relevant part that (1) no city can acquire real property which is in use as a
public park for the purpose of utilizing that property for "non-park" purposes
unless it pays or transfers to the entity operating the park sufficient
compensation or land to replace the park land acquired (9 5401) and (2) the
Act does not apply to acquisition for the construction or maintenance of
underground utility services (95402). Two features of the ROMP will require
that the County of Orange grant easements to the City over public park
property: the West Stilling Basin in Irvine Regional Park and the outlet
structure at Peters Canyon Reservoir. The City finds that the Act does not
apply to such easements for either of these features because:
a) the acquisition of easements by the City for the underground structures
associated with the West Stilling Basin and Outlet 2C would not be
covered by the Act because these structures are associated with
underground utility services;" and
b) the easements for the above-ground permanent structures associated
with these features would make the same use of the parks for drainage that
currently exists, albeit without the structures (e.g., pipe outlet, rip rap,
basin), in that the West Stilling Basin will be placed in an unimproved
area of the Irvine Regional Park within the Villa Park Dam inundation
area, and at Peters Canyon Reservoir, Outlet 2C will be placed in an
unimproved area which currently receives drainage.
Therefore, the City finds that the Act does not apply to its future acquisition
from the County of easements for ROMP features because such acquisition
will not replace park land with non-park uses; it simply replaces current park
uses with similar park uses. In addition, the project applicant has agreed to
donate to the County Lots 00, 0 and PP, which directly adjoin the park, to be
preserved as natural open space. Thus, compensating for and replacing any
park land lost to the necessary ROMP easements.
19. The data and analysis upon which these findings of fact are based are set forth
in the staff report and associated documents for Final SEIR No. 1278lFinal
EIR 1716, General Plan Amendment No. 2003-0001, Pre Zone Change No.
1218 & 1219, ROMPS, Design Guidelines, Tentative Tract Maps
16199,16201 and 16514, Conditional Use Permit 2488-03, and Development
Agreement by and between the City of Orange and The Irvine Company,
staffs oral presentation, public testimony, Planning Commissioner comments,
and Council comments which constituted the City Council's review of this
application.
20. The Santiago Hills II and East Orange Planned Communities project as
approved by the City Council includes a modified project description
eliminating East Orange Area 3 as a development area and designating East
Orange Area 3 as open space. The elimination of development from East
Orange Area 3 eliminates the need for planned water quality basins 10 and 11
as described in the ROMP.
