RESOLUTION NO. 10019
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ORANGE APPROVING GENERAL PLAN AMENDMENT NO.
2003-0001 THAT WILL RESCIND THE EAST ORANGE
GENERAL PLAN ADOPTED IN 1989 AND ESTABLISH
GOALS, POLICIES, IMPLEMENTATION MEASURES, TEXT,
AND FIGURES TO THE CITY OF ORANGE GENERAL PLAN
AND INCLUDES CHANGES TO THE INTRODUCTION OF
THE GENERAL PLAN, LAND USE ELEMENT, CIRCULATION
ELEMENT, OPEN SPACE/CONSERVATION ELEMENT,
SAFETY ELEMENT, NOISE ELEMENT, AND HISTORIC
PRESERVATION ELEMENT THAT COMPREHENSIVELY
ADDRESSES LONG RANGE PLANNING FOR SANTIAGO
HILLS II AND EAST ORANGE PLANNED COMMUNITIES
APPLICANT: THE IRVINE COMPANY
WHEREAS, the City Council has authority per Orange Municipal Code Sections
17.10.010 to take action on General Plan Amendment No. 2003-0001, rescinding the East
Orange General Plan and establishing goals, policies, implementation measures, text, and
figures for the Planned Communities of Santiago Hills II and East Orange; and
WHEREAS, General Plan Amendment No. 2003-0001 was filed by The Irvine
Company in accordance with the provisions of the City of Orange Municipal Code; and
WHEREAS, General Plan Amendment No. 2003-0001 was processed in the time and
manner prescribed by state and local law; and
WHEREAS, Pursuant to the authority and criteria contained in the California
Environmental Quality Act (CEQA), the Community Development Director analyzed the
proposal and determined that the project will have a potentially significant adverse effect on
the environment. A Draft Environmental hnpact Report (Draft SEIR l278/Draft EIR 1716)
was prepared and circulated for public review for a period of at least 45 days, from October
20, 2004 through December 6, 2004. The Final Environmental hnpact Report for the
Santiago Hills II and East Orange Planned Communities and required discretionary permits is
complete and adequate for the consideration of the General Plan Amendment. City Council
Resolution 10018 has been passed, approved and adopted by the City Council on November
8, 2005, certifying Final SEIR 1278/Fina1 EIR 1716, SC#1988110905 and adoption of a
Statement of Overriding Considerations and a Mitigation Monitoring Program for the
Santiago Hills II and East Orange Planned Communities and all required discretionary
permits; and
WHEREAS, the Planning Commission conducted a public hearing for the SHIVEOPC
project on July 18, 2005, continued the item to August IS, 2005 and adopted Planning
Commission Resolution No. PC 26-05 on August IS, 2005, recommending approval of
General Plan Amendment 2003-0001; and
WHEREAS, the City Council conducted a duly advertised public hearing on
September 27,2005, continued the item to October 11, 2005, to October 25,2005 and again
to November 8, 2005, at which time interested persons had an opportunity to testify either in
support of or opposition to the proposal and for the purpose of considering General Plan
Amendment No. 2003-0001, upon property described as follows:
Attachment A for Santiago Hills II and East Orange, and Citywide.
NOW, THEREFORE, BE IT RESOLVED that the City Council rescind Resolution
No. 7469 adopted on December 19, 1989 (East Orange General Plan) and approve General
Plan Amendment No. 2003-0001 as shown in Attachment B, attached hereto and incorporated
by this reference and based on the following findings:
SECTION 1 - FINDINGS
I. The proposed open space land uses are consistent with the goal to maintain open
space for purposes of providing recreational opportunities and conserving natural
resources and includes four local parks and one community level sports park and
preservation of native open space areas, including areas adjacent to Irvine Park,
the established NCCP areas and restored riparian areas.
2. The potential range of density of development and future land uses permitted by
the Residential Land Use Designations are compatible with existing residential
uses located in the vicinity ofthe project site.
3. The project provides off-road trails that support hiking, biking and equestrian use
and on-road Class II bikeways and is consistent with providing safe and efficient
travel ways in Orange and expands opportunities beyond those currently provide in
the City's Master Plan of Bikeways.
4. The proposed changes to the circulation element and the Master Plan of Streets
and Highways is consistent with the goal to provide a comprehensive circulation
system that serves the needs of the existing community and that will meet
projected traffic demand.
5. Consistent with Goal 5.0 of the Land Use Element, the general plan amendment
provides a range of housing densities for all income groups. Proposed densities
include low-density residential, low medium density residential and medium
density residential.

6. Consistent with provisions of the Safety Element, the GP A provides policies and
implementation measures that account for the peculiar hazards in the study area
and are consistent with existing goals of minimizing risk from environmental
hazards, which can include geotechnical, fire hazards, and flooding.
I 7.Consistent with the Noise Element goal of recognizing the importance of
protecting residents from unnecessary and harmful noise, existing and projected
noise contours were completed and the project area will comply with provisions
detailed in the Noise Element.
8. Consistent with the Growth Management Element, the traffic impacts of the GP A
were properly analyzed by using the "V/C" or volume to capacity method and the
ICU" or intersection capacity utilization method, as established by the Orange
County Transportation Authority ("OCTA"), which is the Local Transportation
Authority. OCTA uses the VIC and ICU methodologies for conducting traffic
impact studies associated with the MPAH. Impacts to Santiago Canyon Road
have been analyzed by traffic engineers in several ways and findings and
conclusions have been submitted into the Administrative Record. The
overwhelming majority of the expert evidence submitted has concluded that: (I)
there are traffic impacts to Santiago Canyon Road within the Project area west of
the westerly access point to East Orange Planning Area 2 which require mitigation
and have been mitigated; (2) the Project will not have any significant impacts to
Santiago Canyon Road southeast of the westerly access point to East Orange
Planning Area 2; (3) these impacts have been studied in accordance with the City's
General Plan; and (4) the methods for analyzing the traffic impacts on Santiago
Canyon Road contained in the City's General Plan and utilized by the City are an
accepted methodology among traffic engineers.
9. Consistent with the Growth Management Element, the proposed project includes a
Development Phasing Plan that is consistent with the development phasing
requirements included in the Growth Management Element and specifically with
the definition of such a plan set forth therein.

Consistent with the Housing Element, the proposed GP A inchldes designations for
land uses which will allow zoning at appropriate densities to provide the
opportunity for developers to help fulfill the City's share of regional housing
needs. The proposed GPA is consistent with the City's cUiTently approved
Housing Element, which anticipated future potential annexation of the East Orange
area; no amendment is required.
The proposed GP A does not involve the reduction of residential density for any
parcel to a lower density that is below the density that was utilized by the
Department of Housing and Community Development (RCD) in determining that
the City's Housing Element complied with housing element law because:
a) as explained in the SEIRIEIR, the regional housing allocation for the City
does not include housing that would be produced by future development within
the City's sphere of influence;
b) nonetheless, the City's housing element referenced future housing in
Santiago Hills II Planned Community to meet a portion of its allocation of the
regional housing need but did not rely on the remainder of the project area, all
of which is currently outside the City but within the City's sphere of influence;
c) HCD found that the City's Housing Element complied with state law; and
d) the project does not change the total number of residential units permitted
by the General Plan for the Santiago Hills II Planned Community portion of
the project, and (e) a higher density is associated with greater opportunities for
affordable housing and the project will increase the number of medium-density
units in the Santiago Hills II Planned Community.
Therefore, the findings described in California Government Code section 65863(b)
are not required for the proposed project and there are sufficient sites in the City
that are adequate to accommodate the City's share of the regional housing need.
12. The data and analysis upon which these findings of fact are based are set forth in
the staff report and associated documents for Final SEIR No. 1278/Final ErR
1716, General Plan Amendment No. 2003-0001, Zone Change No. 1218 & 1219,
ROMP, Design Guidelines, Tentative Tract Maps 16199,16201 and 16514,
Conditional Use Permit 2488-03, and Development Agreement by and between the
City of Orange and The Irvine Company, staffs oral presentation, public
testimony, Planning Commissioner comments, and Council comments which
constituted the City Council's review ofthis application.

describes planning policy for 1,900 acres of land situated between Irvine

East Oranae Study Area: Two additional land use plans exist for the
undeveloped areas located in the eastern portion of the plannina area: the
496-acre Santiaao Hills II Planned Community and the 6.334-acre East
Oranae Planned Community. These two areas have also been referred to
as East Oranae Study Area. Fiaure 1-1 illustrates these areas.
Plannina efforts for the 18.000 acres of land within the City's
unincorporated Sphere of Influence beaan in 1984. with a ioint effort by
the City. the Countv of Oranae. and The Irvine Company. This initial work
effort resulted in the East Oranae Policy Plannina Study. which provided
aeneral development aoals and policies and identified preliminarv
plannina areas. Plannina efforts continued between 1986 and 1989, with
the intent to provide a lona-ranae comprehensive plan for a portion of the
land known as the East Oranae Study Area. Approved in 1989. the East
Oranae General Plan focused development in portions of the East Oranae
Study Area that were the least environmental sensitive and preserved
those areas that offered the areatest natural resources. That plan
addressed both the Santiaao Hills II parcel and the East Oranae parcel. In
2000. the Santiaao Hills II portion of the study area was amended to
further reduce development intensity and that property has since received
pre-zonina approvals. The Irvine Company and the City have an onaoina
proaram to refine land use policy and plans for the East Oranoe Study
Area.
Given that the East Oranae Study Area has a relationship to the City's
lona term plannina and the expectation that some of the land will be
annexed to the City of Oranae. this General Plan contains text. exhibits.
and tables incorporatina portions of the study area. This General Plan
supercedes the 1989 East Oranae General Plan.
Over time as phased development plans are prepared for the East Oranae
Studv Area. the plannina areas will be annexed to the Citv. Future
development plans. which mav be Planned Communitv or Specific Plans.
will use this General Plan as a basis for plan consistencv. For anv

three studv areas are as follows:

Regional Plans: Orange County agencies have adopted regional
highway and recreation plans which affect land use policy in the City.
Ongoing offorts to ostablish a r.euto for the Eastern Transportation
Corridor, a major highway to link State Highway 91 to southern Orango
County, influonces land use decisions in tho eastern portion of the City.
The SR-241/261. which bisects the Santiaoo Hills II and East Oranoe
Planned Communities. provides reoional access to the eastern portion of
the Citv. The location and operational impacts (e.o, noise. air oualitv.
Iiohtinq) of the SR-241/261 influence land use decisions in the eastern
portion of the City.

The Central/Coastal NCCP Plan affects land use decisions in the eastern
portions of the plannino area. In September 1991. Governor Pete Wilson
siqned AB 2172 INCCP Act) providinq enablino leoislation authorizinq the
California Department of Fish and Game ICDFG) to enter into aqreements
with anv person for the purpose of preparinq and implementinq NCCPs
and preparinq quidelines for development and implementation of NCCPs.
AB 2172 also permits NCCPs to be prepared bv local. State. or federal
aqencies independentlv or in cooperation with other persons.

The purpose of the NCCP prooram is to provide reoional or area-wide
protection and perpetuation of natural wildlife diversitv. while allowino
compatible and appropriate development and orowth. AB 2172 was
desioned in recoonition of the fact that individual species protection under
the state Endanoered Species Act and the Federal Endanoered Species
Act is costlv and historicallv ineffective as a mechanism for protection or
prevention of extinction of plant and animal species. and that a habitat-
based. multi-species or ecosvstem-driven preservation approach has
oreater potential for lono-term success. The focus of the NCCP prooram
represents a dramatic shift from focusino on preservation of "individual
species" to "habitat preservation."
As part of the Central & Coastal NCCP. a Habitat Conservation Plan
NCCP/HCP) and associated Implementation Aoreement were developed
to protect the taroet species and habitat. On Julv 17. 1996. the Central &
Coastal NCCP/HCP. Implementation Aoreement. and EIR/EIS were
approved. The Implementation Aoreement was sioned bv the United
States Fish and Wildlife Service. CDFG. and the participatino landowners
and cities. Both the City and TIC are sionatories to this aoreement. The
NCCP/HCP established a 37.000-acre reserve area. fundine mechanisms.
a manaoement prooram. and mitioation measures to protect sensitive
species and habitat. The reserve is administered bv the Nature Reserve
of Oranoe County. which includes representatives of the City. USFWS.
CDFG. The Irvine Company. and other local environmental oroups.
The reserve borders the eastern portion of the plannino area on the north
and south. and includes portion of the East Oranoe Stud v Area. The
Central/Coastal NCCP also includes portions of Irvine Reoional Park and
Peters Canyon Reoional Park. The General Plan land use desionations in
these areas conform to the NCCP in that all areas currentlv proposed for
urban development are areas identified as permitted for development and
take" bv the Central/Coastal NCCP. Developments located within the
boundaries of the NCCP will be reviewed for conformance with the NCCP.
Irvine Ranch Land Reserve
The Irvine Ranch Land Reserve sets aside more than 50.000 acres of
land to be "reserved in perpetuity as open space and for recreational
purposes". This reserve stretches from Weir Canyon near SR-91 at the
north end of Irvine Ranch. connects with the Cleveland National Forest
alono the northeast border of the ranch. continues south to include laroe
reaional open space systems in the northern and southern hillsides of
Irvine. and extends to the Laouna Coast Wilderness Parks and Crvstal
Cove State Park near Laouna Beach. This land reserve affects the

pattern of developable and undevelopable land in the eastern portion of
the plan nino area.

for new major transportation corridors within eastern and southeastern
Orange County, eleven affected cities and the County have formed a joint
power agency charged with the responsibility of studying and planning
these routes. In 1992, the Foothill/Eastern Transportation Corridor
AQencv certified the EIR for SR 241/261 and approved a locally preferred
alternative. In September 1994. the Federal HiQhway Administration
selected a precise aliqnment for SR 241/261 that bisects the East Oranoe
General Plan area. All phases of SR 241/261 have been constructed and
241/261 is now fully operational. One of the rQadways, the Eastorn
Transportation Corridor, is to traver&e the hills and canyons oast of Irvino
Park, connocting Intorstato 5 to State Routo 91. Land use planning must
take into account the alignment of and access to this corridor.

Irvine Ranch Land Reserve: The Irvine Ranch Land Reserve sets aside

and is located within the NCCP area. Amendment to the NCCP would be
reauired before extraction could occur. While the latter designation does
not permit mining, it will protect the resource zone from urbanization,

City, the SR-214/261 that traverses the eastern portion of the planninq
area, and the many arterial roadways which traverse almost all areas of
Ithecommunity. High volumes of traffic on the freeways, toll roads, and
arterials such as Tustin Street, Chapman Avenue and Katella Avenue
account for ambient noise levels in excess of 65 dBA some distance from
these transportation routes.
