RES-10008 Redesignation Property ApprovalRESOLUTION NO. 10008 I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING A GENERAL PLAN AMENDMENT TO REDESIGNATE PROPERTY LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF MANCHESTER PLACE AND COMPTON AVENUE, INCLUDING 206 N. MANCHESTER PLACE, FROM OFFICE PROFESSIONAL (OP) TO LOW-MEDIUM DENSITY RESIDENTIAL (LMDR) APPLICANT: THE OLSON COMPANY WHEREAS, the City Council has the authority per Government Code Section 65350 et seq., to amend the City's General Plan when it finds it to be in the public interest; and WHEREAS, the Olson Company has filed an application with the City requesting amendment to the land use element of the General Plan to re-designate property to accommodate their project; and WHEREAS, the City Council determines that the proposed General Plan Amendment is requested pursuant to Government Code Section 6535 8( c), to provide for low or moderate income housing; and WHEREAS, the Planning Commission has reviewed the requested General Plan Amendment in accordance with Government Code Section 65353; and WHEREAS, the City Council held a duly advertised public hearing on September 13, 2005 for the purpose of considering, among other things, the amendment to the land use element of the General Plan upon the property described in Exhibit A; and WHEREAS, in compliance with the California Environmental Quality Act (CEQA) and State CEQA Guidelines the City has prepared a Mitigated Negative Declaration hereinafter MND) to evaluate the potential adverse environmental effects of the project and related amendment to the land use element of General Plan; and I WHEREAS, the City Council has approved and adopted the MND in accordance with CEQA at a legally notice public hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ORANGE THAT THE LAND USE ELEMENT OF THE GENERAL PLAN IS HEREBY AMENDED BASED ON THE FOLLOWING FINDINGS: 1. That the proposed action furthers the City's General Plan goals of providing additional recreational facilities and housing opportunities. 2. That the California Government Code and City of Orange requirements for a General Plan Amendment have been appropriately and adequately addressed. 3. That the subject site is physically suitable for the type and intensity of the land use being proposed. 4. That there is adequate public access and adequate utilities to servIce the proposed residential development. 6.That the project provides for safe and adequate vehicular and pedestrian circulation, both on and off-site. I5.That the project location, size and design are compatible with existing surrounding development and neighborhoods. 7. That the general plan amendment is granted upon sound principles of land use and in response to services required by the community, including but not limited to offering housing for low or moderate income families. 8. That the general plan amendment will not cause deterioration of bordering land uses or create special problems for the area in which the site is located. 9. That the general plan amendment has been considered in relationship to its effect on the community or neighborhood for the area in which the site is located. 10. That there is no evidence before the City Council of the City of Orange that the proposed residential development will have any potential for adverse affects, either individually or cumulatively, on wildlife resources or the habitat upon which the wildlife depends. II. That the data and analysis upon which these findings of fact are based are set forth in the staff report, oral presentations, public testimony, and Commissioner comments, that constitute the record which is the basis for the City Council's review and approval of this general plan amendment. 12. That it approves the amendment of the land use element of the City's General Plan to re-designate the subject property in accordance with the maps attached as Exhibit B.
