A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE ESTABLISHING A LETTER OF
UNDERSTANDING BETWEEN THE CITY OF
ORANGE AND THE CITY OF ORANGE POLICE
MANAGEMENT ASSOCIATION EFFECTIVE JULY
1, 2005 THROUGH JUNE 30, 2008
WHEREAS, the City of Orange, hereinafter referred to as City, and the City of
Orange Police Management Association, hereinafter referred to as COP A Management
have met and conferred in accordance with the requirements of the Meyers-
Milias-Brown
Act; and WHEREAS, the City and COP A Management have reached
agreement on wages, salaries, and other terms and conditions of employment effective July
1, 2005 through June 30,
2008; and WHEREAS, the City and COP A Management agree to
incorporate the provisions contained in the attached Letter of Understanding into a new
Memorandum of Understanding at some future date once both parties have an opportunity to
review and concur on any and all language changes to be included in a new
Memorandum of
Understanding; and WHEREAS, the City Council has consulted with the City
Manager and Personnel Director concerning the proposed employment terms contained in
the attached Letter
of Understanding;NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Orange that the attached Letter of Understanding is approved and
incorporated by reference as

A LETTER OF UNDERSTANDING
I
BETWEEN THE CITY OF ORANGE AND
THE CITY OF ORANGE POLICE MANAGEMENT ASSOCIATION
EFFECTIVE JULY 1, 2005 THROUGH JUNE 30, 2008
This Letter of Understanding (LOU) is entered into by and between the City of Orange
the City) and the City of Orange Police Management Association (COPA Management).
In May and June 2005, the City and COPA Management met and engaged in the Meet
and Confer process to establish its next contract. These discussions resulted in this LOU
between the City and COPA Management, who have agreed to the following:
Term of Agreement
July 1,2005 through June 30, 2008
Salarv Increases
Effective June 26. 2005
o Police Sergeants = 5.0% Increase
o Police Lieutenants = 4.5% Increase
o Police Captains = 3.5% Increase
o Police Records Manager = 5.0% Increase
o Crisis Intervention Counselor = 5.0% Increase
Effective June 25,2006
o 4.5% Across the Board Increase

Effective June 24. 2007
o 3.0% to 6.0% Salary Range Increase based on the market median of the salary
survey, per benchmark classification. Police Records Manager shall receive a
flat 4.5% increase, and Crisis Intervention Counselor shall receive a flat 3.0%
increase.
COP A Management and the City will conduct a salary survey by or before July 31, 2007 of
the eleven (11) pre-selected cities to determine the maximum (top step) base salary for
the benchmark classifications of Police Sergeant, Police Lieutenant, and Police Captain only.
The survey cities include Anaheim, Brea, Costa Mesa, Fountain Valley, Fullerton, Garden
Grove,Huntington Beach, Irvine, Newport Beach, Santa Ana, and Westminster. The
contractual July 2007 salary data from the survey agencies, as well as the City of Orange, will be
utilized
for any necessary adjustments, however the City of Orange salary will not be included as part
of the median calculation. In the event any classification is below the median of the eleven
11) surveyed cities, the City shall increase the entire salary range of that classification to a
level at the survey median, at a minimum of 3.0% to a maximum of 6.0%, in 0.5%
increments, to bring the salary to the survey median. The effective date for any applicable
salary increases will be June 24, 2007. All classifications shall receive a minimum of a 3.0%
salary increase, regardless of their position in the labor market.
PERS Cost-
Sharing Employees continue to participate in PERS Cost-Sharing; City agrees to
cap contribution rate at 3.1% for duration of contract for sworn employees, and 2.64%
for non-sworn.
Medical Insurance Contribution Effective Julv L 2005, increase flexible benefits contribution from $
640/month to 875/month including those
who waive insurance Effective 7/1/06 - Increase by 5.0% to $919
per month Effective 7/1107 - Increase by 5.0% to $965 per
month Education
Reimbursement Effective July 1, 2005, the City agrees to increase annual Educational
Reimbursement benefit from $1,200 to $1,500 per fiscal
year.Special Assignment
Pay Effective July 1, 2005, Police Lieutenants assigned to the Detective
Division,Administration Division, or Traffic Bureau shall qualify for an additional 6.0% on top
of base salary as special assignment
compensation.Effective July 1, 2005, Police Lieutenants who transfer from a special assignment back
to Patrol shall continue to receive said 6.0% special assignment compensation until
such time as they qualify for Seniority
Pay.Senioritv
Pay Effective July 1, 2005, Police Lieutenants who qualify for Seniority Pay shall
receive 6.0% per month on top of base salary after completion of five (5) years of service
within their rank, which represents an increase of 1.0% (i.e., from 5.0% to 6.
0%).Bilingual
Bonus Effective July 1, 2005, Bilingual Bonus shall increase from $140.00 per month
to 200.00 per
month.
Administrative Leave
I
Effective Julv L 2005. Police Captains shall receive an additional 16 hours of
administrative leave for the balance ofthe 2005 calendar year
Effective Januarv L 2006. and each January 1st thereafter, Police Captains shall be
granted 80 hours per calendar year of administrative leave (increased from 48 hours
per year)
Effective Julv L 2005. Police Lieutenants shall receive a bank of 40 hours of
administrative leave for the balance of the 2005 calendar year
Effective Januarv L 2006. and each January 1st thereafter, Police Lieutenants shall be
granted 80 hours per calendar year of administrative leave, in exchange for no longer
qualifying for paid overtime
Holidav Accrual
Effective January 1, 2006, all members shall receive the full bank of 110 holiday
hours on a January 1 st basis, rather than March 1 st
2005 Holiday Hours already accmed need to be used by December 31, 2005, or else
these hours shall be automatically converted to cash on January 1, 2006
Management Concessions
Police Lieutenants shall no longer qualifY for paid overtime.
New Memorandum of Understanding
The City and COPA Management agree to incorporate the provisions contained in this
Letter of Understanding into a new Memorandum of Understanding once both parties
have had an opportunity to review and concur on any and all language changes included
in the new MOU.
Ratification and Execution
I
The City and COPA Management acknowledge that this Letter of Understanding shall
not be in full force and effect until ratified by the Association and adopted by the City
Council of the City of Orange. Subject to the foregoing, this Letter of Understanding is
hereby executed by the authorized representative of the City and COPA Management and
