WHEREAS, the City Council wishes to vacate an easement for street purposes over a portion of Chapman Avenue which is no longer needed; and WHEREAS, the portion of street to be vacated is specifically described in the attached legal description and map; and WHEREAS, this summary vacation of the street is conducted pursuanl to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, Sections 8330 et se c.; and WHEREAS, this vacation meets all of the requirements for a summary vacation of the street under said Code. NOW THEREFORE, the City Council of the City of Orange declares as follows: 1.That this summary vacation is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, Section 8330 et s. 2.That the easement for street purposes to be summarily vacated is a triangular piece on the south side of Chapman Avenue,just east of its intersection with The City Drive, as more particularly described in Exhibit A and depicted in Exhibit B, which are attached hereto and incorporated herein by this reference. 3.That the City reserves and excepts from such vacation all existing easements granted for utility purposes, and reserves any rights necessary to maintain, operate, replace, remove or renew such public utilities. 4.That the portion of Chapman Avenue depicted in Exhibit A and Exhibit B to be summarily vacated is excess right of way not required for right of way purposes. 5.That the street to be summarily vacated has been impassable to vehicular travel for a period of more than five consecutive years and no public money has been expended for maintenance during such period. 6.That the street to be summarily vacated is unnecessary for present or prospective public use because intersection improvements at Chapman Avenue and The City Drive have been completed and no future widening necessitating the use of the subject property is anticipated. 7.That from and after the date this Resolution is recorded the portion of Chapman Avenue vacated shall no longer constitute a public street. 8.That the City Clerk is directed to cause a certified copy of this Resolution to be recorded in the office of the Orange County Recorder.
