A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING REVISIONS TO
THE CITY OF ORANGE LOCAL CEQA
GUIDELINES TO UPDATE CITY PROCEDURES
CONSISTENT WITH THE CEQA STATUTE AND
LOCAL PRACTICE.
APPLICANT: CITY OF ORANGE
WHEREAS, the State CEQA Guidelines require local agencies to adopt objectives,
criteria and procedures to implement the requirements of the CEQA statute and the State
CEQA Guidelines (CEQA Guidelines Section 15022); and
WHEREAS, the purpose of the Local CEQA Guidelines is to provide a structure and
process for implementing the rules and regulations contained in the California Environmental
Quality Act (CEQA); and
WHEREAS, on December 14, 1999, the City Council reviewed the recommendation of
the Planning Commission and adopted City Council Resolution No. 9200 updating the Local
CEQA Guidelines for the City of Orange; and
WHEREAS, the Local CEQA Guidelines have not been updated since 1999 and
revisions were deemed necessary to keep the City's procedures consistent with the CEQA
statute and local practice; and
WHEREAS, the Local CEQA Guidelines could benefit from incorporating a more
comprehensive discussion of City responsibilities and procedural requirements pursuant to
CEQA; and
WHEREAS, the Local CEQA Guidelines could further benefit from a refinement of
the existing guidance related to the applicability of CEQA exemptions and determining
substantial adverse change" for projects involving historic resources; and
WHEREAS, the Planning Commission is authorized by the Orange Municipal Code to
review, consider and make recommendations to the City Council on items related to planning
and environmental matters; and
WHEREAS, in compliance with the California Environmental Quality Act (CEQA)
California Public Resources Code Sections 21000 et seq.) and the State CEQA Guidelines
California Code of Regulations Section 15000 et seq.), the City, acting as lead agency, has
determined that this project is categorically exempt from CEQA, because it involves revisions
to a local guidance document that establishes procedures for complying with CEQA for the
purpose of protecting the environment; and
WHEREAS, after publication of notice, a public hearing has been held by the Planning
Commission who recommends approval of this Project; and
WHEREAS, the City Council has received and duly considered the information and
facts set forth in the agenda report presented to it and any testimony received from staff and the
public at the public hearing at which this Project was considered, which testimony is hereby
incorporated into the record on this matter.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
on the basis of the facts set forth in the agenda report presented to it and any testimony received
at the public hearing at which this matter was considered, that the City Council hereby takes the
following action:
1. This project is categorically exempt from the provisions of CEQA pursuant to
State CEQA Guidelines Section 15308 for the reasons stated in the staff report
and the recitals stated herein.
2. The proposed revisions to the City of Orange Local CEQA Guidelines are
hereby adopted and approved as contained in Attachment A to this resolution as
if fully set forth herein.
