A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AMENDING THE CITY'S
MASTER SCHEDULE OF FEES AND CHARGES
RELATING TO LOCATION/LEASE FEES FOR
COMMERCIAL FILMING ON CITY PROPERTY.
WHEREAS, by Ordinance No. 22-97 adopted on November 25, 1997, the
City Council of the City of Orange established a permit system for the regulation of filming
on public property owned or controlled by the City (City Property);
and WHEREAS, the City Council is authorized to determine by Resolution the
amount payable by permittees for commercial filming on City Property;
and WHEREAS, pursuant to Chapter 3.10 of the Orange Municipal Code, the City
Council has established and maintained a Master Schedule of Fees and Charges, consisting of fees
and charges for the use of City facilities and services provided by the City to persons using
such facilities and services, including fees for filming activities on City Property;
and WHEREAS, in accordance with the mandate of Chapter 3.10 of the Orange
Municipal Code, the Master Schedule of Fees and Charges has been periodically amended and
revised from time to time by the City Council;
and WHEREAS, the City Council desires to amend the City's Master Schedule of Fees
and Charges to provide for a fee structure applicable to location/lease fees for commercial
film permittees committing to multiple filming dates on City Property within a certain period
of time;
and WHEREAS, the City Council hereby finds and determines that the Master Schedule
of Fees and Charges should be amended, in part, to provide for certain fees and charges relating
to the use of City Property for commercial
filming.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange as
follows:Section 1.The foregoing recitals are true and
correct.Section 2. The Master Schedule of Fees and Charges is hereby amended
and Attachment A to this Resolution entitled "Revisions to the Current Master Schedule of
Fees and Charges" is hereby adopted, amending, supplementing and modifying that portion of
the Master Schedule of Fees and Charges that is related to Economic Development to provide
for the inclusion of the amount of fees and charges for the use of City Property for
commercial filming involving a commitment to multiple filming dates, as more particularly described
on said Attachment
Section 3. The City Council finds that the fees and charges set forth in Attachment
A do not exceed the reasonable cost for the use of City Property and the services provided by
the City in connection with the use thereof.
Section 4. The fees and charges listed in Attachment A shall be effective as of the
date ofthis Resolution.
Section 5. If any fee, charge, or rate set forth in this Resolution or the application
thereof to any person or circumstance is held to be unconstitutional or otherwise invalid by any
court of competent jurisdiction, such invalidity shall not affect any other fee, charge, or rate, or
application thereof, which can be implemented without the invalid fee, charge, or rate, or
application thereof, and to this end the fees, charges and rates of this Resolution are declared to
be severable.
