RES-10186 Opposing AB 1457RESOLUTION NO. 10186
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ORANGE OPPOSING AB 1457
WHEREAS, the Foothill Transportation Corridor-South (FTC-S)
has been identified as a needed facility in studies of existing and projected travel
demand in Orange
County; and WHEREAS, the Orange County Board of Supervisors
certified Environmental Impact Reports 123 and 423 on the FTC in 1981 and 1983
respectively; and WHEREAS, the FTC was added to the Orange County Master Plan
of Arterial Highways by the Orange County Board of Supervisors in
1981; and WHEREAS, the Foothill-Eastern Transportation Corridor
Agency (F-E/TCA)certified the Environmental Impact Report for
FTC-S in 2006; and WHEREAS, the "Green Alignment" was and selected by
the F-E/TCA Board of Directors
as the locally preferred alternative; and WHEREAS,
a comprehensive mitigation program representing state-of-the-art
technology in habitat revegetation, scientific studies, habitat conservation and management, and endangered
species protection will be included in
the record of decision when it is issued; and WHEREAS,
the Green Alignment enters onto United States of America,Department of Navy property leased
to the State of California,
Department of Parks and Recreation for park use; and WHEREAS, the
lease agreement between the Department of Navy and the Department of
Parks and Recreation
specifically contemplates the construction of future infrastructure facilities; and WHEREAS, AB
1457 seeks to interfere with the eXlstmg lease agreement between the Department of
Navy and the Department of Parks and Recreation; and WHEREAS, AB 1457 seeks to
take the planning process for the FTC-S out of the
hands of the local communities and their elected officials; and WHEREAS, AB
1457 further seeks to eliminate an alternative that has been chosen as the
WHEREAS, the F-E/TCA will mll1gate impacts to the State of
California,Department of Parks and Recreation San Onofre State Beach Park through
a comprehensive mitigation
program.NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Orange expresses its opposition to AB
1457.ADOPTED this 24th day of April,
