RES-10156 General Plan Amendement Annexation Manchester Pl. and Compton Ave.RESOLUTION NO. 10156 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING ADDENDUM NO. 1779-06 AND GENERAL PLAN AMENDMENT NO.2006-0003 TO ALLOW FOR THE ANNEXATION OF APPROXIMATELY 332-SQUARE FEET OF LAND INTO THE CITY OF ORANGE, FROM THE CITY OF ANAHEIM, LOCATED AT THE INTERSECTION OF MANCHESTER PLACE AND COMPTON AVENUE.APPLICANT: CITY OF ORANGE WHEREAS, General Plan Amendment No. 2006-0003 and related Pre-Zone Change No. 1241-06 were filed by the City of Orange in accordance with the provisions of the City of Orange Municipal Code; and WHEREAS, General Plan Amendment No. 2006-0003 and related Pre-Zone Change No. 1241-06 were processed in the time and manner prescribed by state and local law; and WHEREAS, the 332- square feet of land proposed for the General Plan Amendment and related Pre-Zoning will serve as a small part of a larger project (Manchester Walk), which was approved by the Orange City Council on September 27, 2005; and WHEREAS, the conditions of approval for the Manchester Walk property also apply to the 332-square feet of land proposed for the General Plan Amendment No 2006-0003 and related Pre-Zone Change No. 1241-06; and WHEREAS, the City Council has considered the information contained in Addendum No. 1779-06, including the previously approved Mitigated Negative Declaration No. 1736-04,and has found that because none of the conditions identified with Section 15162 of the California Environmental Quality Act Guidelines have occurred, the preparation of an Addendum to Mitigated Negative Declaration No. 1736-04 is appropriate and consistent with Section 15164 of the CEQA Guidelines; and WHEREAS, the City Council conducted a duly advertised public hearing on January 9,2007, at which time interested persons had an opportunity to testify either in support of or opposition to the proposal and for the purpose of considering Addendum No. 1779-06, General Plan Amendment No. 2006-0003 and related Pre-Zone Change No. 1241-06 upon property described as follows:That parcel of land, being a portion of Lot A, of the Dawn Tract, Beginning at a point in the existing City Limit line of the City of Anaheim and City of Orange, as certified by the Secretary of State of California December 12, 1968, as Resolution No. 68R-720, said point being distant from the Southwest corner of the Southeast quarter of said Section 26, said Southwest corner also being the centerline intersection of Lewis Street and Chapman Avenue, as said intersection is shown on a Map of Tract No. 2413, recorded in Book 73, pages 21 through 23 of Miscellaneous Maps, records of Orange County, California,the following courses and distances: North 01019' 07" West455.43 feet, North 71010' 50"East 42.04 feet to the Northwest corner of Lot "B" of said Tract No. 2413, thence following along the existing City Limit line of the City of Orange, also being the existing City Limit line of the City of Anaheim, and along the Easterly and Southerly line of Parcels "B" and "C" of said map of Tract No. 2413, the following courses: South 010 19' 07" East 30.15 feet to the Southwest corner of Lot "B" of said Tract No. 2413 and to the beginning of a tangent curve concave Southeasterly and having a radius of 1975.00feet, a radial through said point bears North 22021' 08" West, thence Northeasterly along said curve through a central angle of 30 31' 58" an arc distance of 121.78 feet; North 71010' 50" East 613.18 feet; North 710 39' 05"East 562.23 feet to the Southeast corner of Lot "C" of said Tract No. 2413 and the True Point of Beginning; thence South 00 12' 14" East 1.31 feet; thence North 89049' 31" East 41.00 feet;thence North 00 12' 14" West 14.77 feet; thence, leaving the said existing City Limit line of the City of Orange and the City of Anaheim, South 710 39' 05" West 43.15 feet to the True Point of Beginning.NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves and adopts Addendum No. 1779-06 and General Plan Amendment No. 2006-0003 to change the General Plan land use designation from Medium Density Residential (City of Anaheim) to Low-Medium Density Residential (LMDR - 6-15 dwelling units per acre) in the City of Orange, in association with and related to Ordinance No. 2-07 to pre-zone the property as Multi-Family Residential (R-3), from the existing Transitional Zone (6-36 dwelling units per acre) in the City of Anaheim to allow for the annexation of332-square feet ofland (de- annexed from the City of Anaheim), based on the following findings:SECTION 1 - FINDINGS I. The project will resolve a boundary line discrepancy between the cities of Anaheim and Orange.2. The project facilitates the development of a housing project that furthers the affordable housing goals of the City of Orange by providing 50% ( nine) of the units as affordable to moderate income households.3. The land uses changes support the implementation of the City's 2001 Housing Element which indicates the City will continue to encourage and assist in the provision 4. The proposed General Plan Land Use designation of Low Medium Residential (0- 16 dwelling units per acre) and related Pre-Zoning ofR-3 is consistent with the land uses for the adjacent Manchester Walk project.5. The proposed General Plan Land Use designation and related Pre-Zoning is compatible, yet less dense than the existing General Plan Land Use designation (in the City of Anaheim) of Medium Density Residential and Transitional zoning designation (6-36 dwelling units per acre.)6. The play area/open space use of the 332 square feet of land will not change from what was originally approved for the Manchester Walk project.7. The City's Public Works, Fire, and Police Departments have reviewed the project and indicated that City services are available and adequate to serve the project.8. The project will not have a significant adverse impact on traffic volumes and road capacities, school enrollment, or recreational resources.9. There is no evidence before the City Council of the City of Orange that the proposed General Plan Amendment No. 2006- 0003 and related Pre-Zone Change No. 1241-06, will have any potential for adverse effects, either individually or cumulatively, on wildlife resources or the habitat upon which the wildlife depends.Therefore, the proposed development is found to have a de minimis impact in its effect on fish and wildlife.10. The City Council of the City of Orange has made required findings pursuant to CEQA as set forth in Section 2 below.II. The proposed General Plan Amendment and related Pre-Zoning does not involve the reduction of residential density for any parcel to a lower density that is below the density that was utilized by the Department of Housing and Community Development (HCD) in determining that the City's Housing Element complies with Housing Element law because:a) The City utilized the proposed density for purposes of housing plans in the City of Orange, and b) The City of Anaheim zoning designation was not a consideration for determining housing units or affordability.The data and analysis upon which these findings of fact are based, including those in Section 2 of this Resolution, are set forth in the staff report for Addendum No.1779-06 to Mitigated Negative Declaration No. 1736-04, General Plan Amendment No. 2006-0003, and associated with and related to Ordinance No. 2-07 for Pre-Zone Change No. 1241-06, staffs oral presentation, public testimony, the Planning Commission record and SECTION 2 - ENVIRONMENTAL REVIEW 1. Addendum No. 1779-06 to Mitigated Negative Declaration No. 1736-04 was prepared for General Plan Amendment No. 2006-0003 and associated with and related to Ordinance No. 2-07 for Pre-Zone Change No. 1241-06, in compliance with the California Environmental Quality Act and associated Guidelines.2. The City Council finds that the Addendum to Mitigated Negative Declaration No.1736-04 contains an adequate assessment of the potential environmental impacts of General Plan Amendment No. 2006- 0003 and related Pre-Zone Change No. 1241-06. The City Council finds that all potentially significant adverse environmental impacts can be mitigated to a level of insignificance.
