RE: Questions on Item 3.2 of the 8/17/20 agenda regarding the draft STR Ordinance
Here are my questions on this matter.
1) How did staff land on a total of 300 STR permits citywide?
2) Do we have a mapped inventory of where all our existing STRs are located?
3) Should a limit of the number of permits be established in certain geographical areas of town to
reduce overconcentration in a particular area.
4) How was the 300-foot buffer between existing and proposed STR’s determined? Can it be
shifted to 500 feet?
In my opinion, the answers to questions 2-4 be pulled together for further Commission
consideration and provided to the community?
5) What happens with STRs that want to offer a whole house rental without the property owner
being on-site? Do we know how many of these we have in Orange? The ordinance limits the
renters of a STR be limited to two people per bedroom plus 2 additional persons (children under
2 are exempt). I ask for that provision be explained further. How will this code requirement be
enforced?
6) What happens if a HOAs bands STRs in their CCRs? Must they allow the STR use?
7) Are their life safety requirements, permits, and inspections required before a STR can operate?
8) The draft ordinance would allow STRs as a permitted in the Office/Profession zone. How
would use of those building/structures been made safe for life/safety needs as the requirements
are different. In other words, owners and tenants of Office/Professional zones don’t sleep,
prepare meals, bath, or conduct residential activities in that zone. How would such a
residential use be made safe to allow it to occur. For this same zone, how would parking for
the new hotel-like be provided.
9) How were the violation fines determined? Can they be increased?
Further, explain the process for resolving violations of the ordinance so due process is assured
for the STR owner, but neighbors don’t have to suffer though the hardship of bad operators?
For example, can water and power be turned off, like LA is doing for some of their bad acting
STRs.
10) The ordinance gives the City Manager the authority the immediate close down a STR. Give an
example of what would trigger an immediate closure?
