A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING LOT LINE
ADJUSTMENT NO. LL 2009-02 COMBINING FOUR
PARCELS OF CERTAIN REAL PROPERTIES
SITUATED AT 455 SOUTH MAIN STREET IN THE
CITY OF ORANGE, COUNTY OF ORANGE, STATE
OF CALIFORNIA.
WHEREAS, Section 66412 (d) of the Subdivision Map Act makes provisions for the
Council to approve lot line adjustments by resolution where the land taken from one parcel is
added to an adjacent parcel and where a greater number of parcels than originally existed is
not thereby created; and
WHEREAS, the City Council has enacted Orange Municipal Code Sections
16.32.010 et seq., which provide the procedure to be followed for the approval of said lot line
adjustment; and
WHEREAS, the Subdivision Section of the Department of Public Works and the
Staff Review Committee have reviewed and recommended approval of Lot Line Adjustment
No. LL 2009-02 and have made a finding that the real property situated at 455 South Main
Street in the City of Orange, described as Parcel A in Exhibit A attached hereto and
graphically depicted on the map attached hereto as Exhibit B, complies with the provisions
of the California Subdivision Map Act and all applicable City of Orange ordinances and
regulations, including the requirements for building sites; and
WHEREAS, the Subdivision Section of the Public Works Department and the Staff
Review Committee have made the following findings:
1.That the proposal is eligible for processing as a lot line
adjustment pursuant to Section 66412 of the Subdivision Map
Act;
2.That Final Environmental Impact Report No. 1805-08 (EIR 1805-0
8), reference State Clearinghouse No. 2008081118, was certified
by the City of Orange on March 24, 2009, for the Children's Hospital of
Orange County (CHOC) Master Plan project, including the adoption of a
Statement of Overriding Consideration and Mitigation Monitoring Reporting
Program, in conformance with the California Environmental Quality Act
CEQA). Lot Line Adjustment No. LL 2009-02 is an implementing sub-
project and is consistent with the project description outlined for the CHOC
Master Plan project. Approval of this sub-project will not have any effects that
were not examined in Final EIR No. 1805-08, no new effect will occur, and
no new mitigation measures are required;
3.That the proposal is consistent with the General Plan; and
4. That the resultant parcels will meet the requirements of the
Zoning Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby concurs in
the above findings; and
BE IT FURTHER RESOLVED that the proposed Lot Line Adjustment No. LL
2009-02, as shown on Exhibits A and B to this Resolution be approved, and a deed
establishing title in conformity with said parcel be executed; and
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to cause this Resolution to be recorded in the Office of the Orange County Recorder.
