Chapman Avenue, Orange, California. 4:30 P.M. SESSION 1. ROLLCALL PRESENT ABSENT Murphy, Barrera, Coontz, Spurgeon, Slater None 1. 1 APPROVAL OF MINUTES Regular Meeting - April 9, 1996 MOTION SECOND AYES Spurgeon Barrera Murphy, Barrera, Coontz, Spurgeon, Slater ACTION: Approved.CONSENT CALENDAR Tape 1180 2.2.1 Declaration of the Clerk of the Orange Redevelopment Agency, Cassandra J.Cathcart, declaring posting of Orange Redevelopment Agency Agenda of regular meeting of April 23, 1996 at Orange Civic Center, Main Library, the Police Facility at 1107 N. Batavia, the Eisenhower Park Bulletin Board and summarized in Cablevision of Orange; all of said locations being in the City of Orange and freely accessible to members of the public at least 72 hours before commencement of said regular meeting. ACTION: Accepted Declaration of Agency Posting and authorized its retention as a public record in the Office of the Agency Clerk.2.2 Request Agency confirmation of warrant registers dated April 5 and 9, 1996.ACTION: Approved.AGREEMENTS REMOVED AND HEARD SEP ARATEL Y)2.3 Request Agency to approve initiating negotiations with Mr. 1. R. CONSENT CALENDAR (Continued) FISCAL IMP ACT: Funds to be appropriated from 1988 Southwest Taxable Notes to Account No. 922-9813-475100-9180 for building repairs to Santa Fe Depot.Discussion: The Interim Economic Development Director reported the Agency owns the property and is currently in the process of making parking improvements and improvements to land south of the depot area for a park. Staffhas been researching a use for the property to help revitalize the area, and continue the development that has already begun. The 1. R. Guerin Company has proposed to lease the depot from the Agency for the purpose of opening a restaurant, juice bar, a micro-brewery, and negotiate an acceptable lease beneficial to the City and 1. R. Guerin Brewery. Improvements to the building would consist of wheelchair ramps, meeting the ADA building requirements, lowering of the north end of the building to ground level,upgrading the electrical, plumbing, heating, air conditioning, and roof repairs. The improvements would be made regardless of the negotiations with 1. R. Guerin Company, and would bring the building up to code for any tenant.Barbara DeNiro, 1118 E. Adams, asked if there has been any other applicants or any other interest in the depot besides 1. R. Guerin. She questioned the need for a brewery.The Interim Economic Development Director indicated there have been many individuals interested in the depot since it was purchased by the Agency.James Guerin, 28591 Via Hacienda, San Juan Capistrano, explained they are negotiating first and foremost for a restaurant. The brewing equipment on-site is an attraction to the restaurant, which will have an on-site license to produce and sell on- site only. The Orange Police Department will regulate the extent of alcohol that can be sold as the percentage of total food volume, in terms of revenues. He added that the name of the restaurant would likely be "Old Towne Brewing Company".Bob Bennyhoff, 10642 Morada Drive, spoke in support of the proposed restaurant/micro-brewery and reported on the popularity cfmicro-breweries throughout the county.Carole Walters, 534 N. Shaffer, questioned how many liquor licenses are in the one square mile of downtown, and how many mote can there be? She added that if this is the first time this type of project will be built, is there a guarantee that taxpayer's can get their money back if the business is unsuccessful.The Interim Economic Development Director responded that the property is being leased,therefore, if J. R. Guerin Company should default on the lease, the Agency still owns the building with the improvements. She indicated she doesn' t know how many liquor licenses are in the neighborhood, however, the Orange Police Department has assured the Agency the restaurant/brewery is a good use for the area, which takes it ORANGE REDEVELOPMENT AGENCY MINUTES April 23, 1996 2. (R2100.0 AGR-2594) FISCAL IMP ACT: Sufficient funds have been budgeted for this purpose. Discussion: Barbara DeNiro, 1118 E. Adams, asked what the service is for? The Interim Economic Development Director responded legal service counsel was hired specifically for the Mills Project. MOTION SECQND AYES Murphy Barrera Murphy, Barrera, Coontz, Spurgeon, Slater ACTION: Moved to authorize the Chairman and Agency Clerk to execute on behalf of the Agency.RESOLUTIONS 2. 5 RESOLUTION NO. ORA-0308 A Resolution of the Orange Redevelopment Agency approving the preliminary report, draft plan amendment, Draft Relocation Plan, and reaffirming the rules governing participation and preferences for property owners and business occupants in connection with the proposed Third Amendment to the Southwest Redevelopment Project, and authorizing and consenting to a Joint Public Hearing of the City Council of the City of Orange and the Orange Redevelopment Agency with respect to the proposed Third Amendment. ORA- 0309 A Resolution of the Orange Redevelopment Agency making certain findings that the use of taxes allocated from the Third Amendment to the Southwest Redevelopment Project Area outside of the Third Amendment Area for the purpose of low and moderate income housing will be of benefit to the project. (R3500.0. 6)ACTION: Approved. MOTION SECOND AYES Murphy Barrera Murphy, Barrera, Coontz, Spurgeon, Slater Item Nos. 2.3 and 2.4 were removed and heard separately; all other items on the Consent Calendar were approved as recommended.END OF CONSENT CALENDAR 3.
