A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE, CALIFORNIA, SUPPORTING
ARIZONA BUSINESSES AND RESIDENTS.
WHEREAS, Federal efforts to enforce immigration laws and to address the problem
of illegal immigration have repeatedly failed, leading states, including California, whose
voters approved Proposition 187 (the "Save Our State Act") by a 59% to 41% margin in
1994, to attempt their own legislation to address the problems being caused by illegal
immigration; and
WHEREAS, in an effort to address the frustration of its citizens over the lack of
immigration reform to address the problems being caused by illegal immigration the state of
Arizona enacted a law requiring police officers during a "lawful stop, detention or arrest" to
detain people they reasonably suspect are in the country without authorization and to verify
their status with federal officials, a law that is in many respects similar to a law passed by
California voters in 1994 as part of Proposition 187; and
WHEREAS, the cities of Los Angeles, San Francisco, Oakland, Santa Ana, San
Diego and the County of Los Angeles all have passed resolutions condemning Arizona's new
immigration law, asking for boycotts of Arizona businesses and directing that their cities'
contracts not be given to Arizona businesses; and
WHEREAS, it is ironic that several legislative bodies have voiced opposition to
Arizona's law on the basis that it is unconstitutional under the federal supremacy clause, yet
have no problem voicing support for economic boycotts of Arizona which may themselves,
be unconstitutional under the federal supremacy clause as Section 8, Clause 3, of the United
States Constitution reserves to the federal government the power to "regulate
Commerce...among the several States; and
WHEREAS, such boycotts while not only being mean-spirited and misguided,
also likely violate state public bidding laws which require cities to let contracts to the
lowest responsible bidder, which includes bids from companies located outside the state;
and WHEREAS, an economic boycott only harms innocent people and businesses
and just adds to the massive economic burden Arizonans have sustained for years due to
the federal government's failure to secure our borders;
and WHEREAS, while not passing judgment on the constitutionality of Arizona'
s legislation, the City of Orange understands Arizona's frustration and supports its efforts
to try and address the negative impacts that illegal immigration has had on that
State.Furthermore, in a recent poll most American citizens support Arizona's enforcement
of illegal immigration
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Orange does hereby strongly support the businesses and residents in Arizona and encourages
free trade and interstate commerce by and between the City of Orange and the State of
Arizona.
