0519 A RESOLUTION OF THE ORANGE
REDEVELOPMENT AGENCY ESTABLISHING AND FUNDING A
HOME IlVIPROVEMENT PROGRAM FOR QUALIFIED
VERY LOW INCOME AND LOW INCOME RESIDENTS
OF THE CITY OF ORANGE FOR FY 2010-11 AND
FY 2011-12, AND MAKING CERTAIN
FINDINGS IN
CONNECTION THEREWITH.WHEREAS, the City Council of the City of Orange (the City Council)
by the adoption of Ordinance No. 21-01 on November 27, 2001, adopted the
Amended and Restated Redevelopment Plan for the Orange Merged and Amended
Redevelopment Project Area,referred to herein as the Amended Redevelopment Plan) providing for
the merger and amendment of the Redevelopment Plans for the Tustin Street
Original, Tustin Street Amendment No. 1, Southwest Original, Southwest Amendment
No. 1, Southwest Amendment No.2, Southwest Amendment No. 3, and
Northwest Redevelopment
Project Areas; and WHEREAS, both California Health and Safety Code Section 33334.
2 and the Amended Redevelopment Plan authorize and direct the Orange
Redevelopment Agency (the Agency) to expend not less than twenty percent (20%) of all taxes which are
allocated to the Agency pursuant to California Health and Safety Code Section 33670
for purposes of increasing, improving, andpreserving the community's supply of Low
and Moderate Income housing available at affordable housing cost to persons of Low or Moderate
Income and Very
Low Income; and WHEREAS, pursuant to California Health and Safety Code Section
33334.2, the Agency has established a Low and Moderate Income Housing Fund (the
Housing Fund) in connection with the redevelopment of the Orange Merged
and Amended Redevelopment Project Area (referred to herein as the Redevelopment
Project Area); and WHEREAS, pursuant to California Health and Safety Code Section 33334.
2 and in carrying out its statutorily prescribed Low and Moderate Income
housing activities, the Agency is authorized to provide subsidies to, or for the benefit of, Very
Low Income, Lower Income and Low or Moderate Income households and to increase, improve
and/or maintain the community's supply of
affordable housing; and WHEREAS, Section 33334.2 of the California Health and Safety
Code provides that Housing Fund monies may be used both inside of a redevelopment project area
as well as outside of a redevelopment project area provided a finding is made by
resolution of the Board of Directors of the Agency and City Council that the use of Housing
Funds outside of the Redevelopment Project Area will be of benefit to the Redevelopment
WHEREAS, the Agency is desirous of establishing, administering and implementing
a Home Improvement Program for FY 2011-12 and FY 2012-13 (the "
Program") authorizing the expenditure of Housing Fund monies to finance the Program; pursuant to
which, certain rehabilitation assistance will be made available to Very Low Income and
Low Income owner-occupants of single-family residences and mobile homes located
within the City of Orange (the "Qualifying Residences") to maintain the community'
s supply of affordable housing as described in the Orange Redevelopment
Agency Home Improvement Program,attached hereto as Exhibit "A" and incorporated herein
by this reference; and WHEREAS, the City Council and Agency Board adopted
the 2010-11 to 2016-17 Capital Improvement Program on June 8,
2010, which appropriated unreserved funds from the Housing Fund to the Program under Project Number
11298 in the amount of Two Hundred FiftyThousandDollars and No/100 ($250,000.00) in
each of FY 2011-12 and FY 2012-13 for a combined total
Agency financial commitment ofFiveHundred Thousand and No/100 Dollars ($500,000.00) as Project funding
over the specified two (2) year period; and WHEREAS, said appropriation from
the Housing Fund will enable the Agency to establish, administer and implement the
Program
during both FY 2011-12 and FY 2012-13;and
WHEREAS, the Agency hereby requests approval to establish, administer and implement the Program
both inside and outside of the Redevelopment Project Area withinthe City of Orange, and authorization to
expend $500,000.00 of Housing Funds to fund the Program as
more particularly described below and in Exhibit "A" attached
hereto.NOW, THEREFORE, THE BOARD OF DIRECTORS
OF THE ORANGE REDEVELOPMENT AGENCY DOES HEREBY RESOLVE AS FOLLOWS:1. The
Program and the expenditure of Housing Fund monies necessary to establish,
administer and implement the Program for the rehabilitation of Qualifying Residences for eligible
and qualified "Very Low Income Households" (as defined by Section 50105 of the California
Health and Safety Code) and "Low or Lower Income Households"as defined by Section 50079.
5 of the California Health and Safety Code) are hereby approved, which will directly
and specifically benefit and protect the community's supply of Low and
Moderate Income housing, particularly the supply of single-family residences and mobile homes, available
at affordable housing costs to such persons and families of Very Low Income and Low Lower
Income, all within the meaning
of Section 33334.2 of the California Health and Safety Code.
2. The commitment and expenditure of Housing Fund monies to establish,administer
and implement the Program and provide the requisite rehabilitation assistance to the
Qualifying Residences pursuant to the requirements of the Program are specifically authorized by paragraphs (
8) and (10) of
subdivision (
3. The expenditure of Housing Fund monies in the aggregate sum of
500,000.00 allocated over FY 2011-2012 and FY 2012-13 in the annual
amount of250,000.00 from the Redevelopment Project Area to fund the Program will be of
benefit to the Redevelopment
Project Area.4. The use of Housing Fund monies outside the Redevelopment Project
Area in accordance with the administration and implementation requirements of the Program
will be of benefit to the Redevelopment
Project Area.5. Based on the above findings and determinations, the Agency
hereby approves the Program for FY 2011-12 and FY 2012-13, as described in Exhibit "
A" hereto, and further directs and authorizes Agency staff to establish, administer and
implement the
Program as described therein.ADOPTED this 22nd
