A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AMENDING THE
COMPENSATION AND TERMS OF EMPLOYMENT
FOR THE CITY'S EXECUTIVE DIRECTORS AND
TOP MANAGEMENT EMPLOYEES FOR THE
PERIOD OF JULY 1, 2010 THROUGH JUNE 30, 2011.
WHEREAS, Resolution No. 10294 sets forth the terms and conditions of
employment for Executive Directors and Top Management employees as listed in such
resolution; and
WHEREAS, due to an estimated budget shortfall of approximately $11 million for
the 2010-2011 fiscal year, the City Council has determined to amend Resolution No.
10294 to the extent provided herein;
and WHEREAS, the City Council has consulted with the City Manager and
Human Resources Director concerning the proposed employment terms contained
herein NOW, THEREFORE, BE IT RESOLVED that the terms and conditions
of employment of the employees covered by Resolution No. 10294 are amended to the
extent provided
herein.
Agreement 1.
Term.The term of this Resolution shall be from July 1, 2010 through June 30,
2011.2.
Salary Employees covered under this Resolution shall receive a2.0% salary
increase effective June 20, 2010. Salary tables reflecting this 2.0% increase are attached as
Exhibits A and
B.3. Work
Week.The regular work week for employees covered by Resolution No. 10294 shall be
40 hours per week; provided that effective July 1, 2010, through June 30, 2011, all
such employees shall be subject to a 5.0% work furlough. The furlough shall be implemented
by closing the public services provided by such employees 13 additional Fridays during
the fiscal year beginning July 1, 2010, through June 30, 2011 (hereafter, furlough
4. Compensation During Furlough /PERS Reporting.
During the week of a furlough Friday, employees shall have a corresponding
reduction in their basic compensation to reflect the scheduled work hours for that week (36
hours). Notwithstanding this, the City shall, in accordance with PERS rules and regulations,
continue to report salary levels to PERS as if there were no furlough.
5. Vacation Conversion.
Through the entire period of the Term, the vacation conversion benefit provided in
Section 17.C. of Resolution No. 10294 shall be suspended. Suspension of this benefit shall
not affect any other provisions of Resolution No. 10294 pertaining to vacation or other
benefits including, but not limited to, retirement, vacation and sick leave accruals, insurance,
etc.
6. Industrial/Workers' Compensation Leave.
For an employee granted Industrial/Workers' Compensation leave during the Term,
compensation under such leave shall be based upon the compensation received by the
employee as a result of the furlough.
7. City's Representations.
In exchange for participating in the concessions provided herein, the City agrees that
during the term of this Amendment it will not lay off any Top Management employees,
impose any additional work furloughs or other work reductions, or otherwise modify any
rights, terms, compensation, or benefits previously agreed to in the Top Management
Resolution.
8. Status of Resolution No. 10294.
Except as specifically provided and amended herein, the terms and conditions of
Resolution No. 10294 shall govern the provisions of wages, salaries and other benefits for all
covered employees through the Term. This Resolution shall not be interpreted to extend
and/or limit any other rights, benefits, or compensation of the covered employees or the City
Council except as specifically provided herein.
