RES-10506 Amending Circulation & Mobility ElementRESOLUTION NO. 10506 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING GENERAL PLAN AMENDMENT NO. 2010-0001 AMENDING THE CIRCULATION AND MOBILITY ELEMENT TO DOWNGRADE ROADWAY AND INTERSECTION CLASSIFCATIONS LOCATED IN OLD TOWNE ORANGE ON THE CITY'S MASTER PLAN OF STREETS AND HIGHWAYS.APPLICANT: CITY OF ORANGE WHEREAS, the City Council has authority in accordance with State law to take action on General Plan Amendment No. 2010-0001 downgrading the classification of Glassell Street,Chapman Avenue, and the intersection of Glassell Street and Chapman Avenue in the Plaza area of Old Towne Orange; and WHEREAS, Glassell Street, Chapman Avenue, and their intersection at the Plaza form the core physical framework for both the National Register-listed Old Towne Orange and Plaza Historic Districts, respectively; and WHEREAS, physical modifications to Glassell Street or Chapman Avenue such as widening, and signalization of the intersection of these streets in the Plaza would markedly diminish the integrity of the two National Register-listed Historic Districts through potential demolition of historic buildings, changes to the historic relationship between historic structures and the street, removal of historic trees, as well as demolition of the historic traffic circle, park and fountain; and WHEREAS, Pursuant to the authority and criteria contained in the California Environmental Quality Act (CEQA), the Statement of Overriding Considerations associated with adoption of Final Program Environmental Impact Report No. 1815-09, certified on March 9, 2010 (SCH#2006031117), which was prepared for the comprehensive General Plan update in accordance with the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15070 et seq and in conformance with the Local CEQA Guidelines. The proposed General Plan amendment is within the scope of the program approved earlier and the program EIR adequately describes the activity for purposes of CEQA;and WHEREAS, the Planning Commission conducted a duly advertised public hearing on July 7, 2010, for the purpose of considering General Plan Amendment No. 2010-0001 and recommended WHEREAS, the City Council conducted a duly advertised public hearing on August 10, 2010 to consider the Planning Commission recommendation and public testimony in support of or opposition to General Plan Amendment No. 2010-0001 upon property described as follows:Chapman Avenue and Glassell Street in the Old Towne Orange Historic District NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that General Plan Amendment No. 2010-0001 and associated text and graphic revisions shown in Attachment A, attached hereto and incorporated by this reference, is hereby approved based on the following findings: SECTION 1-FINDINGS 1. The Comprehensive General Plan Update provides the City of Orange and its citizens with a shared community vision, goals, policies, and implementation programs that reflects its priorities for maintaining and improving the quality of life for the citizens of Orange, rather than relying on the content of the 1989 General Plan which has realized diminished relevance over the course of its 20 year lifespan.2. The circulation network promoted in the Comprehensive General Plan Update provides a platform for pursuit of a more complete multi-modal transportation network that takes advantage of the City's sidewalks, trails, commuter rail service,bus service, bikeways, roadways, and freeways, to provide the public with transportation options that have the potential to minimize local and regional traffic congestion over time, provide enhancedconnections between the City's neighborhoods, commercial districts, and recreational amenities, and support an active community lifestyle.3. Final Program Environmental Impact Report (EIR) No. 1815-09 for the Comprehensive General Plan Update was certified on March 9, 2010 and prepared in accordance with the California Environmental Quality Act. The City Council finds that the proposed activity is within the scope of the previously approved General Plan and is adequately described in the previously certified General Plan Program EIR for purposes of CEQA. The Statement of Overriding Considerations associated with adoption of the program EIR addresses the environmental effects of the project. Therefore, pursuant to CEQA Guidelines Section 15168(c), the City Council finds that the effects of the project were examined in the General Plan Program EIR and the associated findings and Statement of Overriding Considerations. The City Council also finds that pursuant to CEQA Guidelines Section 15162, the project will not cause new effects or require new mitigation measures. As such, the City Council finds that the proposed activity is within the scope of the project covered by the previously certified Program EIR and no further analysis of the project is necessary or required 4. The data and analysis upon which these findings of fact are based is set forth in the staff reports and associated documents for Final PEIR No. 1815-09 and General Plan Amendment No. 2009-0001, staff's oral presentation, public testimony, and Planning Commissioner comments and recommendation which constitute the City Council's review of this project.ADOPTED this 10th day of August, 2010 ATTEST:Mary E u ,City Clerk, ity ge I, MARY E.
