A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE DETERMINING TO COLLECT
SANITATION CHARGES ON THE PROPERTY TAX
ROLLS.
WHEREAS, the City of Orange Finance Department previously billed for residential
trash service; and
WHEREAS, with the award of a new contract for the provision of residential trash
service in the City, the billing for residential trash service has been taken over by the City's trash
contractor CR &R; and
WHEREAS, because of this, the City is now billing approximately 642 accounts solely
for the sanitation charge, which charge includes sewer, street sweeping, tree trimming, and
storm water charges and 40 accounts solely for sewer; and
WHEREAS, this has created an inefficiency in that the cost of multiple billings and
mailings is disproportionate to the amount of the charge, which annually ranges from $26.88 to
221.76 and makes the cost of attempting to collect from customers who fail to pay
disproportionate to the revenue the City receives; and
WHEREAS, pursuant to Health and Safety Code Section 5473 the City may, by
resolution approved by a two- thirds vote of the City Council, elect to have such charges
collected in the same manner and at the same time as property taxes.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Orange
hereby resolves as follows:
1. That the City has complied with the publication and notification requirements
of Health and Safety Code section 5473.1 and Government Code section 6066.
2. That the sanitation charges, as set forth in the attached Exhibit "A ", which is
incorporated herein by this reference, be placed on the Orange County Property Tax Roll for
the Fiscal Year 2013 -2014, that such charges be collected in the same manner and the same
time as the property tax, and that a copy of this Resolution, along with Exhibit "A ", be
forwarded to the Auditor - Controller of the County of Orange.
3. That this Resolution shall remain in effect until repealed or until a change is
made in the rates charged by the City.
