RES-10729 Amending Circulation & Mobility Element of General PlanRESOLUTION NO. 10729 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING GENERAL PLAN AMENDMENT NO. 2013 -0001 AMENDING THE CIRCULATION AND MOBILITY ELEMENT OF THE GENERAL PLAN IN ORDER TO REVISE THE TEXT DESCRIPTION OF THE CITY'S CRITICAL INTERSECTION PROGRAM; AND TO CORRECT FIGURE CM -2 (MASTER PLAN OF STREETS AND HIGHWAYS) TO ACCURATELY IDENTIFY CRITICAL INTERSECTIONS" AND RE -LABEL CERTAIN ROADWAYS AS "ROADWAYS OUTSIDE OF PLANNING AREA APPLICANT: CITY OF ORANGE WHEREAS, the City Council has authority per State law and Orange Municipal Code Section 17. 10.010 to take action on General Plan Amendments; and WHEREAS, the City Council adopted a comprehensive update to the General Plan including the Circulation and Mobility Element on March 9, 2010 as well as subsequent amendments; and WHEREAS, the Circulation Element describes the City's Critical Intersection Program and identifies the locations of "Critical Intersections" on Figure CM -2, Master Plan of Streets and Highways; and WHEREAS, the City's list of "Critical Intersections" is maintained by the City Traffic Engineer or designee; WHEREAS, in order to better communicate the City's policy related to its Critical Intersection Program, the City desires to refine the Circulation Element's definition of a Critical Intersection "; and WHEREAS, the "Critical Intersections" shown on Figure CM -2, Master Plan of Streets and Highways, are not entirely consistent with the list of intersections in the City with critical intersection" status; and WHEREAS, the City desires to correct Figure CM -2 so that the "Critical Intersections" shown are consistent with the City Traffic Engineer's determinations and with the supporting traffic analysis included in the General Plan and Program Environmental Impact Report No. 1815 -09, certified on March 9, 2010 (SCH #2006031117); and WHEREAS, General Plan Figure CM -2, Master Plan of Streets and Highways, shows City "street classifications" for portions of Villa Park Road, Taft Avenue, Meats Avenue, and Lemon Street -South Mesa Drive -Loma Street located within the City of Villa Park; and WHEREAS, because the City of Orange has no authority to oversee or otherwise regulate streets outside of its Planning Area, the City desires to re -label such streets as Roadways Outside of Planning Area" on Figure CM -2, Master Plan of Streets and Highways; and WHEREAS, the Planning Commission, having considered the proposed changes to the General Plan contained herein at a duly advertised public hearing held on March 4, 2013, including review of the staff report and receiving public testimony on the item, has determined that General Plan Amendment No. 2013 -0001 is justified and recommended approval thereof; and WHEREAS, the City Council considered the proposed changes to the General Plan contained herein at a duly advertised public hearing held on July 9, 2013 and August 13, 2013 including review of the staff report and receiving public testimony on the item. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves General Plan Amendment No. 2013 -0001, and associated text and graphic revisions as depicted on Exhibit "A" (Proposed Text Revisions, shown in underline /stfi-k format), Exhibit "B" (Amended Text), Exhibit "C" (Proposed Changes to Figure CM -2) and Exhibit D" (Amended Figure CM -2), attached hereto and incorporated by this reference based on the following findings: SECTION 1— FINDINGS The subject General Plan Amendment clarifies the definition of a "critical intersection ", making it more straightforward and reflective of current City policy and practices. The subject GPA also rectifies inconsistencies in the General Plan Circulation and Mobility Element's Figure CM -2 as related to the list of "critical intersections" maintained by the City Traffic Engineer. The subject GPA makes the General Plan Circulation and Mobility Element's Figure CM -2 consistent with the 2010 General Plan traffic modeling and the technical analysis provided in the 2010 General Plan EIR. Finally, the subject GPA corrects Figure CM -2, re- labeling certain streets that are located outside of the City's Planning Area as "Roadways Outside of Planning Area ". The proposed revisions correct errors and accurately communicate City policy matters as related to the circulation system. The General Plan Circulation and Mobility Element (as revised) provides for a circulation system that accommodates existing and projected traffic volumes and minimizes traffic congestion. 2 SECTION 2- ENVIRONMENTAL REVIEW Final Program Environmental Impact Report (EIR) No. 1815 -09 for the Comprehensive General Plan Update was certified on March 9, 2010 and was prepared in accordance with the California Environmental Quality Act (CEQA). Pursuant to CEQA Guidelines Section 15168(c), the City finds that the effects of the project were examined in the General Plan Program EIR and the associated Findings and Statement of Overriding Considerations. The City also finds that pursuant to CEQA Guidelines Section 15162, the subject text and graphic revisions will not cause new effects or require new mitigation measures, which were not already identified in the General Plan Program EIR. As such, the City finds that the proposed activity is within the scope of the project covered by the previously certified Program EIR and nothing further is necessary or required to comply with CEQA.
