A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE MAKING CERTAIN FINDINGS
RELATED TO CALIFORNIA ENVIRONMENTAL
QUALITY ACT (CEQA) COMPLIANCE AND
APPROVING GENERAL PLAN AMENDMENT NO
2013 -0002 ADOPTING THE CITY OF ORANGE 2014-
2021 GENERAL PLAN HOUSING ELEMENT.
APPLICANT: CITY OF ORANGE
WHEREAS, the City Council has authority per State law and Orange Municipal
Code Section 17. 10.010 to take action on General Plan Amendments; and
WHEREAS, the Housing Element is one of the required chapters of the City's
General Plan, required by State law;
WHEREAS, the City previously adopted its 2006 -2014 General Plan Housing
Element in April 2010;
WHEREAS, the California Government Code requires Cities to review and update
their Housing Elements according to a schedule set forth by the State Department of Housing
and Community Development (HCD);
WHEREAS, the City also desires to update its Housing Element to ensure that it
accurately reflects the City's housing policy and addresses community needs;
WHEREAS, the City has prepared the 2014 -2021 Housing Element as an update to
its previously approved Housing Element in compliance with State law; and
WHEREAS, the City has prepared Initial Study No. 1834 -13, evaluating the
environmental effects of the proposed Housing Element in compliance with the provisions of
the California Environmental Quality Act (CEQA); and
WHEREAS, the Planning Commission, having considered the proposed General
Plan Housing Element and Initial Study 1834 -13 at a duly advertised public hearing held on
December 16, 2013, including review of the staff report and receiving public testimony on
the item, has determined that General Plan Amendment No. 2013 -0002 is justified and
recommended approval thereof; and
WHEREAS, the City Council considered the proposed General Plan Housing
Element update and Initial Study 1834 -13 at a duly advertised public hearing held on January
14, 2014 including review of the staff report and receiving public testimony on the item.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves
General Plan Amendment No. 2013 -0002 adopting the 2014 -2021 General Plan Housing
Element attached hereto as "Exhibit "B" and incorporated by this reference based on the
following findings.
BE IT FURTHER RESOLVED that the City Council directs staff to implement the
policy action programs identified in the 2014 -2021 Housing Element.
SECTION 1— FINDINGS
1. The General Plan Housing Element meets the requirements of Housing Element law.
The Housing Element contains a housing needs assessment, resources and constraints
analysis, review of past performance, housing policy program and adequate sites
analysis, consistent with State requirements. Further, the State HCD reviewed the Draft
Housing Element and issued a letter finding the Housing Element in compliance with
State law (dated September 25, 2013). Following City adoption of the 2014 -2021
Housing Element, a copy will be submitted to the State for final certification.
2. The Housing Element is generally consistent with the goals and policies stated within
all other elements of the City's General Plan.
The Housing Element is consistent with the City's land use plan and is consistent with
the goals and policies of the remaining elements of the General Plan.
3. The Housing Element advances the State's housing goal of "decent housing and a
suitable living environment for all members of the community ".
The Housing Element contains a needs assessment documenting housing needs in the
Orange community and establishes policy action programs to meet those needs through
the preservation, conservation, improvement and production of housing units in Orange.
The housing policy action programs aim to provide opportunities for production of new
housing units for all income levels, and also address housing for special needs groups
including seniors and large families. As such, City adoption of the Housing Element and
implementation of the housing policy action programs advances the State's housing goal
of providing "decent housing and a suitable living environment for all members of the
community."
SECTION 2 — ENVIRONMENTAL REVIEW
Initial Study No. 1834 -13 attached hereto as "Exhibit A" was prepared to evaluate the
physical environmental impacts of the Housing Element update in conformance with the
provisions of CEQA. The Initial Study finds that the Housing Element plans for the
development of 363 new housing units and identifies development capacity for up to 5,702
new units. New housing units are anticipated to be developed on properties already
designated for "residential" or "mixed use" development pursuant to the City's 2010 General
Plan. The Program Environmental Impact Report (PEIR) for the 2010 Comprehensive
General Plan Update (State Clearinghouse No. 2006031117, certified on March 9, 2010)
analyzed the environmental effects of General Plan buildout, which represents a greater
number of housing units than are proposed under the Housing Element. Because the 2010
General Plan PEIR analyzed the impacts of development pursuant to the 2010 General Plan

Land Use Plan and development anticipated by the Housing Element is less than that
anticipated under General Plan buildout, the environmental effects of the Housing Element
update were already accounted for in the previously- certified General Plan PEIR.
Based on the above and the analysis contained in the Initial Study, the environmental effects
resulting from the Housing Element have already been adequately analyzed and mitigated
pursuant to an earlier Environmental Impact Report (Program Environmental Impact Report
prepared for the 2010 Comprehensive General Plan Update, State Clearinghouse No.
2006031117, certified on March 9, 2010). Further, the Initial Study finds that the Housing
Element would result in no new significant impacts or a substantial increase in the severity of
impacts (beyond those already analyzed in the earlier EIR). As such, no new mitigation
measures are required. Therefore, pursuant to CEQA Guidelines Sections 15168 and 15162,
no further documentation is warranted or required in order to comply with CEQA.
The City Council reviewed and considered any written correspondence submitted along with
any testimony at the public hearing. After examining the Initial Study and based on its
independent review and judgment, the City Council finds that nothing further is warranted or
required to comply with CEQA.
