A request to construct a second unit and the conversion/partial demolition 01 an existing detached
accessory structure into a garage/workshop. The site is located at 525 South Orange Street.
NOTE:
Negative Declaration 1646-00 was prepared to evaluate the environmental impacts of this
project.
The applicant is requesting to continue this item to the meeting 01 January 15, 2001, to allow additional
time to prepare changes to the project.

3. CONDITIONAL USE PERMIT 2341-00 AND ADMINISTRATIVE ADJUSTMENT 00-09 - JTC
ARCHITECTS INC. (PACIFIC BELL)
An application lor a conditional use permit to allow the expansion 01 an existing telephone equipment
lacility on property zoned R-1-7 (Residential, single-Iamily, minimum lot size 7,000 sq. It.) and an
administrative adjustment to allow a 10% reduction in parking space and drive aisle dimensions and a 10%
increase in perimeter lencing/walls height. The site is located at 2525 Orange-Olive Road.

NOTE:
Negative Declaration 1656-00 was prepared to evaluate the environmental impacts of this
project.
Commissioners Pruett and Romero were not at the July 5, 2000 meeting, but have reviewed the staff
report and Minutes from that meeting and felt they would be able to participate in the discussion.
Chairman Bosch noted the Commission had received a letter from John Stratman dated November 30,
2000 and a letter from Melvin Schlueter dafed November 28, 2000.
The public hearing was opened.
John Stratman from Pacific Bell, stated they met with the residents on Delta Street on August 8, 2000 to
discuss the expansion of their facility. Seventeen (17) residents attended the meeting and also toured
the facility. Another meeting with the residents was held on August 17, 2000 to try and resolve issues
with the expansion plans. The revised site plan is a compromise from the first Planning Commission
meeting and there have been many changes.
John Chan. JTC Architects Inc., talked about the changes that were made to the site plan. The setback
along Delta Street will be 20 feet and will be fully landscaped. The new garden wall at the setback will be
split face concrete block 6'7" in height. The gate is reduced to a width of 4 feet and will be kept closed.
Light poles will be lowered to 20 feet and glare will be minimized. The air conditioning equipment will be
contained in the basement to help eliminate noise, They would like to maintain the existing wall as long as
possible and put in the garden wall towards the end of construction. A new parking area will be added on
the west side of the property along Orange-Olive Road,
Mr. Stratman said some concerns still need to be resolved, He referred to Page 7 in the staff report,
Condition 3a. - Demolish the existing wall facing Delta Street and that portion of the wall within the 20'
street side setback area, They had concerns about construction and noise and requested that the
wording be changed to "Prior to occupancy of the new building, the project proponent shall:" Condition 5
relative to the time frame of once per year, not to exceed five days, limits them. Condition 13, on Page 8,
refers to the number of parking stalls for their service vehicles. They request to either delete the condition
or ask that the number be changed from 19to 28 service vehicles. Pacific Bell needs to open their facility
to co-locators. He asked for clarification on condition 17.
Commissioner Romero asked what the expected time frame of construction would be for the expansion of
the facility. Mr. Stratman said they are five months behind schedule and they are looking at a 15 month
interval.
Tim NQ, Senior Proiect ManaQer, responded to questions about the cable pulling equipment.
Commissioner Pruett asked questions about parking for co-locators. He wanted to know if their vehicles
are left at the facility over night. Mr. Stratman responded the vehicles are not left over night. There are a
total of 30 to 35 vehicles at the site. Eighteen (18) Pacific Bell trucks are housed at the facility.
Commissioner Pruett thought visitors parking might be a better definition.
Commissioner Carlton asked about the maximum height of lighting at the property now. Mr. Chan
explained there are 30 toot light poles towards the rear of the property, near the block wall. They will be
replaced with the 20 foot light poles.

Plans continue to change and there is no assurance that the service vehicles will not be starting up during
the night. A staging point for the vehicles is a concern. There has been no allempt to shield the existing
lights. Spill over of sound from the cooling towers is a concern, The residents ask that the Commission
establish specific limits. Landscaping is an issue.
Applicant's response
Mr. Stratman responded to the comments made by the public. The number of vehicles at the site was
addressed and he didn't see the staging area as a problem. Odd hours of the service vehicles doesn't
occur frequently.
Mr. Chan spoke about the light spillage from the site and cooling tower problems. They have made a
commitment to correct the lighting problems. They will hire an acoustic engineer to address the noise
concerns, and they will meet the requirements of the City's noise ordinance.
Mr. Stratman said that landscaping has been an issue in the past, but they will strive to maintain the
landscaping. However, they could not guarantee how long the maintenance will be in place (because of
budget constraints).
Commissioners Carlton and Romero were adamant that all landscaping shall be maintained for the life of
the project.
The public hearing was closed.
Chairman Bosch asked the City Allorney to address the concern raised by the applicant relative to
indemnification of the City in condition 17.
Ms. Binning stated that condition 17 is the City's standard indemnification and hold harmless clause and
they are not willing to negotiate on that condition. Condition 13 refers to the number of service vehicles
and the applicant has asked where in the code this might be required or allowed. She clarified that this is a
conditional use permit. The service vehicles are related to the use. This isn't a restriction on the number
of parking spaces available. The number of vehicles impact the neighborhood and this is a reasonable
condition.
Commissioner Pruell wondered if the Commission should be addressing the parking spaces that are
approved as an issue. The plans show 46 spaces. The other issue to be discussed is lighting.
Conditions 14 and 15 address that issue in terms of limiting the glare onto adjacent properties. There is
also the C~y's code that limits the spillage of lighting onto adjacent properties and a code that addresses
the noise issue.
Mr. Godlewski explained that the new equipment would be required to conform to the code standards.
Commissioner Pruell said that maintenance of landscaping should be added as a condition to assure that
Pacific Bell's budget dollars are included in future applications to the Public Utilities Commission.
Commissioner Smith proposed the following condition: "All landscaping must be consistently planted,
maintained, and watered to the level required by the initial approved plan."
Commissioner Carlton wanted to specify the minimum size of trees on Delta Street. And, she wanted to
amend condition 15 requiring that the existing light poles be replaced with 20 foot light poles and be
shielded from light spillage.
Chairman Bosch referred to the landscape plans, which illustrates 15 gallon street trees and in the setback
along Delta Street, a row of six 24 inch box 8-10 foot tall trees. He was comfortable with the review
process through the Crime Prevention Bureau relative to lighting.

Commissioner Romero was pleased that Pacific Bell had met with the residents and the work that had
been done to mitigate some of the neighbors' concerns. He was not adverse to leaving the wall up along
Delta Street until construction has been finished. It would be advantageous to the neighborhood in
reducing noise. A compromise is needed on the cable pulling equipment.
Chairman Bosch thinks there has been extraordinary progress with the plans. He's glad that the
Administrative Adjustment request has been eliminated relative to the 20 toot setback. He's concerned
with the lights and wants to be sure there is shielding to prevent spillage. The noise from the cooling
towers was not fully addressed and needs to be added to the conditions of approval. The wall needs to
be built in conjunction with the excavation construction of the basement. They have to allow service
vehicle parking, but he is concerned that the number ot service vehicles might exceed the number of
parking spaces.
The Commission talked about condition 16 and wanted to know how the project is monitored during the
construction period. Mr. Godlewski reviewed staff's procedures for the phases of construction. A more
frequent monitoring (6-month review) of the lights, noise, and maintenance after the project is completed
was requested. The Commission was also concerned about the equipment sitting in the neighborhood
and wondered how the equipment would be protected from a potential safety hazard or public nuisance
for children.
Mr. Stratman said that the equipment is not enclosed. There are no safety measures in place for their
cable.
Commissioner Pruett would like to see temporary fencing installed around the cable pulling equipment
when it is sitting in the neighborhood.
Commissioner Smith took exception to the applicant's comments about other utility companies not
providing safety measures. The applicant is the one responsible for making sure of the safety in the
neighborhood.
Chairman Bosch commented that condition 5 was too stringent in terms of once per year or five business
days, but it is also missing key elements in public safety and control to avoid an unwarranted impact upon
the neighborhood in terms of light, noise, glare, personnel, etc. 24 hours a day without some limitation.
He suggested setting some hours of operation for that machinery in the residential neighborhood. That if
the machinery is left in the setback where it is available for access to people overnight or over the
weekend or a non-business time, that there be some temporary security put in place on it. And, specify
the number of consecutive days that the machinery can sit there.

Moved by Commissioner Bosch and seconded by Commissioner Carlton to approve Negative Declaration
1656-00, including the initial study and comments received during the public review process, and find that
there is no substantial evidence that the project will have a significant impact on the environment or wildlife
resources based upon the design, public testimony and mitigation measures.

Adjustment 00-09 with regard to the size of parking spaces and drive aisle maneuverability on site, and
eliminate the previously requested Administrative Adjustment to reduce the setback area along on Delta
Street since the revised plans have increased that setback area to the code required 20 feet.

MOTION
Moved by Commissioner Bosch and seconded by Commissioner Pruett to approve Conditional Use
Permit 2341-00 with conditions 1-19 as set forth in the staff report, adding condition 20: "All landscaping
must be consistently planted, maintained and watered to the level required by the initially approved plan
and City ordinances."
And, add condition 21: "The air conditioning equipment will be replaced from the parking lot with new
equipment to be placed in the basement of the proposed building addition. The interior walls of the
basement area will be covered with sound attenuating baffling material to further reduce ambient noise
levels. No noise generating equipment shall be associated with the new cooling tower located in mid-site,
immediately east of the existing building. Openings on the exterior of the switching building shall be for
vents to control the interior pressure of the building and not connected to any ventilation equipment.
And, that the applicant will prepare, at applicant's expense, a noise study, acceptable to the City, once the
building is completed and fully operational. Said study to be submitted to the City within six months of
issuance of the certificate of occupancy of the new structure. Said study to delineate the noise levels
around the perimeter property line of the subject site and that the applicant, at it's expense, shall modify
the existing building and site (equipment improvements) to further decrease the ambient noise level, if
the noise study finds the new noise levels exceed the maximum levels allowed by the Orange Municipal
Code, day or night."
Amend condition 3: "Prior to issuance of certificate of occupancy permit for the new building, the project
proponent shall:"
Reword condition 5: "The use of cable pulling equipment shall not extend beyond the 20' street side
setback along Delta Street, and shall not exceed five consecutive work days in any single occurrence,
shall be protected by temporary security fencing, subject to the review of the City, and shall be operated
only within the hours of operation and noise levels specified within the City's municipal ordinances for
construction.
Amend condition 10 by adding to the first sentence: "street improvements on Delta Street..."
Delete condition 13.
Amend conditions 14 and 15 to stafe that: "Light fixtures, if pole mounted or on the building, shall not
exceed 20 feet maximum height above adjacent grade and shall be shielded fixtures to assure that no
direct visibility of the lamp in the fixtures or light spillage occurs across the property line, in addition to
conforming with City ordinance."
Amend condition 16 to require a 6 month review from date of issuance of certificate of occupancy.

4. TENTATIVE PARCEL MAP 2000-203 - MELVIN AOU
A request to subdivide a vacant parcel of land approximately one (1) acre in size into 4 smaller parcels for
the development of 4 single family homes. The site is on the north side of Walnut Avenue, 142 feet west
of Hamlin Street.

NOTE:
This project is categorically exempt from the provisions of the California Environmental Quality
Act.
Mr. Godlewski reported that at the last Planning Commission meeting the Commission continued this item
in order for the applicant to address some of the concerns that were raised. Those concerns include the
requirement to provide adequate on-site guest parking, provide for trash pick up, and suggested
resolving concerns that were brought up relative to the setbacks and relationship of the proposed lots to
the existing lots in the surrounding neighborhood. The applicant addressed these issues in the form of
revising the site plan and offering conditions relative to the site planning of the proposal, rather than
changing the actual lot lines of the parcel map as originally submitted. This is the same parcel map seen by
the Commission previously and the applicant is proposing to address the issues through conditions or
stipulations of a site plan.
In reviewing the requirements for approving a parcel map, the City Attorney has reviewed the Subdivision
Map Act in relation to what conditions can be imposed on a parcel map, and they are limited specifically to
those items that would be addressed by the actual subdivision of the land, and not to the subsequent
development in the way of a site plan.
Mr. Reynolds added there are three items that the Commission can focus on in terms of imposing
requirements. The City may only impose requirements on the dedication of rights-of-way, easements and
construction of reasonable off-site and on-site improvements for the parcels that are being created.

GreQ House. 23970 Nicole Wav. Vorba Linda, represented the applicant. He handed out photo books to
the Commission and explained each picture as it related to their project. They are asking to subdivide the
property into four lots to be built with two story homes. A previous plan had already been approved for
four homes. He outlined the Commission's previous concerns of on-site guest parking, trash pick up, and
a lack of privacy with window placement and the five foot side yard setback. Corrections were made to the
site plan to address the Commission's concerns. There are eight guest parking spaces on the site. There
is now a 25 foot ingress/egress for cars. They have worked with the waste management company for trash
pick up and have gotten their approval. The bathroom windows are opaque or glass block to address
privacy issues. The applicant proposes to build four homes at one time and will keep the noise and traffic
to a minimum. He pointed out that five of the eight properties adjoining this property have two story
homes. Side yards will be 7 feet and 28 feet to the rear property line. Perimeter fencing will be on three
sides, and they prefer to put up a block wall fence. They understand that the horse property is
grandfathered in and they do not object to the horses. Changing the parcel map didn't address the issues
raised at the previous hearing.
Chairman Bosch stated that the issue before the Commission is a tentative parcel map; not a site plan.
And, the City Attorney's office has informed them that they can only condition a tentative parcel map
relative to right-of-way dedication, easements and reasonable off- and on-site improvements,
Mr. Reynolds said if the owner/applicant is willing to have all of the stipulated conditions appear on the
parcel map, the City can allow them to be put on the map. It binds the owner to some degree. The site
map will not appear on the parcel map, but it would have to be incorporated by reference. He was not sure
how much the footprints have been reviewed and how closely they would meet the development
standards of the City.
Commissioner Pruett was concerned about the safety issues of the trash trucks pulling into the private
driveway and backing out. The waste management company indicated they want to be held harmless from
any damages that occur. It sounds like they are putting a liability on the new property owners for any
potential damage.

Commissioner Smith was confused. If the Commission is to look at a parcel map and not the specifics on
the property, then why did they ask the applicant to come back with specific information.
Mr. Reynolds responded that the specific information was important to have so that the Commission could
determine if the parcel map makes sense.
Chairman Bosch explained to summarize fhe concerns of the Commission, he referred to the need to
redesign the parcel map, He saw the challenge relative fo appropriate development of the property
relative to the neighboring properties and consistent with the development that had occurred in that
neighborhood to be not apparent in the design where the side yards were placed in the rear yards of
adjacent homes unlike the vast majority of the adjacent homes where streets allowed cui de sacs and
different arrangements to occur. One way of resolving side yard setbacks, window placement and lack of
privacy with two story homes was altering the location by definition of side yards with a specific question as
to how one could do that unless you cause the front of the lot to be on a public street. It can be done by
redesigning the parcel. The applicant elected not to pursue that direction and came back with a revised
site plan.
Commissioner Romero had hoped the applicant would come back with other examples of flag lots that
have been approved in an existing residential area, He is not enthused about a flag lot design, He prefers
to see three houses built on the property rather than four.

The speakers still opposed the four lot subdivision. A three-lot subdivision will resolve many issues of
privacy, parking and the horse-keeping property. The parcel map has not been engineered. The current
property owners' rights need to be protected. There will be safety issues with the proposed trash pick up.
A letter from a neighbor on Walnut opposing the project was read into the record. Mitigation measures
need to be addressed, There should be a 50 foot setback for equestrian properties. The new homes will
not conform to the neighborhood or area. The owner has not met with the neighbors. Approving this
project will cause detrimental effects to the neighboring properties. There are concerns about traffic,
odor, dust, children's safety, privacy and loss of view.
Applicant's response
Mr. House responded to the speakers' concerns. They plan to keep as many trees as possible. They
respect the rights of the current horse owner. But, it was pointed out the horses are not kept 50 feet from
adjoining properties now. He did not think there was traffic and parking congestion all day long caused by
the school and church. The proposed back yards are large enough for children to play in; there is no need
for children to play in the street. He acknowledged that the applicant has not met with the neighbors. As a
representative of the client, Mr. House had not met with the neighbors either,
The public hearing was closed.
Commissioner Pruett stated when this malter was before the Commission previously, he made a motion to
deny the parcel map, At the urging of the rest of the Commission, the project was continued to allow the
applicant the opportunity to re-work the plan. He's very disappointed and outraged that the applicant has

not taken the Planning Commission's concerns seriously. The proposed plans do not conform to the
neighborhood. The circulation does not fit with the private drive and 4-lot configuration. The plan does
not address the issues and he cannot accept the comments that were made,
Commissioner Carlton thought the tentative parcel map complied with all of the codes. The large parcel
will accommodate the four lots in her opinion. Each lot will have more square footage than the
surrounding properties.
Commissioner Romero was not too enthused about the project. He is against flag lots and building four
homes on the property.
Commissioner Smith thought the project would be better served by a three lot subdivision. She is not in
favor of this particular map. However, when the parcel map meets all of the City's codes, she has difficulty
in saying that it is not appropriate, She also has concerns about the properties that are not meeting the
City's codes.
Chairman Bosch had encouraged the applicant to look for a better way to resolve issues with this parcel
map at the previous hearing. However, he feels the parcel map is inappropriate for this parcel of land. The
four lots over-burdens the property and will damage the potential future residents as well as the adjacent
neighborhood. He had hoped to see the problems resolved in the parcel map. Although the parcel map
met the zoning ordinance, it caused extraordinary hardships in terms of circulation, backing out onto the
public street, inability of the trash truck to tum around, safe hammer head turn around for a fire truck, and it
sets up conditions of placing habitable rooms adjacent to guest parking and the driveways.
It was noted the project is categorically exempt from CEQA review.

2000-203 with the findings that had been articulated in the Commission's discussion of the project.

5. ORDINANCE AMENDMENT 3-00 - CITY OF ORANGE SPECIAL EVENTS
A proposal to amend the City zoning Ordinance related to special events in order to clarify the definition of
a special event, and establish criteria and findings related to event duration, land use compatibility,
vehicular traffic, public health, safety and welfare, and maintenance and promotion of the City's business
environment.

Bill Selman. 1800 East Chapman Avenue, spoke about special events to promote a business and he is in
favor of the amendment.

The Commission talked about outdoor sales and car sales at The Block. Mr. Godlewski stated the
amended ordinance takes these activities into consideration and limits them to only two events per year at
anyone location. The Commission suggested adding commercial activities to Section 17.46.080,
Chairman Bosch was still concerned about determining a threshold for considering an event in terms 01
number of people or activities in public places or in the public institution zone, Mr. Godlewski said public
places are covered in a different section of the ordinance, Chairman Bosch thought it needs to be
controlled to protect the property rights of the individuals and to maintain the zoning ordinance.
Mr. Godlewski said the ordinance could be researched further to address special commercial events and
be brought back to the Commission with corrections.

6. MINOR SITE PLAN REVIEW 145-00 AND ADMINISTRATIVE ADJUSTMENT 00-20 - GARY JONES
(OWNER OF HORTUS NURSERY)
A request to convert a used-car lot and car storage facility to a specialty plant nursery. The proposal
includes the demolition of two storage sheds and rehabilitation of three existing structures. The applicant
has applied for an administrative adjustment to allow a 10% reduction in the number of required on-site
parking spaces. The site is located at 403 West Chapman Avenue and 135 North Atchison Street and is in
the Old Towne Historical District.
NOTE:
Negative Declaration 1666-00 was prepared to evaluate the environmental impacts of this
project.
The public hearing was opened.
Gary Jones. owner of Hortus Nurserv, is asking the Commission to consider the a nursery at this site. Their
goal is to enhance the historical building and reintorce the existing architecture.
Commissioner Smith is very excited wilh Hortus Nursery wanting to establish their business in Orange.
Chairman Bosch stated the proposed use meets all of the requirements with a very minor administrative
adjustment to allow a reduction in parking spaces.

145-00, with conditions 1 through 10, as listed in the staff report, based on the findings that this project is
compatible with surrounding development and neighborhoods. The project conforms to City
development standards. It has complied with the special design guidelines for the area and the
Southwest Redevelopment Plan and Depot Plan. The project provides for safe and adequate vehicular
and pedestrian circulation, both on- and off-site. City services are available and are adequate to serve the
project. And, the project has been designed to fully mitigate or substantially minimize adverse
environmental impacts.
