1. CONDITIONAL USE PERMIT 2326-00 AND ADMINISTRATIVE ADJUSTMENT 00-04 - KEN ARTHUR
A request to allow the demolition of an existing garage and the construction of a new two-car garage and
workshop with a new second-story unit over the garage. The project includes two parallel open parking
stalls on the south edge of the driveway. The site is located at 133 North Shaffer Street and is within the
Old Towne Orange Historic District.
(This item was continued from the April 3, 2000 and the May 15,2000 meetings.)
NOTE:
Mitigated Negative Declaration 1632-00 was prepared to evaluate the environmental impacts
of this project.
The applicant requested to continue this item to the next meeting due to delays in preparing the
requested revisions.

Moved by Commissioner Carlton and seconded by Commissioner Romero to continue Conditional Use
Permit 2326-00 and Administrative Adjustment 00-04 to the meeting of Wednesday, July 5, 2000.

3. VARIANCE 2085-00 - KAUFMAN & BROAD COASTAL, INC.
A request to allow the construction of a 6' high wall within the front yard setback. The site is located at
7179 East Magdalena Drive.
NOTE:
This project is categorically exempt from the provisions of the California Environmental Quality
Act.
Chairman Bosch excused himself from the meeting due to a potential conflict of interest. The remainder
of the meeting was chaired by Vice Chair Pruett.
There was no opposition to this item; therefore, the full presentation of the staff report was waived, and
the public hearing was opened.
Applicant, Eric Scheck with Kaufman & Broad, talked about the unique situation with Lot 16. The front
yard of Lot 16 becomes the side yard. To help enclose the yard and provide a solution, they propose to
build a 6' high decorative masonry wall, with a 2' planted area before the wall. The wall will be a split-face,
standard light beige masonry wall.
Commissioner Carlton wanted to know why the developer is just now asking for a variance when they are
in the framing stage of construction. She thought there were other solutions, such as a smaller house on
the lot, that could have been brought forward.
Mr. Scheck explained the tentative tract was approved prior to Kaufman & Broad acquiring the property.
Commissioner Pruett asked about the long sliver of land that is to the east of the tract and wondered if it
were being maintained by an association. Mr. Scheck replied that this area is a part of the homeowner's
association.
Commissioner Pruett asked if there would be an objection to including this area in condition 2, so that the
landscape/irrigation system and landscaping will be maintained by the association to ensure that the
neighborhood would not have an unsightly wall. Mr. Scheck said that would not be a problem.
The public hearing was closed.
It was noted the project is categorically exempt from CEQA review.
MOTION
Moved by Commissioner Pruett and seconded by Commissioner Romero to approve Variance 2085-00
with conditions 1 through 6, modifying condition 2: "Landscaping and an automatic irrigation system shall
be installed and maintained by the association, along with the adjacent parcel, in substantial conformance
with landscape proposal submitted with this application, prior to finaling building permit." The Commission
finds that because of special circumstances applicable to the subject property with the layout of Lot 16,
the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed
by other properties in the vicinity and under identical zone classification; and that the variance granted
shall be subject to such conditions which will assure that the authorized adjustment shall not constitute a
grant of special privilege inconsistent with the limitations upon other properties in the vicinity and zone in
which subject property is located.

Moved by Commissioner Smith and seconded by Commissioner Carlton to adjourn to Monday, June 26,
2000 at 3:00 p.m. in the Weimer Room for a tour of the Santiago Hills Phase 2; and then to the next
regular meeting on Wednesday, July 5,2000. The meeting adjourned at 7:11 p.m.
