APPROVAL OF THE MINUTES FROM THE REGULAR MEETINGS OF
JANUARY 5, 2004, (CONTINUED FROM THE FEBRUARY 2, 2004
MEETING) JANUARY 19,2004 AND FEBRUARY 2, 2004.
The minutes ofthe meeting of February 2,2004 were withdrawn and are to be continued to the
next regularly scheduled meeting of March 15,2004. Commissioners voted on the minutes of the
meetings of January 5,2004 and January 19, 2004.
Commissioner Domer moved to approve the minutes ofthe January 5,2004, and January 19, 2004,
Planning Commission meetings, and it was seconded by Vice-Chairman Bonina.

(2) CONDITIONAL USE PERMIT 2485-03 - DAVE & BUSTER'S
A request to allow the sale of alcoholic beverages on a new patio being added to the
south side ofthe existing restaurant/entertainment facility. The site is located at 20
City Boulevard West.
NOTE:
This project is categorically exempt from the provisions of the
California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15303-c (New Construction or Conversion of
Small Structures).

Leslie Aranda Roseberry gave a staff presentation. The applicant proposes the on-site sale of
alcoholic beverages within a new 1,351 sq. ft. outdoor patio at the Dave and Buster's Restaurant
located at The Block at Orange. To implement the proposal the appiicant has applied for
Conditional Use Permit 2485-03 to amend approved Conditional Use Permit2225-98, which
allowed the applicant to have on-site sales of alcoholic beverages and an entertainment facility
with amusement arcade machines. The applicant's restaurant is located at the northwest comer of
The Block at Orange.
The applicant, Bryan L. Spain, (Senior Vice President, Procurement Development, Dave &
Buster's, 2481 Manana Drive, Dallas, TX 75220), gave a presentation on the proposed new
outdoor patio. He noted that they wished to modify the back entrance to the facility and create a
patio-type environment in addition to an indoor/outdoor small bar area. He explained that Dave &
Buster's had approached The Mills Corporation (owners of The Block at Orange) about doing
something to "dress up" the entrance where Dave & Buster's is located. The Mills Corporation
had proposed a signage change to which they felt was not enough to attract more customers to that
end ofthe mall (which is typically less active than other areas of the mall).
The Commissioners had the following questions:
· Is there access from the outdoor patio into the mall? The answer was there was an
"emergency only" exit from the patio/grilllbar area into the mall- and it was clearly
marked as such. Additionally, there was a "panic bar" located on the gate to notify
patrons this was an emergency-only exit.
· How high is the fencing around the patio? The answer was that the patio fence
would be approximately 42".
· The indoor/outdoor dining is under a current roof that is there -- would the new bar
be within/underneath the roof area? The answer was yes, and there would be metal
security gates that came down at night to secure it.
· Had the neighbors been notified of these proposed changes? The answer was there
needed to be mall approval to make these changes, so yes, all of the patrons of the
mall were aware of it and had to support it in order for them to go forward.
· The condition (#29) that states "there shall be no special promotional events held on
the property, unless a written request for such is received and approved by the City
of Orange Community Development Director and the Police Department's Vice
Unit at least one week in advance" - does this apply to political events? Sergeant
Kisela of the City of Orange Police Department responded to this question. He
explained that the reason for this condition is that for any gathering that could
create an undue drain on resources of the police department (i.e., where there would
be an inordinate amount of people/potential issues) or anything out ofthe normal
day-to-day operation, the applicant would be required to contact them and advise
them of what the event is, etc., and to acquire approval for the special event.
