RES-10932 Letter of Understanding For Maintenance & Crafts EmployeesRESOLUTION NO. 10932 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ORANGE AND THE ORANGE MAINTENANCE AND CRAFTS EMPLOYEES' ASSOCIATION EFFECTIVE JULY 1, 2015 THROUGH JUNE 30, 2017. WHEREAS, the City of Orange, hereinafter referred to as "City," and the Orange Maintenance and Crafts Employees' Association have met and conferred in accordance with the requirements of the Meyers - Milias -Brown Act; and WHEREAS, the City and the Orange Maintenance and Crafts Employees' Association have reached agreement on wages, salaries, and other terms and conditions of employment effective July 1, 2015 through June 30, 2017; and WHEREAS, the City Council of the City of Orange has consulted with its Chief Negotiator concerning the proposed employment terms contained in the attached Letter of Understanding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that the attached Letter of Understanding is approved and incorporated by reference as Exhibit ADOPTED this 10th day of May, 2016. This Letter of Understanding ( "LOU ") is entered into by and between the City of Orange and the Orange Maintenance and Crafts Employees' Association. Recitals A. The City of Orange (hereafter, "City ") and the Orange Maintenance and Crafts Employees' Association ( "OMCEA ") hereby enter into this LOU effective July 1, 2015. B. The parties agree to incorporate the language addressed in this LOU into a new Memorandum of Understanding ( "New MOU "), once both parties have the opportunity to review and concur on any and all language changes that will become part of the New MOU. A New MOU document will be presented to the City Council at a future meeting for its approval. C. All references to the "MOU" in this LOU shall be to that Memorandum of Understanding by and between the City and OMCEA adopted by City Council Resolution No. 10762. D. This new "LOU" shall supersede the "MOU" (Resolution No. 10762) and was adopted by the City Council on March 25, 2014. Agreement 1. Term and Effective Date. The term of this LOU shall be from July 1, 2015 to June 30, 2017 and will become effective upon ratification by the OMCEA membership and approval of the City Council. 2. Salary (MOU Appendix "A "). Implement an across the board base salary increase of 2 %, effective April 17, 2016. Implement an across the board base salary increase of 2 %, effective June 26, 2016. Monthly Salary Tables effective June 29, 2014, April 17, 2016, and June 26, 2016 are attached as Appendix "A ". Resolution No. 10932 3 3. Medical Insurance (MOU Article XVI, Section IB). Modify Article XVI, Section 1B of the MOU to provide that the City's contribution on behalf of each active employee shall be increased by $50 effective April 1, 2016 and increased by an additional $50 effective January 1, 2017. 4. Vacation Conversion (MOU Article XII, Section 3). Effective July 1, 2015, an employee may convert up to 33% of his/her current annual vacation accrual into cash in lieu of time off with pay during the 2015 -2016 fiscal year. Effective July 1, 2016, an employee may convert up to 33% of his/her current annual vacation accrual into cash in lieu of time off with pay during the 2016 -2017 fiscal year. 5. Education Reimbursement (MOU Article XVII, Section 3). Effective July 1, 2015, the parties agree to add Article XVII, Section 3 as follows: SECTION 3. Professional Development. The City agrees to allow reimbursement to employees of up to $375.00 of the $750.00 allotted per fiscal year for activities that aid in their professional development. Reimbursable activities include the following: 1. Attendance at job - related professional conferences and seminars; 2. Payment of membership dues in community and professional organizations; 3. Purchase of job- related professional journals, books, and other written materials, which further their knowledge and improve their effectiveness in their duties. Participation and /or purchase must be approved in advance by the Department Head and the Human Resources Director. The above modifications are made to recognize and encourage staff to pursue educational and public relations oriented activities beyond those normally budgeted for them by their departments and in which they are directed to participate. Approved activities are those which may be expected to further their knowledge of their jobs and the Orange community and which contribute to their improved effectiveness. Resolution No. 10932 4 Individual departments may continue to budget funds for staff attendance at professional conferences and seminars, for payment of professional membership dues, and for the purchase of books, journals, and related written materials, which enhance the staffs knowledge. 6. Overtime (MOU Article X, Section 1). Amend Article X to include clarification that Fatigue pay and any paid leave hours used during the Christmas/New Year's Holiday Closure shall count as hours worked for purposes of computation of overtime. 7. Safety Shoe Allowance (MOU Article XIX, Section 3). Effective July 1, 2016, the parties agree to amend Article XIX, Section 3 to change the Safety Shoe Allowance from a $450 yearly reimbursement to a $450 yearly stipend. 8. Fatigue Pay Policy. The City shall extend the current public works fatigue pay policy to public works employees within the OMCEA group. 9. Language Clean-up/Other. Implement mutually agreed language clean -up to conform MOU to current practices or agreements. 10. Status of MOU. Except as specifically provided and amended herein, the terms and conditions of the MOU shall govern the provisions of wages, salaries and other benefits for all employees covered by the MOU through June 30, 2017. This LOU shall not be interpreted to extend and /or limit any other rights, benefits, or compensation of either party except as specifically provided herein and both this LOU and MOU shall expire on June 30, 2017.
