A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE FINDING THAT CERTAIN
CITY -OWNED REAL PROPERTY LOCATED ON
OLD CHAPMAN AVENUE IN THE CITY OF
ORANGE IS SURPLUS TO THE CITY'S NEEDS
AND AUTHORIZING THE DISPOSAL OF SAID
PROPERTY.
WHEREAS, the City of Orange (the "City ") is a municipal corporation exercising
governmental functions and powers, organized and existing under the laws of the State of
California; and
WHEREAS, the City owns property, which consists of approximately 8,426 square
feet and commonly known as a part of Old Chapman Ave. (the "Property"); and
WHEREAS, as authorized by California Government Code Section 37350, the City
Council finds and determines that the Property is not needed for the purpose for which it was
acquired or for any other public purpose and is, therefore, surplus real property; and
WHEREAS, in accordance with California Government Code Sections 54220 et seq.,
the City has extended written offers to sell the Property to certain public and private entities
described therein; and prior to disposing of the Property will consider and negotiate any
offers received from such entities for at least the time period required in said Sections 54220
et seq.; and
WHEREAS, pursuant Section 65402 of the California Government Code, the City
Council finds and determines that the location, purpose and extent of the proposed
disposition of the Property, have been considered and reported on by the Director of the
Community Development Department of the City and that said proposed disposition to the
Buyer in accordance with the terms and provisions of the Purchase Agreement conforms to
the City's adopted general plan; and
WHEREAS, this City Council, as the "lead agency" under the California
Environmental Quality Act ( "CEQA "), finds and determines that the sale of the Property is
categorically exempt from the provisions of CEQA under Section 15312 of the State CEQA
Guidelines relating to the sale of surplus government property; and
WHEREAS, the City Council believes that the sale of the Property is to the common
benefit of the City and its residents, and in accord with the public purposes and provisions of
applicable State and local law requirements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
resolves, on the basis of the facts set forth in the agenda report presented to it and any
testimony received at the meeting at which this matter was considered, as follows:
The foregoing recitals are true and correct.
2. The City Council finds and determines that the Property is categorically
exempt from the provisions of CEQA under Section 15312 of the State CEQA Guidelines
and, accordingly, hereby authorizes and directs the City Clerk to file a Notice of Exemption
with the Orange County Clerk.
3. The City Council hereby finds and determines that the Property is not needed
for the purpose for which it was acquired or for any other public purpose and is, therefore,
surplus real property, and directs staff to solicit bids for the sale of the Property, which bids
shall be considered at the time of bid closing by the City Council.

In the City of Orange, County of Orange, State of California, being that portion of Final Decree
Partition of the Rancho Santiago de Santa Ana, entered September 12, 1868 in Book B, Page 410 of
Judgements of the District Court of the 17` Judicial District in and for Los Angeles County,
California, lying within the 60.00 feet wide strip of land described as Parcel 2 of the Resolution No.
4731, recorded March 7, 1978 in Book 12588, Page 307 of Official Records in the office of the
County Recorder of Orange County, described as follows:
Beginning at the northeasterly corner of Lot 1 of Tract No. 14985 as shown on a map filed in Book
730, Pages 49 and 50 of Miscellaneous Maps, in the office of said County Recorder; thence radial to
the centerline of said Parcel 2 South 50 °00'14" East 30.00 feet to said centerline being a non - tangent
curve concave southeasterly having a radius of 200.00 feet; thence along said centerline the
following courses:
1) southwesterly 48.35 feet along said curve through a central angle of 13 0 51'08 ",
2) South 26 °08'38" West 61.77 feet to a curve concave easterly having a radius of 300.00 feet
3) southerly 72.70 feet along said curve through a central angle of 13 °53'02" and
4) South 12 °15'36" West 71.94 feet to the northwesterly line of Parcel Z30 -133 as described in
the Final Order of Condemnation recorded August 9, 1971 in Book 9754, Page 161 of
Official Records, being a non - tangent curve concave southeasterly having a radius of

Thence along said northwesterly line southwesterly 48.56 feet along said curve through a central
angle of 2 °13'33" to the westerly line of said Lot l; thence along said westerly line the following
courses:
1) non - tangent from said curve North 12 °15'36" East 110.12 feet to a curve concave easterly
having a radius of 330.00 feet
2) northerly 79.97 feet along said curve through a central angle of 13 °53'02"
