A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE REPEALING RE50LUTION
NO. 7838 AND REVISING THE POLICE FACILITY
DEVELOPMENT FEE CATEGORIES AND RELATED
FEES.
WHEREAS, the City Council adopted Chapter 3.13 of the Orange Municipal Code to
require that developers contribute their fair share of the costs of the acquisition and constcvction
of new police facilities and certain other improvements and additions to police facilities; and
WHEREAS,the Orange Municipal Code provides that fees may be increased by resolution
adopted by the City Council; and
WHEREAS, the Police Facility Development fees were last updated by the City in 1991;
and
WHEREAS, the City contracted with a consultant to perform an analysis of the fees
necessary to be chazged to new development to provide the police facilities required as a result of
such development and also to perform an analysis of the current categories of new development
that would generate the need for police faciliTy development fees; and
WIIEREAS, the consultant performed this analysis and calculated the fees in compliance
with the requirements of the Mitigation Fee Act (Califomia Govemment Code Section 66000 et
seq.) and recommended revisions to the residential development category; and
WfI REAS, the City Council has considered the information in the consultanYs report
and the CiTy's staffreport and has determined the fees should be adjusted to more equitably allocate
new developmenYs fair shaze of the cost of new police facilities and to cover increased
construction costs and administrative costs.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orange as
follows:
1.The current"Single Family"fee category is recategorized as"Single-Family/Multi-
Family."
2.Resolution No. 7838 is repealed and the Police Facility Development fees,
including administrative fees,for the Single-Family/Multi-Family and Non-Residential categories
are hereby adopted as set forth in Eachibit"A."
3.The Police Facility Development fees shall be automatically adjusted on the first
day of July each year, beginning July 1, 2020, to reflect the percentage of increase or decrease in
the Consumer Price Index for All Urban Consumers(CPI-U)(Los Angeles-Long Beach-Anaheim;
all items,not seasonally adjusted; 1982-1984=100 reference base)for the rimeframe since the most
recent increase. The adjusted fee,if any,shall be rounded to the nearest dollaz for the"per dwelling
uniY' fees and to the neazest one-tenth of a cent for the "per squaze fooY'fees.
