A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING GENERAL PLAN
AMENDMENT NO. 2018-0002 AND MITIGATED
NEGATIVE DECLARATION NO. 1858-18, A
REQUEST TO CHANGE THE GENERAL PLAN
DESIGNATION OF A 41,672 SQUARE FOOT SITE
FROM NEIGHBORHOOD NIIXED USE (NNII7 TO
GENERAL COMMERCIAL (GC) ON A SITE
LOCATED AT 202 SOUTH MAIN STREET.
GENERAL PLAN ANIENDMENT NO. 2018-0002
APPLICANT: CHICK-FIL-A
WEiEREAS, the City Council has authority per Orange Municipal Code (OMC) Sections
17.10.10 and 17.10.20 to approve General Plan Amendments; and
WH REAS, an application for General Plan Amendment No. 2018-0002 was filed by
Chick-fil-A in conjunction with its project application (the Project) in accordance with the
provisions of the OMC; and
WHEREAS, General Plan Amendment No. 2018-0002 was processed in the time and
manner prescribed by state and local law; and
WHEREAS, the Planning Commission conducted a duly advertised public hearing on
January 20, 2020, at which time interested persons had an opportuniTy to testify either in support
of or opposition to the Project, including General Plan Amendment No. 2018-0002 and
recommended the City Council approve General Plan Amendment No. 2018-0002 and certify
and adopt Mitigated Negative Declaration No. 1858-18, which was prepared to analyze potential
environmental impacts of the Project; and
WHEREAS, the CiTy Council conducted a duly advertised public hearing on September
February 11, 2020, at which time interested persons had an opportunity to testify either in
support of or opposition to General Plan Amendment No. 2018-0002.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves General
Plan Amendment No. 2018-0002 based on the following findings:
1. The requested General Plan Amendment to change the current land use designation
for the Project site from Neighborhood Mixed Use (NMIX) to General Commercial
GC) will be consistent with the Land Use designation to the north.
2. The land uses contemplated under the GC Land Use designation aze compatible with
the abutting NMIX district that remain to the south, east, and west of the site, which
accommodate a mix of neighborhood-oriented commercial and residential uses.
3. The proposed Project will be consistent with the intent of the proposed General
Commercial (GC) designation. Further, the proposed drive-through restaurant will be
approximately 4,527 squaze feet on a 41,672 squaze foot site, which equates to a 0.11
Floor Area Ratio. The Project will comply with the proposed GC designation's
maximum Floor Area Ratio limit of 1.0. If the proposed Project and associated
discretionary actions aze approved, the proposed Project will be consistent with the
site's new General Plan land use designation and will comply with the General Plan
policies for General Commercial (GC) designated azeas.
4. Mitigated Negative Declaration No. 1858-18 contains an adequate assessment of the
potential environmental impacts of the proposed Project, including the General Plan
Amendment, and the Project will have less than significant impacts to the
environment,with the implementation of the conditions therein.
