A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE REQUESTING AND CONSENTING TO
CONSOLIDATION OF ELECTION5 AND SUBNIITTING
TO THE CITY VOTERS AT THE NEXT REGULAR
MUNICIPAL ELECTION TO BE HELD ON NOVEMBER
3, 2020, A BALLOT MEASURE RELATING TO THE
APPROVAL OF RESOLUTION NO. 11188 APPROVING
GENERAL PLAN ANI NDMENT NO. 2018-0001 FOR
THE TRAILS AT SANTIAGO CREEK PROJECT.
WHEREAS, on October 22, 2019, the City Council adopted Resolution No. 11188
approving General Plan Amendment No. 2018-0001 for the Trails at Santiago Creek project in
accordance with the provisions of the City of Orange Municipal Code, and authorizing and
directing the Mayor of the City of Orange to execute the same; and
WHEREAS, after resolving issues between the project opponents and the CiTy over the
effectuating language contained in Resolution No. 11188,it was executed by the Mayor of the City
of Orange on November 5, 2019; and
WHEREAS, on December 4, 2019, the Chief Clerk received a Referendum Petition
against Resolution No. 11188, approving General Plan Amendment No. 2018-0001; and
WIIEREAS, pursuant to Election Code Section 9237, a referendum petition must be
signed by at least 10 percent of the registered voters in the City based upon the County Election
Official's last official report of registrations to the Secretary of State; and
WIiEREAS, the Orange County Registrar's last official report of registration to the
Secretary of State for the CiTy of Orange was 70,007 registered voters and ten percent of said
regisffation would require 7,001 valid signatures to qualify the referendum petition; and
WHEREAS, on January 8, 2020, the Orange CounTy Registraz of Voters deternuned that
the Referendum Petition contained 7,005 valid signatures and notified the Chief Clerk as set forth
in E ibit A, attached hereto and incorporated herein by reference; and
WHEREAS, the Chief Clerk has prepazed the Declaration of Sufficiency of Petition for
Referendum; and
WHEREAS, the City Council has determined to submit Resolution No. 11188, which is
subject to the Referendum Petition to the City voters at the regular municipal election to be held
on November 3, 2020.
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as
follows:
1.That pursuant to the requirements of the laws of the State of California relating to general
law cities, that Resolution No. 11188 be placed on the ballot at the Tuesday, November 3, 2020,
regular municipal election.
2. That the CiTy Council as authorized by the California Elections Code, does order
submitted to the voters at the November 3, 2020, election the following question, which shall be
printed on the election ballot in the form set forth as follows:
Shall Resolution No. 11188,approved by the Orange City Council,
to amend the General Plan with respect to the approximately 109.2 YES
acre property located at 6145 E. Santiago Canyon Road, which
currenfly allows for a mixture of sand and gravel
operation/processing, residential, open space, and other uses, to
allow for the Trails at Santiago Creek project, consisting of 128
single-family homes on approxnnately 40.7 acres and designating NO
approximately 68.5 acres for open space, creek restoration, and
public multi-use recreation trails, be adopted?"
3. The full text of Resolution No. 11188 is attached hereto as Exhibit A, incorporated
herein by reference. The full text of Resolution No. 11188 is not required to be printed in the
Sample Ballot and Voters Pamphlet, but shall be made available at the Office of the City
Clerk/Elections Official at no cost to the requestor.
4. The CiTy Council of the CiTy of Orange hereby requests and consents to the
consolidation of this election with other elections which may be held in whole or in part in the
temtory of the City as provided in Elections Code 10400 et seq.
5. The Orange CiTy Clerk shall file a certified copy of this resolution with the Orange
County Registraz of Voters to ensure the requisite timeframes for holding the election as required
by applicable law.
6. The CiTy of Orange requests that the Orange County Registraz of Voters conduct the
election and canvass the returns, and the CiTy consents to reimburse the Registrar of Voters for all
costs incurred by said services.
7. That in all particulars not recited in this resolution, the election shall be held and
conducted as provided by law for holding municipal elections.
8. The CiTy Attorney shall prepaze an impartial analysis of the measure and submit it to
the Orange CiTy Clerk, in accordance with Elections Code Section 9280.
9. Arguments in favor or against the proposed measure are permissible and shall be filed
with the Orange City Clerk in accordance with Elections Code Secrion 9282.

10. The Ciry Council of the City of Orange determined that the filing of rebuttal azguments
in favor or against the proposed measure was not necessary,thereby excluding rebuttal azguments
from the ballot pamphlet.
11. The Orange CiTy Clerk shall establish deadlines for the impartial analysis, azguments
for and against, and rebuttal azgwnents to coincide with the election calendar prepared by the
Orange County Registrar of Voters.
12. Pursuant to Elections Code 9295 et seq., the City Clerk shall make a copy of the
material referred to in Elections Code Sections 9280, 9282, and 9285 available for public
examination inthe City Clerk's office for aperiod often(10) calendaz days immediately following
each filing deadline for submission of those materials.

W IEREAS, General Plan Amendment No. 2018-0001 was processed in the time and
manner prescribed by state and local law; and
WHEREAS,the City Council has certiFied and adopted Envuonmental Impact RepoR No.
1857-18, which was prepazed to analyze the potentially significant environmental impacts of the
proposed Trails at Santiago Creek project]ocated at 6145 East Santiago Canyon Road(hereinafter
referred to as the"ProjecY, including General Plan Amendment No. 2018-0001; and
WI3EREAS,the Planning Commission conducted duly advertised public hearings on July
15,2019,and August 5,2019,at which time interested persons had an opportunity to tesflfy either
in support of or opposition to the Project,including Geneml Plan Amendment No.2018-0001,and
recommended appmval of the Project by a vote of 4-1; and
WfIEREAS, the City Council conducted duly advertised public hearings on September
24, 2019 and October 22, 2019, at which time interested persons had an opportunity to testify
either in support of or opposition to the Project, including General Plan Amendment No. 2018-
0001.
NOW,THEREFORE,BE IT RESOLVED that the City Council of the City of Orange
approves General Plan Amendment No.2018-0001 based on the following:
SECI'ION I:
The existing general plan land use designations are depicted on the map attached hereto as
Exhibit "A" and incorporated herein by reference. The CiTy of Orange General Plan is hereby
amended in order to change the general plan land use designations by amending the land use
designations on the sites depicted on the map attached hereto as E ibit "B" and incorporated
herein by reference.
SECl'ION II:
The pmposed General Plan Amendment would change the current land use designaHons
for the Project site from Low Density Residential (LDR) (approximately 15.4 acres), Resource
Area(RA) (approximately 773 acres), and Open Space (OS) (approximately 16.5 acres) to Low
Density Residential(LDR)(approxunately 40.7 acres),and Open Space(OS)(approximately 68.5
acres). The proposed project entitlements include this General Plan Amendment which govems
over both the East Orange General Plan and Orange Pazk Acres Plan, and the Rezoning to SP,
which incorporates the Trails at Santiago Creek Specific Plan. These entidements create vertically
consistent documents that cover and include the proposed Project. The other subordinate project
enlitlements shall not take effect unless this General Plan Amendment becomes effecfive.
