Staff did not receive any comments from the public. 1.5 CONTINUED OR WITHDRAWN ITEMS: Anna Pehoushek, Assistant Community Development Director asked the Commission to continue this Item 2.2 until June in order to allow the City Council time to review the Capital Improvement Program budget due to various delays that have occurred. 1.6 PLANNING MANAGER REPORTS: None 1.7 ANNOUNCEMENT OF THE APPEAL PROCEDURES 2. CONSENT CALENDAR: 2.1 APPROVAL OF MINUTES: April 6, 2020 A motion was made to approve the April 6, 2020 minutes as written: MOTION: Commissioner Glasgow SECOND: Commissioner Vazquez AYES: Commissioners Glasgow, Willits, Simpson, Vazquez and Martinez NOES: None MOTION CARRIED Planning Commission 2.2 COMMISSION BUSINESS: May 18, 2020 General Plan conformance finding for FY 2020-2021 through 2024-2025 Five -Year Capital Improvement Program. Item 2.2 continued to a date uncertain per Item 1.5 above. 3. NEW HEARINGS: 3.1 Actions related to compliance with Senate Bill 743 and updates to the California Environmental Quality Act (CEQ Statute to address the use of vehicle miles traveled as the metric for evaluation of development prof ect transportation impacts including: 1) General Plan Amendment No. 2020-0001 revising the General Plan Circulation and Mobility Element and Implementation Plan; 2) An Ordinance amending Chapter 17.105 Environmental Review, of the Orange Municipal Code; and 3) An update to the City of Orange Local CEQA Guidelines. Ashley Brodkin provided an overview of the revisions to the General Plan Circulation and Mobility Element and Implementation Plan, the amendment to Chapter 17.10 of the Orange Municipal Code and an update to the City of Orange local CEQA guidelines consistent with the staff report. For the record, Commissioners Glasgow, Willits, Simpson, and Martinez disclosed they met with staff before the meeting. Ms. Brodkin responded to questions from the Commissioner regarding the following: • The screening criteria • Definition of local serving retail and community institutions • How average trips are calculated • How future projects which are mostly infill projects will be screened out • What community institutions fall under the community benefit • How the traffic fee program is impacted • Mitigation measures. • July 1 effective date of new standards Larry Tay, Manager of Transportation, explained VMT is calculated by high-level software and comprehensive modeling. He stated the TSIP Fee update effort is in progress and the goal is to expand the type of projects that can be funded using the fees they collect. One of their objectives is to ensure that the fees that they assess are similar, in unit cost, to the present fees. Chair Simpson stated there were no public comments received on this item and closed the public hearing. Chair Simpson explained this is a compliance action due to state law and commended the staff on their efforts. Vice Chair Glasgow stated this is mandated by Senate Bill 743 and that the threshold is within reason and will work for most projects; many projects will be exempt due to being infill projects. 2 Planning Commission May 18, 2020 Commissioner Vazquez appreciates that they are localizing as much as they can. LOS appears to be what most people are interested in and he is happy that it will remain. RECOMMENDED ACTION: Adopt Planning Commission Resolution No. PC 12-20 entitled: A Resolution of the Planning Commission of the City of Orange recommending that the City Council of the City of Orange approve General Plan Amendment No. 2020-0001 amending the City of Orange General Plan Circulation and Mobility Element and Implementation Plan to establish consistency with the California Environmental Quality Act Statute and City practice. A motion was made to adopt a Resolution of the Planning Commission of the City of Orange recommending that the City Council of the City of Orange approve General Plan Amendment No. 2020-0001 amending the City of Orange General Plan Circulation and Mobility Element and Implementation Plan to establish consistency with the California Environmental Quality Act Statute and City practice. MOTION: Commissioner Willits SECOND: Commissioner Glasgow AYES: Commissioners Glasgow, Willits, Simpson, Vazquez and Martinez NOES: None MOTION CARRIED Adopt Planning Commission Resolution No. PC 14-20 entitled: 3 Planning Commission May 18, 2020 A Resolution of the Planning Commission of the City of Orange recommending that the City Council of the City of Orange approve an update to the City of Orange Local California Environmental Quality Act (CEQA) Guidelines to update the City procedures consistent with the State CEQA Statute and City practice. NOTE: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per CEQA Guidelines Section 15308 (Class 8, Actions by Regulatory Agencies for Protection of the Environment) because it involves updating the General Plan, Orange Municipal Code, and Local CEQA Guidelines to make them consistent with the current provisions and interpretations of CEQA and the State CEQA Guidelines. It does not involve a specific site, development project, or focused geographic area, does not change permitted land use or density and does not otherwise result in a physical change that could cause an impact to the environment. Nothing further is warranted or required to comply with CEQA. No public review is required for an exemption.
