Responses to Comments Introduction In accordance with the California Environmental Quality Act (CEQA) Guidelines Section 15088, the City of Orange, as the lead agency, evaluated and considered the comments received on the Draft IS/MND for The Terrace Apartments Project and has prepared the following responses to the environmental comments received. This Response to Comments document is part of the Final IS/MND for the project in accordance with CEQA Guidelines Section 15132. Comment Letters and Responses The comment letters reproduced in the following pages follow the same organization as used in the List of Authors. THIS PAGE INTENTIONALLY LEFT BLANK &$/75$16 3DJHRI &$/75$16 3DJHRI &$/75$16 3DJHRI THIS PAGE INTENTIONALLY LEFT BLANK 7 State Agencies California Department of Transportation (CALTRANS) Response to CALTRANS-1 A queuing evaluation has been conducted by Linscott, Law, & Greenspan Engineers (LLG) for the five State-controlled study intersections within the study area (i.e., key study intersections No. 1, No. 2, No. 6, No. 15, and No. 17) to determine the minimum required stacking/storage lengths for all off-ramp lanes. The queuing evaluation was conducted based on Existing, Existing Plus Project, Year 2021 Cumulative, and Year 2021 Cumulative Plus Project AM and PM peak-hour traffic volumes. The queues were taken directly from Appendix D (Caltrans Level of Service [LOS] Worksheets) of the Traffic Impact Analysis Report. Table 1, included in Appendix A of this document, presents the AM and PM peak- hour 95th percentile queuing analysis results for the five State-controlled study intersections under Existing Plus Project traffic conditions. Column 1 presents Existing traffic conditions and column two presents Existing Plus Project traffic conditions. Review of Table 1 indicates that adequate storage is provided at the off-ramps for all five State-controlled study intersections under Existing Plus Project traffic conditions. Table 2, included in Appendix A of this document, presents the AM and PM peak- hour 95th percentile queuing analysis results for the five State-controlled study intersections under Year 2021 Cumulative Plus Project traffic conditions. Column 1 presents Year 2021 Cumulative traffic conditions and Column 2 presents Year 2021 Cumulative Plus Project traffic conditions. Review of Table 2 indicates that adequate storage is provided at the off-ramps for all five State-controlled study intersections under Year 2021 Cumulative Plus Project traffic conditions. Response to CALTRANS-2 The Conditions of Approval require the applicant to prepare and submit a Traffic Control Plan for City approval. As requested in this comment, the Traffic Control Plan will identify a 2-mile radius of all closures that affect Caltrans facilities. The Traffic Control Plan will be provided to Caltrans prior to the issuance of grading permits. Implementation of this Condition of Approval is not necessary to reduce any environmental impact. Response to CALTRANS-3 Existing traffic conditions are included in the analysis. Please refer to Table 3 (Project Traffic Generation Forecast), located in Appendix A of this document, which includes the daily, AM peak-hour and PM peak-hour trips for the existing apartments. As shown in the upper portion of Table 3, the existing site generates 2,102 daily trips, 192 AM peak-hour trips (56 inbound; 136 outbound) and 170 PM peak-hour trips (117 inbound; 53 outbound). Response to CALTRANS-4 As shown on the project site plans, requisite bicycle parking is provided in the new subterranean parking structures. The City’s bicycle parking requirement for each building is two racks or 10 bicycles per garage. 8 Response to CALTRANS-5 The project would not alter any bicycle paths or result in any adverse impacts to bicyclists or pedestrians. The request by Caltrans is a regional issue and not a project issue. Lewis Street is designated on the City’s Bikeway Master Plan as a future Class II bikeway; however, there are no off-site improvements or impacts as a result of the project to warrant the project to make such improvements. Response to CALTRANS-6 As described in Section 10, Land Use/Planning, of the Draft IS/MND, the overall project has a pedestrian-oriented design and does not include commercial or industrial elements such as food service facilities, retail stores, delivery areas, loading docks, or outdoor material storage areas. As shown on the site plan, loading and pickup can be accommodated in the new parking lot in front of the clubhouse. Response to CALTRANS-7 As requested in this comment from Caltrans, the City would require a Condition of Approval that the management offices have bus routes available to their tenants at all times. In addition, the City would require that the apartment complex directory map indicate the route to the nearby bus stops. Sincerely, Gabrieleno Band of Mission Indians/Kizh Nation (1844) 390-0787 Office GABRIELENO Page 1 of 1 1 THIS PAGE INTENTIONALLY LEFT BLANK 15 Organizations Gabrieleño Band of Mission Indians—Kizh Nation (GABRIELEÑO) Response to GABRIELEÑO-1 On September 15, 2017, FirstCarbon Solutions (FCS) sent a request for information letter pertaining to a cultural resources assessment being prepared for the project. In response, on September 25, 2017, the Gabrieleño Band of Mission Indians—Kizh Nation requested to discuss the project. The results of this initial discussion indicated no Tribal Cultural Resources were identified as having the potential to be adversely impacted by the project. Additionally, based in part on this discussion, precautionary Mitigation Measure (MM) CUL- 1, MM CUL-2, MM CUL-3, and MM TRIBAL-1 were agreed to and included in the Tribal Cultural Resources and Cultural Resources section of the IS/MND. MM TRIBAL-1 requires compliance with Public Resources Code Section 5097.98 for the designation of most likely descendant. As described in Section 17 of the IS/MND, these mitigation measures provide direction for the proper documentation, recordation, and disposition of previously undiscovered resources should they be found during project construction activities. Accordingly, implementation of MM CUL-1, MM CUL-2, MM CUL-3, and MM TRIBAL-1 would ensure that potential impacts are reduced to a less than significant level. Additionally, in compliance with Assembly Bill 52 (AB 52) and Senate Bill 18 (SB 18), in October 2018, the City of Orange sent out AB 52 notifications letters and did not receive any response. A Notice of Intent (NOI) was circulated for the project on August 8, 2019. On August 12, 2019, in response to the NOI, the Gabrieleño Band of Mission Indians—Kizh Nation requested for consultation regarding any ground disturbance. Further attempts to consult with the Gabrieleño Band of Mission Indians—Kizh Nation were initiated by the City and FCS, on the City’s behalf, via email on August 12, 2019; October 1, 2019; and again on October 10, 2019. Pursuant to AB 52, the lead agency must provide written, formal notification to the tribes that have requested it within 14 days of determining that a project application is complete, or deciding to undertake a project, which complied in October 2018. The tribe must respond to the lead agency within 30 days of receipt of the notification if it wishes to engage in consultation on the project. As of the date of this writing, no further responses have been received from the Gabrieleño Band of Mission Indians—Kizh Nation regarding consultation on the proposed project. Please refer to Appendix B of this document for the aforementioned letter and email communications. Changes in Response to Specific Comments Section 3.17, Tribal Cultural Resources Page 124, Paragraph 2 The following correction has been made with regard to referencing the tribes that have requested to be included on the City’s AB 52 consultation list. To date, two three tribes (Gabrieleño/Tongva Band of Mission Indians–Kizh Nation and Juaneño Band of Mission Indians Acjachemen Nation, San Gabriel Band of Mission Indians, and Torres Martinez Desert Cahuilla Indians) have requested to be included on the City’s AB 52 consultation list, which is a list of potential tribes the City maintains for consultation purposes for mitigating potential impacts to TCRs under CEQA. A letter was sent to each of the tribes on September 14, 2017October 19, 2018, which requested comments and responses from the tribes. To date, one response from the Gabrieleño Band of Mission Indians–Kizh Nation was received regarding the City’s AB 52 consultation FCS’s letter requesting information pertaining to a cultural resource assessment dated on September 25 15, 2017 (See Appendix B.3: Native American Information Request Letter Responses included in Appendix D: Cultural Resources Assessment). Box 393 Covina, CA 91723 RE: Assembly Bill 52 Consultation, Terrace Apartments, 200 City Boulevard West, City of Orange, Orange County, California Dear Chairman Andrew Salas: The City of Orange is preparing an Initial Study-Mitigated Negative Declaration for the proposed Terrace Apartments (project) located at 200 City Boulevard West in Orange, Orange County, California. The proposed project is subject to the California Environmental Quality Act (CEQA) and, therefore, must comply with California Public Resources Code thus must comply with California Public Resources Code § 21080.3.1 (Assembly Bill [AB] 52 of 2014), which requires local governments to conduct meaningful consultation with California Native American tribes that have requested to be notified about projects in the geographic area with which the tribe is traditionally and culturally affiliated. The proposed project involves the redevelopment of 3.3-acres of the existing 16.9-acre multi-family apartment community. The project proposes to construct an additional three multi-family apartment buildings as part of the existing Terrace Apartments. This would add 177,616-square-feet of floor area and a total of 167 apartment units on-site. The existing buildings on-site would remain for a total of 608 dwelling units on the site. There are currently 786 existing parking stalls, the construction of the project will remove and replace 93 stalls, add an additional 329 parking stalls for a total of 1,208 parking stalls. There will be three subterranean parking structures constructed beneath the proposed buildings. The input of the Gabrieleno Band of Mission Indians-Kizh Nation is important to the City of Orange’s planning process. Under AB 52, you have 30 days from receipt of this letter to respond in writing if you wish you consult on the proposed project.
