SUBJECT Resolution No. 11067 - Resolution of the City Council of the City of Orange adopting the Amendments to the 2015 Urban Water Management Plan (UWMP). 2. SUMMARY The City's 2015 UWMP was adopted on June 14, 2016 per the California Water Code (Sections 10610 - 10656). Subsequent review of the UWMP by the California Department of Water Resources (DWR) resulted in the UWMP needing to be amended and re- adopted to facilitate modifications required by DWR. 3. RECOMMENDED ACTION Approve Resolution No. 11067. 4. FISCAL IMPACT None 5. STRATEGIC PLAN GOAL(S) 1. Provide for a safe community: b. GENERAL PLAN IMPLEMENTATION Infrastructure Element Goal 6.0: Ensure water, sewer, and storm drain systems that meet the needs of residents and businesses. Policy 1.1: Provide sufficient levels of water, sewer, and storm drain service throughout the community. Economic Development Element Goal 6.0: Provide sufficient infrastructure to support anticipated economic development and growth. Policy 6.1: Provide public improvements to support commercial, industrial and institutional uses. 7. DISCUSSION and BACKGROUND Water Code Sections 10610 through 10656 of the Urban Water Management Planning Act requires all urban water suppliers providing water to more than 3,000 customers to prepare and adopt an UWMP every five years in the years ending in zero and five. The City Council approved Resolution No. 10936 on June 14, 2016 adopting the 2015 UWMP. The 2015 UWMP was then submitted to the DWR on June 27, 2016 for review. The City of Orange received an advisory letter dated October 23, 2017 from the DWR recommending the amendment of the 2015 UWMP to incorporate the following modifications: • CWC 10632. Provide an outline of specific water supply conditions that are applicable to each stage of the water shortage contingency plan, and address a 50 percent reduction in water supply. • CWC 10632 (a) (5) Provide consumption reduction methods that would be employed by the water supplier to reduce water use during different stages of the water shortage contingency plan. • CWC 10608.52 (a) and (b) SBX 7 -7 Table 413 - Provide the calculations used for determining the indirect recycled water deductions. These recommended revisions have been incorporated in the 2015 UWMP: • Revisions to Section 5.2.3 Table 5 -1 — Provides an outline of specific water supply conditions applicable to each stage of water supply reduction as well as assigning percent reduction in water supply to each stage up to a 50 percent reduction to address CWC 10632. • Revisions to Section 5.5.3 Table 5 -4 — Consumption reduction methods included to address CWC 10632 (a) (5) and provide context for the stages for water supply reduction. • Addition of Section 8.4 — Provides an outline of the steps the City is taking to adopt the Amended UWMP including publicizing a public hearing, holding a public hearing, adopting the UWMP, and submitting the UWMP to the appropriate agencies. • Revisions to SBX 7 -7 Table 4 — Includes calculations to substantiate volume of indirect recycled water reported in SBX7 -7 to address CWC 10608.52 (b) are now included in the report. ITEM 03/13/18 2 • Revisions to Appendix B Table — DWR Standardized Tables 8 -1 and 8 -3 updated. • Addition of Appendix E -1 —Notice of Public Hearing Notice for Amended UWMP. • Addition of Appendix F -1 —Resolution of the Amended UWMP adoption. The City has 180 days from the date of the advisory letter to adopt the amended 2015 UWMP and resubmit to DWR for approval. 8. ATTACHMENTS • Resolution No. 11067 • City of Orange 2015 UWMP • Amendments to 2015 City of Orange UWMP ITEM 03/13/18 3 RESOLUTION NO. 11067 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING THE CITY OF ORANGE 2015 URBAN WATER MANAGEMENT PLAN. WHEREAS, the City of Orange (the "City ") is a municipal corporation which exercises governmental functions and powers and is organized and existing under the laws of the State of California; and WHEREAS, the City is an "urban retail water supplier" under the meaning of that term set forth in Section 10608.12 of the Water Code of the State of California; and WHEREAS, the Urban Water Management Planning Act (commencing with Section 10610 of the Water Code of the State of California; herein referred to as the "Law ") was enacted in 1984 to require every urban water supplier to prepare and adopt an Urban Water Management Plan, the primary objective of which is to plan for the conservation and efficient use of water; and WHEREAS, the City has heretofore prepared and adopted an Urban Water Management Plan pursuant to the Law; and WHEREAS, the Law requires each urban water supplier to review and update its Urban Water Management Plan at least every five (5) years; and WHEREAS, the City has on June 14, 2016, adopted the update to its Urban Water Management Plan in the form of the "City of Orange 2015 Urban Water Management Plan" (the "Plan ") in accordance with the Law, which, among other things, required each urban water supplier to make the proposed Plan available for public inspection and to hold a noticed public hearing thereon; and WHEREAS, the City has received comments back from the California Department of Water Resources (DWR) that require the Plan to be revised and amended, and that such amended Plan will be required to be adopted to become part of the Plan; and WHEREAS, there has been made available in the office of the City Clerk for at least two weeks prior to such public hearing for public inspection and copying, at a cost not to exceed the cost of duplication, the proposed updated Plan; and WHEREAS, pursuant to Section 10642 of the Law, after notice duly published in accordance with the Law, the Agency held a public hearing on this date with respect to the proposed updated Plan.
