CONSENT CALENDAR: 2.1 APPROVAL OF MINUTES FROM THE REGULARLY SCHEDULED MEETING OF OCTOBER 1, 2018. All matters listed under the Consent Calendar are considered to be routine by the Planning Commission and will be enacted by one motion. NEW HEARINGS: 3.1 CONDITIONAL USE PERMIT NO. 3072-18, DESIGN REVIEW NO. 4945-18, AND MINORSITE PLAN REVIEW NO. 0946-18, ENTERPRISE RENT-A-CAR. LOCATION: 745 N. TUSTIN ST. A proposal to establish a rental car agency in the Limited Business (C-1) zoning district. The project includes conversion of an existing historic single family residential building into a rental car office and installation of a vehicle hand wash station in an existing detached storage building. RECOMMENED ACTION: Adopt Planning Commission Resolution No. PC 31-18 entitled a resolution of the Planning Commission Approving Conditional Use Permit No. 3072-18, Design Review No. 4945-18, and Minor Site Plan No. 0946-18 to establish a rental car agency at 745 N. Tustin Street NOTE: The proposed project is also categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15331 (Historical Resource Restoration/Rehabilitation). The proposed modifications to the two existing buildings on the lot comply with the Secretary of the Interior’s Standards for the Treatment of Historic Properties. 3.2 ZONE CHANGE NO. 1291-18 TO CREATE A HISTORIC DISTRICT OVERLAY ZONE FOR THREE EICHLER TRACTS AND ADOPT THE ORANGE EICHLER DESIGN STANDARDS. The City of Orange is proposing to create a historic district overlay zone for three Eichler Tracts (Fairhaven, Fairhills, and Fairmeadow) and to adopt the Orange Eichler Design Standards to preserve the character of the Eichler Historic Districts. Under Orange Municipal Code Chapter 17.17, historic district designation is processed as an overlay zone with protections for historic resources added to the base zoning. Planning Commission Agenda – October 15, 2018 Page 4 of 5 RECOMMENED ACTION: Adopt Planning Commission Resolution No. PC 30-18 entitled: A resolution of the Planning Commission recommending City Council approval of Zone Change No. 1291-18 to create a historic district overlay zone for three Eichler tracts and adoption of the orange Eichler design standards. NOTE: The historic district overlay zone and adoption of the Orange Eichler Design Standards are categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15308 (Class 8 – Actions by Regulatory Agencies for Protection of the Environment) and 15331 (Class 31 – Historical Resource Restoration/Rehabilitation). The overlay zone is established for the protection of historic resources and makes no changes to the land uses permitted by the base zoning. It assures the maintenance and protection of the environment through the preservation of historic resources and appropriate standards for new construction in the historic districts, as required by the Class 8 exemption. The Orange Eichler Design Standards are written such that projects that are found to be in conformance with the Design Standards also will be in conformance with the Secretary of the Interior’s Standards for the Treatment of Historic Properties (SOI Standards). The regulatory process for projects within the historic district overlay zone involves review to ensure conformance with the Orange Eichler Design Standards and the SOI Standards, as required by the Class 31 exemption. Creation of the historic district overlay zone ensures that historic resources will be preserved and protected from changes that may affect the integrity of the historic character, design, materials, and features. No public environmental review is required for a Categorical Exemption. Planning Commission Agenda – October 15, 2018 Page 5 of 5 4. ADJOURNMENT: The next regular Planning Commission Meeting will be held on November 7, 2018 at 7:00 p.m. in the Council Chambers APPEAL PROCEDURES Any final determination by the Planning Commission may be appealed, and such appeal must be filed within 15 calendar days after the Planning Commission action. This appeal shall be made in written form to the Community Development Department, accompanied by an initial appeal deposit of $1,000.00. The City Clerk, upon filing of said appeal, will set petition for public hearing before the City Council at the earliest date. All owners of property located within 300 feet of the project site will be notified by the City Clerk of said hearing. For additional information, please call (714) 744-7220.
