1. SUBJECT
Second Amendment to Agreement with Nieves Landscape, Inc. for landscape maintenance
services for City Facilities and Rights of Way to increase the amount for FY 16 from $227,459.98
to $267,459.98.
2. SUMMARY
This Amendment provides for an increased level of landscape maintenance, repair and trash
removal services in Plaza Park and quadrants.
3. RECOMMENDED ACTION
1. Approve the Second Amendment to Agreement 5778.A with Nieves Landscape, Inc.; and
2. Authorize the Mayor and City Clerk to execute on behalf of the City.
4. FISCAL IMPACT
Funds are available to cover the cost of the Second Amendment as follows:
100.7022.51431.00000 (Landscape Maintenance — City Property) $ 40,000.00

7. DISCUSSION and BACKGROUND
Background
Nieves Landscape Inc., currently provides landscape maintenance services for the City Facilities
and Rights of Way, including Plaza Park. An increase in restaurants in the Plaza area and the
general popularity of the area has resulted in increased activity in and around the Plaza Park,
including daily spilled food, increased generation of litter and over - flowing trash receptacles in
the Park, more wear and tear on turf due to pedestrian traffic, more vehicular intrusion damaging
landscape and amenities, and other general maintenance impacts. This increase in visitation and
activity in Plaza Park has necessitated a change in the frequency and methods for overall park
maintenance.
The original agreement for FY 15 provided an option for a one year extension through FY 16. In
May 2015, the First Amendment to the Agreement with Nieves Landscape, Inc. was executed,
adding $17,000.00 to fund increased maintenance of Plaza Park for the remainder of FY 15,
extending the Agreement for the additional year and including a CPI increase for FY 16. At that
time, funds were not appropriated for FY 16 for the increased Plaza Park landscape maintenance.
Upon adoption of the FY 16 annual budget, additional funds for landscape maintenance in Plaza
Park were appropriated to cover the increased service level.
Discussion
The Second Amendment to the existing agreement with Nieves Landscape Inc. provides for an
increase of $40,000.00 to include the following additional scope of work:
• Daily cleaning and trash removal, including on weekends and holidays is required by the
landscape contractor to address aesthetics and health and sanitation in the Plaza, especially
during the summer months. This amendment continues this level of service for FY 16.
Every year activity is especially heavy in Plaza Park during the holiday season and the popular
Tree Lighting event. When holiday decorations are displayed in Plaza Park each year, they
attract many visitors to the Park to view the decorations and take photos, etc. This activity
covers a 6 week period which includes the Tree Lighting event that draws a large crowd every
year. While we are pleased that Plaza Park is such a popular destination, this increased activity
level results in damage to the Park, including trampled grass which is reduced to dirt and mud.
Additional landscape services are needed to repair the turf on an annual basis.

• Damage to the landscape caused by errant vehicles driving into the Park requires repair and
replacement of irrigation components, turf, plants, benches, light poles and bollards.
This Second Amendment increases the current annual amount for FY 16 from $227,459.98 to
$267,459.98. City staff intends to circulate a Request for Proposals for landscape maintenance of
City Facilities and Rights of Way in spring 2016 for FY 17 and beyond.
