SUBJECT Resolution No. 10897 — A Resolution of the City Council of the City of Orange Establishing a Letter of Understanding between the City of Orange and the City of Orange Police Management Association Effective July 1, 2015 to June 30, 2017. 2. SUMMARY Resolution No. 10897 establishes a Letter of Understanding between the City of Orange and the City of Orange Police Management Association effective July 1, 2015 to June 30, 2017. 3. RECOMMENDATION Approve Resolution No. 10897 and authorize staff to make the necessary budget adjustments and /or appropriations to the departments' salary and benefit accounts to fund the increased costs of the contract. 4. FISCAL IMPACT Costing Summary: Fiscal Year 2015 -16 Cost Description General Fund Cost of Salary Increase $102,206 Cost for Negotiated Benefits $68,374 Total Annual Cost $170,580 Fiscal Year 2016 -17 Cost Description General Fund Cost of Salary Increase $294,192 Cost for Negotiated Benefits $182,387 Total Annual Cost $476,579 ITEM I 1 11/10/15 5. STRATEGIC PLAN GOAL(S) 1. Provide for a safe community. a. Provide staffing and resources to deliver services that ensure public safety. 2. Be a fiscally healthy community. a. Expend fiscal resources responsibly. 6. DISCUSSION and BACKGROUND The City of Orange Police Management Association (Association) is currently comprised of 30 Police Officers and 2 benefited non -sworn personnel. Beginning May 2015, representatives from the City and Association began the collective bargaining process to negotiate the terms and conditions of a new labor agreement. The prior contract between the parties expired on June 30, 2015. After six months of contract negotiations, the parties reached agreement on the terms and conditions of a new two -year labor contract that includes the following provisions: ITEM 2 11/10/15 Provision Description I Term of Agreement Effective July 1, 2015 through June 30, 2017 The MOU shall be amended as follows: Effective November 1, 2015, the salaries of unit employees (sworn) shall effectively increase by 3 %. Effective October 18, 2016, the salaries of unit employees (non- 2 Salary sworn) shall effectively increase by 2 %. Effective August 7, 2016, the salaries of unit employees (sworn) shall effectively increase by 3 %. Effective June 26, 2016, the salaries of unit employees (non -sworn) shall effectively increase by 2 %. Effective January 1, 2016, the City's contribution toward medical insurance benefits per employee shall increase by $50. 3 Medical Insurance Effective January 1, 2017, the City's contribution toward medical insurance benefits per employee shall increase by $50. Effective July 1, 2015, employees may convert up to 33% of their annual vacation accrual into cash during the 2015 -2016 fiscal year. 4 Vacation Conversion Effective July 1, 2016, employees may convert up to 33% of their annual vacation accrual into cash during the 2016 -2017 fiscal year. ITEM 2 11/10/15 5 Sick Leave Payout Effective October 18, 2015, sick leave payout shall be extended to industrial disability retirement on same terms as service retirement. Effective October 18, 2015, increase compensation as follows, for POST Advanced Certificate and a Bachelor's degree from $550 to 6 Educational $600 /month, and for POST Advanced Certificate and a Master's Reimbursement degree in area related to Law Enforcement or Public Management from an accredited university as approved by the City Manager or his /her designee from $650 to $725 /month. The parties agree to amend Article X, Section IA to allow the Chief 7 SWAT Team of Police or designee to assign up to 6 employees (from Lieutenant and Sergeant ranks) to the SWAT Team. The parties agree to revise Article VI to include a new section regarding overtime /compensatory time, if a Lieutenant is assigned Overtime to a task force, special enforcement or event funded by the state, federal government or private entity, and overtime worked under 8 (Compensatory that program or event is paid and reimbursable at a rate of time -and- Time) one -half, the City will pay the Lieutenant at that rate. The time - and- one -half is NOT applicable unless the contract allows for time - and- one -half and the City is reimbursed fully for that cost. 9 Language Implement mutually agreed language clean -up to conform MOU to Cleanup /Other current practices. The Association took this to a vote of their membership and ratified the proposal on October 21, 2015. Council approval is required to finalize this agreement in the form of a Letter of Understanding. 8. ATTACHMENTS • Resolution No. 10897 • Appendix "A" — Salary Table NAEconomic Development Files \STAFF REPORTS\2015 \111015a_Police Mgmt LOU.doc ITEM 3 11/10/15 RESOLUTION NO. 10897 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ORANGE AND THE CITY OF ORANGE POLICE MANAGEMENT ASSOCIATION EFFECTIVE JULY 1, 2015 THROUGH JUNE 30, 2017 WHEREAS, the City of Orange, hereinafter referred to as "City," and the City of Orange Police Management Association have met and conferred in accordance with the requirements of the Meyers - Milias -Brown Act; and WHEREAS, the City and City of Orange Police Management Association have reached agreement on wages, salaries, and other terms and conditions of employment effective July 1, 2015 through June 30, 2017; and WHEREAS, the City Council of the City of Orange has consulted with its Chief Negotiator concerning the proposed employment terms contained in the attached Letter of Understanding; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that the attached Letter of Understanding is approved and incorporated by reference as Exhibit "A."
