1. SUBJECT
An Ordinance of the City Council of the City of Orange amending Title 17 of the Orange
Municipal Code to streamline the review process and clarify definitions and City standards for
duplexes, cottage food operations, auto brokers, senior housing and mixed use development in
strictly commercial zones, multi- family residential development, bars and tattoo parlors in Mixed
Use zones, the entitlement process for alcohol sales at gas stations and residential parking
requirements.
2. SUMMARY
In October 2012, the City Council directed the Community Development Department to undertake
amendments to Title 17 of the Orange Municipal Code (Zoning Ordinance) with the purpose of
streamlining the review of certain types of development applications and uses in order to simplify
and make the public's interaction with the City more streamline, as well as to make more efficient
use of City staff resources. The subject Ordinance represents the fourth phase of Code streamlining
and addresses the duplexes, cottage food operations, auto brokers, senior housing and mixed use
development in strictly commercial zones, multi - family residential development, bars and tattoo
parlors in Mixed Use zones, the entitlement process for alcohol sales at gas stations and residential
parking requirements.
13. RECOMMENDATION
(1) Find the Ordinance categorically exempt from the provisions of the California Environmental
Quality Act (CEQA) per State CEQA Guidelines Section 15305.
(2) Approve First Reading of Ordinance No. 08 -15 amending Title 17 of the Orange Municipal
Code related to the definition of duplexes, cottage food operations, auto brokers, senior
housing and mixed use development in strictly commercial zones, multi - family residential
development, bars and tattoo parlors in Mixed Use zones, the entitlement process for alcohol
sales at gas stations and residential parking requirements.

7. DISCUSSION and BACKGROUND
The subject Ordinance represents the fourth tier of development streamlining opportunities
stemming from the City's 2012 Organizational Assessment. The proposed Ordinance addresses
the review process and clarifies City standards for duplexes, cottage food operations, auto brokers,
senior housing and mixed use development in strictly commercial zones, multi - family residential
development, bars and tattoo parlors in Mixed Use zones, the entitlement process for alcohol sales
at gas stations and residential parking requirements. Specifically, the Ordinance:
• Revises the definition of "Duplex or Duplex Residential" to include two detached dwelling
units on a single parcel in addition to the duplex scenarios contained in the existing
definition.
• Recognizes "Cottage Food Operations" as permitted uses in residential and mixed use
zones in accordance with state legislation.
• Recognizes wholesale and retail "Auto Brokers" as permitted uses in certain Commercial
and Residential zones subject to certain operating parameters.
• Eliminates "Multi- Family Housing in conjunction with a mixed use development" and
"Mixed use development" in Commercial zones in order to encourage and concentrate such
development in the City's established Mixed Use zoning districts.

• Re- establishes development standards for Senior Housing developments in Commercial
zones that were inadvertently removed from the Code at the time the Density Bonus
Ordinance was updated in 2008.
• Provides clarification in the land use table for Mixed Use zoning that `Bars" and "Tattoo
parlors" are not permitted in any of the City's Mixed Use zoning districts.
• Provides clarification of development standards that are cross - referenced for strictly multi-
family development in Mixed Use zones.
• Provides clarification of development standards applicable to single family dwellings in
the Old Towne Mixed Use zones.
• Addresses the existing complexity associated with Residential parking standards by
focusing the required parking on the type of residential unit rather than a property's
underlying zoning designation.
• Eliminates the need for Conditional Use Permit applications for the sale of alcohol at gas
station convenience stores to be reviewed by the City Council.
A detailed discussion of the Code revisions is presented in Attachment 5 to this report.
Planning Commission Review
The Planning Commission conducted a public hearing on the proposed Ordinance on June 1,
2015. One member of the public spoke on the item suggesting that public notification of
Ordinance changes with citywide applicability occur by means beyond both the state and
Municipal Code required newspaper publication to reach a wider segment of the population.
Additionally, correspondence was received from Jon Hobbs requesting that the City provide
greater flexibility in the Code related to smaller -scale senior housing projects on infill sites
(Attachment 6). The Commission recommended City Council approval of the proposed
Ordinance by a vote of 3 -0.

MIXED USE DEVELOPMENT IN COMMERCIAL ZONES,
MULTI - FAMILY DEVELOPMENT, BARS AND TATTOO
PARLORS IN MIXED USE ZONES, THE ENTITLEMENT
PROCESS FOR ALCOHOL SALES AT GAS STATIONS,
AND RESIDENTIAL PARKING REQUIREMENTS
WHEREAS, the City desires to put in place clear policies and procedures that avail the
public of efficient and expeditious review of cottage food operations, auto broker businesses, and
alcohol sales at gas stations in support of entrepreneurism, the business community, and economic
vitality of the City; and
WHEREAS, the City recognizes that senior housing projects may be well suited uses in
commercial districts due to the convenience of goods and services, medical care, and public
transportation to serve the elderly citizens of Orange; and
WHEREAS, the City's 2010 General Plan update effort resulted in the creation of
dedicated mixed use land use districts with the purpose of providing strategic locations in the City
near employment and transportation hubs well- suited for long -term mixed use development
conditions, and desires to protect the economic viability and cohesiveness of its commercial
districts by eliminating the possibility of mixed use development in strictly commercial zones; and
WHEREAS, the City desires to eliminate confusion in the zoning ordinance about
development conditions that constitute a duplex, and parking requirements for residential uses in
order to provide clear information to property owners and a positive customer service experience
to the public; and
WHEREAS, the City desires to clarify limitations on bars and tattoo parlors as land uses
in mixed use zoning districts.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES
HEREBY ORDAIN AS FOLLOWS:
