1. SUBJECT
Ordinance No. 07 -15 approving Zone Change 1277 -15 to rezone properties in the Tustin - Chapman
2010 General Plan Land Use Focus Area to Public Institution (PI) in order to establish consistency
with the Public Facilities and Institutions (PFI) and Yorba North Commercial Overlay General
Plan land use designation in accordance with State law. The subject Zone Change addresses
properties presently developed with medical facilities located north of the intersection of Chapman
Avenue and Yorba Street.
2. SUMMARY
The City of Orange General Plan update was adopted in March 2010. The Tustin - Chapman 2010
General Plan Land Use Focus Area generally includes properties along Tustin Street, Chapman
Avenue, La Veta Avenue, and the Santiago Creek corridor. Due to the geographic configuration
of the Focus Area, establishment of General Plan- Zoning consistency is being broken down into
smaller areas. The subject of Zone Change 1277 -15 are the parcels located north of the intersection
of Chapman Avenue and Yorba Street that have a General Plan designation of PFI. The General
Plan's Yorba North Commercial Overlay is also in place for these parcels. The affected properties
are presently zoned Limited Business (C 1) and Open Space (OS). The properties are presently
developed with a hospital, medical office buildings, and office building related parking.
State law requires consistency to be established between the General Plan land use designation
and zoning classifications. Zone Change No. 1277 -15 establishes General Plan and Zoning
consistency for the affected properties.
13. RECOMMENDATION _J
(1) Find that the proposed zoning change is within the scope of the previously- approved 2010
General Plan, which was evaluated in certified Program EIR No. 1815 -09; and find that the

Program EIR adequately describes the zoning changes for purposes of CEQA and no new
environmental documents are required.
(2) Approve First Reading of Ordinance No. 07 -15 approving Zone Change No. 1277 -15 rezoning
properties in the portion of the Tustin - Chapman 2010 General Plan Land Use Focus Area north
of the intersection of Chapman Avenue and Tustin Street to Public Facilities and Institutions
to establish consistency with the Public Institutions and Yorba North Commercial Overlay
General Plan Land Use Designations and Zoning classification in accordance with State law.

Implementation Program
Implementation Program I -1 of the General Plan Implementation Plan calls for consistency
between General Plan and zoning designations to be established.
7. DISCUSSION and BACKGROUND
The City's 2010 General Plan was adopted on March 9, 2010. The 2010 General Plan Land Use
Element included re- designation of certain properties in the Tustin - Chapman 2010 General Plan
Land Use Focus Area. A map depicting the General Plan changes that occurred in the area is
provided as Attachment 5 to this report.

The Tustin - Chapman Focus Area properties north of the intersection of Chapman Avenue and
Yorba Street were re- designated from General Commercial (GC) PI with the Yorba North
Commercial Overlay in the General Plan Update and have inconsistent commercial zoning
classifications. One parcel developed with a medical office building also has split commercial and
open space zoning, with the parking area of the building located on the open space -zoned portion
of the property
In accordance with State planning law (Government Code §65860), the City must establish
consistency between the General Plan and its zoning. Furthermore, Implementation Program I -1
of the General Plan Implementation Plan calls for consistency between General Plan and zoning
designations to be established.
The proposed re- zoning of properties in the area affected by the Zone Change reflects long-
standing on- the - ground conditions. Chapman Hospital and the surrounding medical office uses
are anticipated to remain. The PI and Yorba North Commercial Overlay General Plan
designations were put in place by the City Council to encourage these medical uses to remain in
place as resources that support the citizens of Orange. The commercial overlay is intended to offer
flexibility in the long -term use of the property to allow for the integration of commercial uses that
complement the medical uses that are concentrated in this location.
The proposed Zone Change establishes PI zoning on all involved properties, not only reconciling
the General Plan and Zoning designations, but also on- the - ground uses with these designations.
The Zone Change will not cause existing development to become legal non - conforming due to the
compatibility between existing uses and proposed zoning.
Public Notice
A City Council public hearing notice was published in the Orange City News on July 1, 2015. In
addition, 1,244 notices were mailed to the owners of affected properties and properties within a
300 foot radius of the perimeter of the subject parcels being rezoned. Hearing notices were also
posted at City Hall, City Library, and City Fire Department posting locations.
Planning Commission Hearing
On April 20, 2015, the Planning Commission conducted a public hearing for the proposed zone
change. The Commission adopted Resolution No. PC 13 -15, recommending approval to the City
Council by a vote of 3 -0. Two members of the public spoke on the item. One sought confirmation
that the Zone Change did not involve the open space designated parcels along Santiago Creek, and
expressed concerns about incremental loss of open space along the creek corridor. The other
expressed support for the proposed Zone Change. The Planning Commission Resolution and Staff
Report are provided as Attachments 2 and 4, respectively.

ZONE CHANGE NO. 1277 -15
APPLICANT: CITY OF ORANGE
WHEREAS, on March 9, 2010 the City adopted its 2010 General Plan, including
a Land Use Element and associated Land Use Policy Map that re- designated land uses in
the portion of the Tustin - Chapman Land Use Focus Area to Public Institutions (PI) and
Yorba North Commercial Overlay; and
WHEREAS, the properties subject to Zone Change No. 1277 -15 have been zoned
Limited Business (C 1) and split zoned Cl and Open Space, neither of which are
consistent with their General Plan land use designation; and
WHEREAS, California Government Code §65860 requires consistency between a
city's general plan and zoning; and
WHEREAS, the Planning Commission, having considered the proposed
Ordinance and Zone Change at a public hearing held on April 20, 2015, including review
of the staff report and having received public testimony on the item, has determined the
proposed amendment is justified and recommends approval thereof.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
recommends the City Council approve the subject Ordinance and Zone Change, as
