SUBJECT Special Event Permit request from the Assistance League of Orange, California, Inc to host the 9 Annual Taste of Orange, on Sunday, May 3, 2015. 2. SUMMARY Consider approval of a request from the Orange Blossoms, an Auxiliary of Assistance League of Orange, California, Inc., to hold their annual "Taste of Orange" event; and to authorize the sale and permit the purchase, possession, and consumption of alcoholic beverages on a portion of the South Orange Street public parking lot during this event. 3. RECOMMENDATION 1. Approve the Special Event Permit with Assistance League of Orange, California, Inc., to hold their Annual "Taste of Orange" on Sunday May 3, 2015; and 2. Authorize the sale and permit the purchase, possession, and consumption of alcoholic beverages at the annual "Taste of Orange" event, on a portion of the South Orange Street public parking lot pursuant to the requirements of Section 5.72.080 of the OMC; and 3. Approve wavier of $208 parking lot usage fee for this event. 4. FISCAL IMPACT The applicant is responsible for all costs associated with the safe closure of the parking lot; therefore, there will be no fiscal impact to the General Fund. 5. STRATEGIC PLAN GOAL(S) Goal 5: Recognize, promote, and preserve Orange's rich heritage. GENERAL PLAN IMPLEMENTATION Land Use Goal 5.0 — Maintain and enhance the vibrant, pedestrian - friendly, and livable character of Old Towne's neighborhoods and commercial core. 7. DISCUSSION The Orange Blossoms (Assistance League) are planning their annual "Taste of Orange," to be held on Sunday, May 3, 2015, from 3:00 p.m. to 7:00 p.m. at the Assistance League Chapter House located at 124 South Orange Street in Old Towne Orange. This is their ninth annual event. Prior to 2010 the entire event was held within their Charter House footprint which was approved at a staff level. With the success of their "Taste of Orange" event, the Orange Blossoms began to utilize a portion of the City's South Orange Street parking lot in 2010, which required Council approval. The initial request was for use of the parking lot for overflow purposes and only utilized the row of parking spaces closest to their Charter House, with no alcohol permitted in this area. Again the success of the event prompted the Assistance League in 2011 to request a larger portion of the lot for food and the consumption of alcohol. In 2012 the Assistance League requested a significant portion of the lot which now closes approximately 100 public parking spaces in the South Orange Street lot and on Orange Street, from 8:00 am to 10:00 p.m. Since the expansion of the event into the parking lot, staff has not received any formal complaints from merchants. Staff believes strongly that this is due in part to the event being held on a Sunday when the Plaza parking lots are more available. Staff recommends approval of alcohol usage, waiver of the $208 daily fee and the Special Event Permit. Since the request for usage of the parking lot is by an Orange based non - profit, staff is recommending waiver of the costs associated with the use of this lot. The Special Events committee has worked with the event organizer to go over the event footprint, the safe closure of the portion of the public parking lot, exits, event security, parking plans, notification of area residents and businesses, and other event details. A condition placed by the Orange Police Department, as in the past, is that since the "Taste of Orange" event permits alcoholic beverages and has an anticipated attendance of over 500 attendees, they are required to have two officers on -site during the event. The applicant will submit a bond to cover the anticipated cost of police officers and other costs associated with this event. The Assistance League will be responsible for all costs associated with the production of the event. Special Event Permits are typically handled by the Community Development Department on an administrative basis. However, this request must be brought to Council for approval due to the use of the parking lot, special alcohol requirements and fee waiver. Orange Municipal Code (OMC 5.72.080) requires the approval of the City Council when alcoholic beverages are consumed in public facilities and public places. 8.
