1. SUBJECT
Resolution No. 10845— A Resolution of the City Council of the City of Orange approving Lot Line
Adjustment No. LL- 2014 -04 to adjust the property lines among three (3) real properties situated at
1148 N. Lemon St to create three (3) new lots.
2. SUMMARY
Max L. Hoskins, owner of all three parcels, has requested approval of Lot Line Adjustment No.
LL- 2014 -04 to adjust the property lines of two properties located at 1148 N. Lemon Street and a
former railroad strip behind this address. The new lot configuration will consist of three lots,
where middle section of the railroad strip will be combined with the two parcels at the above
address and two segments of the railroad strip will remain as separate lots. The follow list of
Assessor's Parcel Numbers describes these three properties: 375 - 281 -01, 375- 281 -02, 375 -281-
08, 375- 271 -01, and 275- 271 -14.

Approve Resolution No. 10845.

7. DISCUSSION and BACKGROUND
The State Subdivision Map Act permits a lot line adjustment between four or fewer adjoining
parcels, where land taken from one parcel is added to an adjoining parcel, and where a greater
number of parcels than originally existed is not thereby created. The lot line adjustment must be
approved by the local agency.
Max L. Hoskins of Hoskins Equipment acquired a 40 feet wide strip of land from Union Pacific
Railroad Company in 2006. This strip of land is located on the east side of the existing railroad
easement stretching from Katella Avenue at the north end to Collins Avenue at the south end.
This former railroad strip consists of a total of 4 lots. A previous request by Mr. Hoskins to
adjust the lot lines among these 4 lots was made in 2011. The request was denied by SRC for the
reason that the former railroad strip did not have any General Plan designation and had no
assigned Zoning. Since that time, the City has amended the General Plan and the strip of land
now has General Plan and Zoning designations.
Mr. Hoskins subsequently resubmitted the Lot Line Adjustment application in February 2014
and only requested lot line adjustment on the middle two lots. That lot line adjustment, LL-
2011-03 was approved in June 2014 by Resolution 10808.
Mr. Hoskins is now filing a new lot line adjustment to develop a property located at 1148 N.
Lemon Street known as Lemon Grove Apartments. This address currently has two separate
parcels. In addition, a 40 feet wide former railroad strip is located behind this address to the
west. This former railroad parcel is the northern most parcel of the four railroad parcels
purchased by Mr. Hoskins and it is the parcel immediately to the north of Lot Line Adjustment
LL- 2011 -03. Mr. Hoskins intends to split this railroad strip into 3 segments, where the middle
segment of the strip will be combined with the two parcels on 1148 N. Lemon Street to create
one lot for the new development. The northern segment will also be a part of the Lemon Grove
Apartment project. The southern segment will remain unused and land - locked. His plan is to sell
this southern segment to the adjacent property owner later.
The proposed lot line adjustment is graphically depicted on Exhibit `B" in the attached
Resolution No. 10845.
All of the Subdivision Map Act requirements for this lot line adjustment have been satisfied. All
zoning and planning requirements are also met.

RESOLUTION NO. 10845
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE APPROVING LOT LINE ADJUSTMENT NO.
LL- 2014 -04 TO CONFIGURE THREE NEW LOTS BY
ADJUSTING THREE PROPERTIES LOCATED AT 1148 N.
LEMON STREET, IN THE CITY OF ORANGE, COUNTY
OF ORANGE, STATE OF CALIFORNIA.
WHEREAS, Section 66412 (d) of the Subdivision Map Act makes provisions for
the Council to approve lot line adjustments by resolution where the land taken from one
parcel is added to an adjacent parcel and where a greater number of parcels than originally
existed is not thereby created; and
WHEREAS, the City Council has enacted Orange Municipal Code Sections
16.32.010 et seq., which provide the procedure to be followed for the approval of said lot
line adjustment; and
WHEREAS, the Subdivision Section of the Department of Public Works and the
Staff Review Committee have reviewed and recommended approval of Lot Line
Adjustment No. LL 2014 -04, attached hereto, and have made a finding that Parcels A, the
real property located at 1148 N. Lemon Street, and parcels B and C, the real properties
situated adjacent to the railroad, behind Parcel A, in the City of Orange, described in
Exhibit "A" of Lot Line Adjustment No. LL 2014 -04 and graphically depicted on the map
in Exhibit "B" of Lot Line Adjustment No. LL 2014 -04 complies with the provisions of
the California Subdivision Map Act and all applicable City of Orange ordinances and
regulations, including the requirements for building sites; and
WHEREAS, the Subdivision Section of the Department of Public Works and the
Staff Review Committee have also examined the Site Map attached as Exhibit "C" of Lot
Line Adjustment LL 2014 -04 for the conformance to the City general plan, specific plan,
zoning ordinance, and building ordinance.
WHEREAS, the Subdivision Section of the Public Works Department and the
Staff Review Committee have made the following findings:
1. That the proposal is eligible for processing as a lot line
adjustment pursuant to Section 66412 of the Subdivision Map
Act;
2. That the requirements of the California Environmental Quality
Act have been met;
3. That the proposal is consistent with the General Plan; and
4. That the resultant parcels will meet the requirements of the
Zoning Code.
