SUBJECT Bid No. 145 -33; SP- 3906; FY 2014 -15 Community Development Block Grant (CDBG) Project — Americans with Disabilities Act (ADA) Wheelchair Access Ramps at Various Locations, rejection of all bids. 2. SUMMARY Bids for ADA Wheelchair Access Ramps at Various Locations, Fiscal Year 2014 -15 were received and opened on February 26, 2015. Nine (9) bidders responded to the Notice Inviting Bids. The lowest bidder deemed non responsive. The other bids received were higher than the available project funding. Staff recommends rejection of all bids and seeks the authorization to re- advertise the project with a reduced scope of work. 13. RECOMMENDED ACTION 1. Reject all bids received. 2. Authorize staff to re- advertise this project with a reduced scope of work. 14. FISCAL IMPACT Funds are budgeted and available in the Capital Improvement Program in the following account: 310.9645.56330.11328 (CDBG — ADA Improvements) $ 96,482 15. STRATEGIC PLAN GOAL(S) lb. GENERAL PLAN IMPLEMENTATION Infrastructure Element Goal 3.0 Ensure adequate maintenance of public rights -of -way to enhance public safety and improve circulation. Policy 3.1: Continue to maintain and repair sidewalks and pavement surfaces on public rights - of -way. 7. DISCUSSION and BACKGROUND The City Council previously approved advertisement for bids in its February 10, 2015 meeting. The bid solicitation was advertised on February 11, 2015 for a period of two (2) weeks, and bids were opened on February 26, 2015. Nine (9) bidders submitted proposals as follows: 1) Smart Tech Group, Inc. $ 77,200 2) Carvajal Trucking & Tractor, Inc. $101,400 3) Vido Samarzich, Inc. $103,800 4) EBS Engineering, Inc. $107,000 5) El Camino Construction & Engineering $111,150 6) Unique Performance Construction, Inc. $123,080 7) ND Construction Company, Inc. $129,087 8) Kalban, Inc. $169,800 Upon review of bids received, staff determined that Smart Tech Group, Inc. was not responsive to and did not conform in all material respects to the specifications contained in the City's invitation to bid. With the second low bid received at $101,400 and the necessity to include 15% for contingency and construction management, the total project cost would be approximately $116,610, exceeding the total available funding. Staff is recommending rejection of all bids and requesting authorization to re- advertise the project with a reduced scope of work. This project will provide for construction of approximately fourteen (14) ADA wheelchair access ramps at various locations, City wide. As part of this project, detectable warning surfaces (truncated domes) will be installed per the American with Disabilities Act Accessibility Guidelines (ADAAG) requirements. The City receives CDBG funding from the U.S. Department of Housing and Urban Development for activities that primarily benefit Low and Moderate Income residents. Construction of ADA compliant access ramps City -wide qualifies for CDBG funding because the ramps benefit disabled residents that are considered to be Low Income. 8.
