SUBJECT Contract between the Successor Agency to the Orange Redevelopment Agency and Nieves Landscape, Inc., for annual landscape maintenance services for Successor Agency properties. 2. SUMMARY Assembly Bill 1484, specifically under Health and Safety Code Section 34171 (d)(1)(F) authorizes a successor agency to enter into contracts necessary for maintaining assets prior to disposition. This Contract provides for Nieves Landscape, Inc. (Nieves) to perform annual landscape maintenance services at Successor Agency -owned properties. 3. RECOMMENDATION 1) Approve the Contract between the Successor Agency and Nieves for landscape maintenance services at Successor Agency properties in an amount not to exceed $8,000.00; and, 2) Authorize the Chairperson and Successor Agency Clerk to execute the Contract on behalf of the Successor Agency. 4. FISCAL IMPACT An amount sufficient to fund this agreement is available in Account 940.9810.51450.00000. The Successor Agency will be seeking funding for this Contract in ROPS 15 -16A, which covers the period from July 1, 2015 through December 31, 2015; and is subject to approval by the Successor Agency, Oversight Board, and State Department of Finance (DOF). 5. GENERAL PLAN IMPLEMENTATION Economic Development Element Goal 5.0 Improve economic viability of business districts through aesthetic enhancement, reconstruction, rehabilitation, and elimination of physical deterioration. Policy 5.1: Eliminate and prevent physical deterioration and economic obsolescence by implementing the Orange Merged and Amended Redevelopment Plan. 7. DISCUSSION and BACKGROUND Background Assembly Bill 1484, specifically under Health and Safety Code Section 34171 (d)(1)(F) authorizes a successor agency to enter into contracts necessary for maintaining assets prior to disposition. These contracts are subject to the approval of the Oversight Board of the Successor Agency to the Orange Redevelopment Agency and the California Department of Finance (DOF). DOF is also in the midst of reviewing the Successor Agency's Long -Range Property Management Plan ( LRPMP) detailing disposition of Successor Agency properties. If and when the LRPMP is approved by DOF, the contract for landscape maintenance services will cease upon transfer of those approved Successor Agency properties to be dedicated for governmental purposes to the City. Discussion The proposed Contract with Nieves Landscape, Inc. (Nieves) provides for landscape maintenance work at Successor Agency properties in the amount not to exceed $8,000. The scope of work includes: weed control; turf, shrub, vine and ground cover care; pest control; irrigation systems care; and graffiti reporting on the following Successor Agency properties: • North Olive Parking Lot • North Orange Parking Lot • South Orange Parking Lot • 174 South Orange Street • Vacant parcel at W. Chapman Avenue and the 5 freeway Action by the Successor Agency is requested to allow inclusion of this contract in the proposed ROPS 15 -16A and ROPS 15 -16B to ensure that sufficient Redevelopment Property Tax Trust Funds would be available for the Nieves Contract in FY 15 -16. It is recommended that the Successor Agency approve the proposed Contract between the Successor Agency and Nieves for an amount not to exceed $8,000.00 for a period covering July 1, 2015 through June 30, 2016. Due to the Nieves's existing contract with the City of Orange exceeding the $30,000 threshold for Executive Director approval, authorization by the Successor Agency Board is requested. This Contract is also subject to approval by the Oversight Board and DOF. SAORA ITEM 2 2/10/15 7.
