Chapman Avenue, Orange, California. 4:30 P.M. SESSION 1. OPENING 1.1 INVOCATION Given by Pastor Phillip Sipes, St. John's Lutheran Church 1.2 PLEDGE OF ALLEGIANCE TO THE FLAG Led by Mayor pro tem Alvarez 1.3 ROLL CALL PRESENT - Alvarez, Mayor Murphy, Coontz, Cavecche ABSENT - Slater 1.4 PRESENTATIONS/ ANNOUNCEMENTS/ INTRODUCTIONS - None. 2. PUBLIC COMMENTS - None. 3. CONSENT CALENDAR All items on the Consent Calendar are considered routine and are enacted by one motion approving the recommended action listed on the Agenda. Any member of the City Council, staff or the public may request an item be removed from the Consent Calendar for discussion or separate action. Unless otherwise specified in the request to remove an item from the Consent Calendar, all items removed shall be considered immediately following action on the remaining items on the Consent Calendar. 3.1 Declaration of City Clerk, Cassandra J. Cathcart, declaring posting of City Council agenda of an Adjourned Regular Meeting of December 18, 2001 at Orange Civic Center, Main Library at 101 N. Center Street, Police facility at 1107 North Batavia, the Eisenhower Park Bulletin Board, and summarized on Time-Warner Communications, all of said locations being in the City of Orange and freely accessible to members of the public at least 72 hours before commencement of said Adjourned Regular Meeting. ADMINISTRATIVE REPORTS - None. 8. REPORTS FROM CITY MANAGER - None. 9. LEGAL AFFAIRS - None. 10. PUBLIC HEARINGS 10.1 EXTENSION OF INTERIM URGENCY ORDINANCE NO. 19-01. The public hearing to consider adoption of Ordinance No. 23-01 extending Ordinance No. 19-01 an Interim Urgency Ordinance prohibiting building of secondary units in the 300-400 blocks of South Grand Street between Palmyra Avenue and La Veta Avenue for a period of 10 months and 15 days was continued to this date and time from December 11, 2001. The Director of Community Development reported Ordinance 19-01 is an Interim Ordinance for a building moratorium, adopted November 13, 2001, and is only valid until December 28th Ordinance 23-01 would extend the moratorium for 10 months and 15 days. During this time, staff will address the issues that created the original Interim Ordinance, including a study of the Floor Area Ratio (FAR) in this area, development standards, garage and parking demands and historic standards. This report will be brought back within three to four months, first to the Planning Commission and then the City Council. MAYOR MURPHY OPENED THE PUBLIC HEARING Those speaking in opposition to the extension of the Urgency Ordinance: . Corrine Schreck, 446 N. James, stated there is already an abundance of rules and regulations in Old Towne, there have only been I3 second units built in this area in the last 50 years, the number of homeowners that want to keep the R-2 zoning actually outnumber those that want to down zone, this area has already been studied many times over the years at a great cost to the taxpayers, and suggested that a vote be taken of every homeowner in this area before a decision is made. PAGE 2 CITY COUNCIL MINUTES December 18, 2001 10. PUBLIC HEARINGS (Continued) . Ken Millbrat, 308 S. California, stated there is no density problem in this area and agreed there should be a vote of all property owners. . Grace Hills, 214 N. Pine, was concerned about the housing shortage in the downtown area, not wanting to limit growth in this area and that the R-2 zoning should remain as that is how these properties were purchased years ago. Those speaking in favor of the extension of the Urgency Ordinance: . Joan Crawford, 394 S. Orange, stated this extension would give staff the opportunity to study all options for this area and make an appropriate recommendation and create a reasonable deadline so the issue can finally be resolved. . Janet Crenshaw, 464 N. Shaffer, representing the Old Towne Preservation Association Board, spoke in support of the moratorium until a complete study can be done. MAYOR MURPHY CLOSED THE PUBLIC HEARING Councilmember Coontz stated she still has concerns on a change of zoning but is glad the City is finally concentrating on the Floor Area Ratio (FAR) which creates bulk and mass issues. This has been a concern for a long time, as FAR was included as part of the zoning requirements in the past, but it is too heavy for the historic structures in Old Towne and should be looked at separately. Councilmember Cavecche agreed the FAR study is very important. Mayor pro tem Alvarez spoke in support of continuing the building moratorium and developing specific measurements so that homebuyers have appropriate information when buying homes in this area. Mayor Murphy stated he was not comfortable extending this moratorium for another 10 months. No additional projects have come up recently and it is not fair to place restrictions in this area for another year and have this two block area wait while an analysis is being done. He stated he might support a restriction for three to four months only. The Director of Community Development summarized a tentative time line for this study, noting it depends on the type and amount of public input received and if the Planning Commission requires additional study after its first hearing. The most optimistic time frame is to return to the City Council at the second meeting in April. Councilmember Coontz agreed that if the study can be complete by April, that would make sense; and suggested the process be made easier in the future for homeowners to find out what the rules and regulations are. The Council agreed that since a 4/5 vote is required for an Urgency Ordinance, a compromise is necessary for this action, and an April deadline would be reasonable. PUBLIC HEARINGS (Continued) The City Attorney noted that if a homeowner has already received a building permit, work can proceed regardless of this moratorium. ORDINANCE NO. 23-01 An Urgency Measure of the City Council of the City of Orange extending the Interim Ordinance prohibiting the building of secondary units in the 300 and 400 blocks of South Grand Street between Palmyra A venue and La V eta Avenue. MOTION - Alvarez SECOND - Coontz AYES - Alvarez, Mayor Murphy, Coontz, Cavecche ABSENT - Slater Moved that Ordinance No. 23-01 was read by title only and same was passed and adopted by the preceding vote, with the provision that it be extended only until April 23, 2002. 11.
