WHAT IS A REPORTABLE STOP?
• Any DETENTION of a person by a peace officer
• Any peace officer interaction with a person in which the officer
conducts a SEARCH. For purpose of RIPA, this includes a pat-
down search of a person’s outer clothing and consensual
search.
•“Search” unless otherwise provided, means a search of a
person’s body or property in the person’s possession or
control.

Scenario #1:
Do officers have to submit a RIPA if they conduct a probation or
parole compliance search of an individual in their residence?

Scenario #1 Answer: No
Interactions that take place with a person in their residence who is the
subject of an arrest warrant, search warrant or search condition are
not subject to the reporting requirements. A peace officer shall also
report any interactions with persons in the residence who are not the
subject of the warrant or search condition, if the officer takes any of
the following actions: handcuffs or flex cuffs the person; arrests the
person; points a firearm, electronic control device, or impact projectile
weapon at the person; discharges or uses a firearm, electronic control
device, impact projectile, baton or other impact weapon, or chemical
spray on the person; or if a canine bit/held the person.

Scenario #2:
Officer Tom detains someone on Main and Chapman, who he knows is on parole, and searches the subject,
who has search and seizure terms. Does Officer Tom need to submit a RIPA?

A peace officer shall, report any interaction with a person who is the subject of an arrest or search
warrant or search condition that takes place anywhere other than the person’s residence.

Scenario #3:
Officer Tom is conducting routine patrol and sees somebody he knows by first/last name and DOB(NOT on
parole or probation and does NOT have a warrant) and detains him or even does a consensual encounter
that leads to a search. Does Officer Tom need to submit a RIPA?

Scenario #3 Answer: Yes
In this scenario, although the officer knows the subject, per DOJ, detaining or searching the subject
would require the officer to complete a RIPA. If an officer approaches a subject, has a consensual
encounter with a subject, and there is no detention or search, then a RIPA would not be required for
this encounter.

Scenario #4:
Officer Smith and Officer Brown responded to 1107 Mountain Way regarding a domestic disturbance
between a male and female. Upon arrival, Officer Smith entered the residence and conducted a pat -down
search of the male and female. Does Officer Smith need to complete a RIPA?
