NYPD (Queens) officers ambushed/shot on November 24,
2020, at 12:45 p.m
Dallas Police officers ambushed/shot on February 19, 2021
at 1100 a.m.
Sacramento officer shot and killed June 19, 2019 at 500
p.m.
Escondido officer shot on February 22, 2021 at 300 a.m.
Indianapolis officer killed on April 9, 2020 at 300 p.m.
McAllen (Texas) officers shot and killed on July 11, 2020.
Montgomery (Alabama) officer shot by ex-boyfriend on July
8, 2020 at 215 a.m.
Stats
2019-Orange Police had 301 Domestic Violence calls and
13 involved firearms.
April 2020-Orange County Sheriff reported 25% increase in
DV calls and a similar increase in family dispute/custody.
April 2020-LAPD experienced a 16% increase and LA
County has had an increase in every month in 2020.
8.1% increase for domestic violence related to pandemic.
Penal Code §13700
•Domestic Violence means abuse
committed against a past or present
spouses, cohabitants, dating or
engagement relationships, or those
who have a child in common.
•Same sex and relationships with
emancipated minors are covered. Note
that the parent-child relationship is
NOT covered.
Break it down

investigation
•Identify dominant

The Report/Investigation
•Document ALL domestic violence in a report.
•Interview the involved parties and available
witnesses, including children. Get in the habit of
tape recording victim’s and suspect’s statements.
•Obtain tape recording the 911 calls.
•Photograph injuries,non injuries,and other
pertinent evidence.
•Identify the Dominant Aggressor.
•If there is probable cause, MAKE AN ARREST
•Obtain authorization for the release of medical
records from the victim [OPD-V8].
•Provide the victim with the Resource Information
brochure in compliance with Penal Code §13701.
•Complete the Right to Privacy and Request for
Confidentially
Penal Code §13730
•Reports shall be taken on ALL
domestic violence related incidents and
the reports shall include:
Signs abuser was under the influence of
alcohol or a controlled substance.
Prior domestic violence calls for service or
reports involving the same alleged abuser or
victim.
Whether a firearm or deadly weapon was
used and/or is present at the location.
Documenting Injuries
•The presence or absence of
injuries, and accompanying
explanation can provide
valuable evidence.
•Don’t ignore old injuries they
can provide a history or
pattern of abuse.
•Take follow up photographs
2-3 days after the initial
injury. There may be more
pronounced bruising visible.
•Review photographs before
leaving to ensure clearness.

•Law enforcement agency policies
SHALL require the arrest of
domestic violence offenders.
•Policies also REQUIRE the arrest
of an offender for violation of
protective orders.
•Policies discourage dual arrests.

•Most significant, rather than the first
•Consider the intent of law to protect
victims of domestic violence from
continued abuse.
•Threats of abuse and history of
domestic violence.
•Self defense.

•Other factors:
The size of the parties involved
Any training or advantage, such as martial arts or
boxing.
Use of weapons by either party.
Existence of corroborating evidence or witnesses.
Location, severity and type of injuries, offensive vs.
defensive.
Consider emotional state, angry, argumentative,
combative, uncooperative vs. cooperative, crying,
upset, fearful, trembling, etc.
LIABILITY
•Failure to take proper actions to protect a
victim
•Failure to appropriately enforce a court order
protecting a victim of domestic abuse
•Failure to respond at all or in a timely manner
•Failure to provide information to a victim as
mandated by law
•Exhibiting a pattern of differential treatment
or application of the law to domestic violence
cases.

PREVENTION
•A majority of domestic violence cases
are misdemeanors.

to file. Corroborate any statement.
•A complete investigation will mitigate
future responses by our agency.
